BOISE, Idaho — Convicted child killer Joseph Edward Duncan III told a federal judge Friday that he wants to represent himself at his sentencing hearing.
A jury is being chosen to decide whether Duncan should be put to death for the abduction and slaying of 9-year-old Dylan Groene in 2005.
"I don't have an issue with counsel personally," Duncan said in court. "It's ideological. I don't believe that they can ethically represent my ideologies."
Duncan did not elaborate on what those ideologies are. But authorities have examined an Internet blog that he kept for months before the slayings which documented his internal struggle against right and wrong, railed against the ostracizing of convicted sex offenders, and offered religious views.
Duncan pleaded guilty in December to 10 federal crimes stemming from the 2005 kidnapping of Dylan and his then 8-year-old sister, Shasta Groene. Both were taken from their Coeur d'Alene home in May 2005 and sexually abused before Duncan shot and killed Dylan at a campsite in western Montana.
Duncan previously pleaded guilty in Idaho state court to killing the children's mother, Brenda Groene; her boyfriend, Mark McKenzie, and 13-year-old Slade Groene at the family home.
If Duncan represents himself, it could put him in the position to cross-examine Shasta Groene, the sole survivor of the murders and abduction.
It is not yet clear if either side expects to call Shasta as a witness.

Jet Duncan deserves his own section of Hell.
I think, were I a judge, I'd have Shasta testify on videotape. There are ways to circumvent the kind of trauma Duncan would put her through on the stand. Duncan wants to hurt Shasta, he will enjoy it, and he will do it in such a way that it is more painful to her than it needs to be.
This is a case where a well-placed bullet to Duncan's head would be a blessing for that little girl.

Lawyers serving as standby counsel for a man who murdered a family to kidnap and sexually abuse two children asked to withdraw from the sentencing phase of his federal case on Wednesday, but the judge refused.
The attorneys said they could not ethically continue as standby counsel for Joseph Edward Duncan III, who is representing himself, because he apparently intends to base his defense on an irrational and incomprehensible world view.
"We are not mouthpieces, we are not gunslingers ... that do the bidding of someone whose rationale we do not share and whose view of the world" is irrational, said Judy Clarke, one of Duncan's standby counsel. "We feel that the request is beyond what we should be asked to do ... beyond what our professional ethics allow us to do."
U.S. District Judge Edward Lodge, however, directed that they remain on the case, saying he would not allow it to be delayed any longer.
Jury selection resumed Wednesday after a more than three-month delay following Duncan's request to represent himself. During that time he underwent a battery of psychological tests and Lodge ruled late last month that he was mentally competent to serve as his own attorney.
Duncan is facing the death penalty after pleading guilty to 10 federal charges in the kidnapping of two northern Idaho siblings, ages 8 and 9, and the murder of the older child in 2005. The 8-year-old was rescued; it is unclear whether she will testify in the sentencing phase.
The children were taken from their Coeur d'Alene home in May 2005 after Duncan fatally bludgeoned their brother, their mother and her fiance. Duncan has pleaded guilty in state court to those three murders, which also could lead to a death sentence.
During jury selection, four potential jurors said seeing Duncan act as his own lawyer could affect their ability to be impartial.
"If he is able to come face to face with the little girl, that's ethically wrong," one potential juror said. "That's not right _ it's like abusing her again."
Clarke said Duncan doesn't intend to present any evidence about his own traumatic childhood or mental state as she and his other standby lawyers recommend.
"We do not share his theory of the case to the extent we can understand his theory of the case," Clarke said.

Duncan is representing himself at his death penalty hearing, joining federal prosecutors Wednesday morning in choosing a jury for the process. Duncan's standby legal counsel, Judy Clarke, has said Duncan doesn't plan to offer any mitigation, such as evidence of his own traumatic childhood.
Opening arguments were expected to begin Wednesday immediately following jury selection.
Duncan isn't new to the legal system. His past is littered with arrests and prison time for crimes ranging from car theft to rape and molestation. He is suspected in the 1996 slayings of two half-sisters from Seattle, and is charged with the 1997 killing of a young boy in Riverside County, Calif.
In 2005, he came to Idaho. He stalked a family and then entered their Coeur d'Alene home, murdering 13-year-old Slade Groene, his mother, Brenda Groene, and her fiance, Mark McKenzie. Then he kidnapped the two youngest, 9-year-old Dylan Groene and then-8-year-old Shasta Groene.
He pleaded guilty to those murders in state court in 2006, and in January 2007 the federal government charged him with 10 felonies for the trauma he inflicted on Dylan and Shasta. They were threatened, sexually abused and tortured in the remote Montana wilderness, where Dylan was killed, according to court documents. Then he packed up Shasta and returned to Coeur d'Alene, stopping in the middle of the night for a meal at a Denny's restaurant, where a waitress recognized Shasta and called police.
In December, Duncan pleaded guilty to the federal charges, clearing the way for a jury to decide his fate.
The case won't be easy, the judge has warned potential jurors. They'll have to review horrendous evidence, including a videotape Duncan made of the "sadistic sexual abuse" of Dylan. They may hear poignant testimony from Shasta, the sole survivor.
What they likely won't hear is any mitigating evidence designed to lighten Duncan's culpability.
Former defense attorneys are serving only as "standby counsel," a sort of legal resource for Duncan as he presents his case.
Clarke has argued in court that Duncan is irrational and not mentally competent to represent himself. U.S. District Judge Edward Lodge disagreed.

A jury that will decide whether a convicted pedophile should be executed listened Wednesday as a prosecutor graphically described how the man killed members of an Idaho family, abducted two children and abused the youngsters at a campsite before murdering one of them.
Joseph Edward Duncan III, who is representing himself, told the 12-member jury in his opening statement that the prosecutor's narrative was "fair and accurate up to the point of what occurred at the campground."

BOISE - We've long known that Joseph Duncan kidnapped the two youngest Groene children and took them to a remote campsite in the Lolo National Forest in Montana, but prosecutors focused on another campsite - one that may have foreshadowed Duncan's plans.
In the week or two leading up to Duncan's attack at the Groene family home in Coeur d' Alene, it appears he had a different plan in the works.
In another remote campsite, in another forest, Duncan was camping and collecting children's items. In the Kootenai National Forest in an area known as Stryker, detectives found three small children's plastic swimming pools and a little girl's bicycle he stole from a residence days earlier. Police also found a tripod at the site, which was already set up.
The Federal Bureau of Investigation was able to find Duncan's campsite in Stryker through the global positioning system in his stolen Jeep.
That GPS also revealed numerous other suspicious stops, homes... all with the common denominator of children's play equipment in the yard.

Yikes...I've been camping near Stryker (but well before JED was there)
I found this old article indicating he may have also been cruising neighborhoods in Missoula before heading west.
I-90 runs through Missoula west to Coeur d'Alene. It's a lovely drive.
The article states that the Groene family lived close to the interstate. How fucking convenient.

Federal prosecutors showed the video as part of their efforts to persuade the jury to recommend the death penalty for Joseph Edward Duncan III. He kidnapped the boy, Dylan Groene, and his sister, Shasta, in May 2005 after murdering their older brother, their mother and her fiance. The two young children were taken deep into the Lolo National Forest, where they endured weeks of horrendous abuse at the hands of Duncan.
Duncan ultimately shot the boy point-blank in the head while his sister, then 8, watched. He was arrested after returning to Coeur d'Alene, where a waitress recognized Shasta as the two ate at a Denny's restaurant.
The videos and photos taken at the cabin show Duncan forcing the boy to perform a sex act, whipping him with a belt and hanging him with a wire noose until the boy passed out.
"The devil is here, boy, the devil himself. The demon couldn't do what the devil sent him to do so the devil came himself," Duncan yells in one video. "The devil likes to watch children suffer and cry."
Duncan covered his face as parts of the video were shown, and jurors frequently shot him looks. Two of Duncan's standby attorneys also avoided looking at the screen.
Duncan, a convicted pedophile originally from Tacoma, Wash., has pleaded guilty to federal and state counts including murder. The federal jury is considering the death penalty on charges related to the kidnappings and Dylan's murder, but he also could face execution on state counts in the other three killings.
After releasing Dylan from the noose, Duncan promised to take him to the hospital so his injured neck could be treated. He also promised to tell hospital staffers where to find Shasta, who had been left back at the campground, so they could come find her. He kept neither promise.
After that, Duncan offered to let Dylan watch the video of his "death," then wandered away from the camera where he could be heard singing part of the Lord's Prayer

Those poor jurors, they will live the rest of their days with those awful, sick and disgusting images in their heads. With no way to bleach their brains.

That was what was thinking but changed my mind when I saw he is not going to do any mitigating factors in the penalty phase. Virtual guarantee of a death sentence. He is a chickenshit and wouldn't want to be bored.

Convicted killer Joseph Duncan is spending Monday being sentenced on a litany of charges related to the devastation he brought on a North Idaho family in 2005.
Duncan first faced a judge via video-conference to be sentenced on state charges. The judge, located in Coeur d'Alene, handed down three life sentences for the murders of Brenda Groene, Slade Groene and Mark McKenzie. Those sentences are fixed and will be served concurrently.
Later Monday morning, he was sentenced for seven more charges - including three additional life sentence for kidnapping and two counts of aggravated sexual abuse.
He was also sentenced to ten years each on four additional miscellaneous counts.
All together, Duncan has been sentenced to death, six life sentences and an additional 40 years in prison.
He could still face charges in California on separate crimes he is accused of.

But despite his self-described epiphany, Duncan remains delusional and incompetent to stand trial for the 1997 murder of a 10-year-old Beaumont boy, Dr. Art Kalechstien said.
Kalechstien was the fourth witness called as a witness for defense attorneys to pronounce Duncan incompetent. Two other psychologists called by the prosecution have said Duncan is not mentally ill and able to stand trial.

If found competent, the case will go to trial. If not, the case will be held until he is found competent. He has confessed to abducting and killing 10-year-old Anthony Martinez. By forcing a trial, he wants just another platform to shout his craziness from.

The Riverside County Superior Court has appointed a special investigator on behalf of a man being tried for the murder of a 10-year-old Beaumont boy.
Judge David B. Downing appointed private investigator Enrique Tira to work with Joseph Edward Duncan during his upcoming capital trial.
Downing assigned the investigator to help Duncan prepare his defense, subpoena victims and collect evidence. Tira is being paid $75 per hour by the county without a cap, according to court records.
Duncan is representing himself on Riverside County charges for the 1997 kidnapping and killing of Anthony Martinez, who was taken from his Beaumont home. His body was found nearly two weeks later bound with duct tape and beaten with a rock.
Duncan has already received three death sentences and nine life terms for killing a family of four in Idaho. According to court records, he has confessed to Anthony's killing, but pleaded not guilty.
Both the Riverside County public defender's office and the Desert Conflict Defense Panel have rejected the case, citing a strain on resources.
The judge said last year that Duncan needed stand-by counsel to be ready to take the case if Duncan decides he needs an attorney or the judge ruled he can't represent himself. No attorneys have been assigned.
A trial is scheduled to begin in September. Duncan was ordered to appear Feb. 26 for a scheduling hearing.

A prosecutor has agreed to meet with officials at the Riverside County Jail in Indio and the investigator for a confessed child killer who requested a laptop computer so he can prepare his defense to charges of killing a Beaumont boy.

Downing said that provision “doesn't work.”
Deputy District Attorney Otis Sterling initially told the judge that he has already fulfilled his obligation to provide Duncan with all the documents in the Riverside County case.
Sterling said his office was working on redacting witness names and other sensitive information from documents in the Idaho case.
“The laptop issue is between the court and Mr. Duncan,” Sterling said.
Downing expressed his frustration at the prosecutor's response.
“I retire in 21 months. In that time, it is my goal to get all the cases tried that are assigned to me,” the judge said, noting that Duncan's trial cannot go forward until he is given access to all documents.
Duncan, who was given unrestricted access to a laptop in Idaho, told the judge that he needs a computer to handle all of the documents, but that he was open to allowing his investigator, Enrique Tira, to handle all of the discovery.

When ever I see this page updated I always feel shocked or surprised for some reason..maybe my unconscious is just hoping Duncan would disappear.
Truly he has to be one of the most evil people to ever exist. I am all about giving people a fair trial and (trying to) presume their innocence and plead their case. then there a few that just need put down, fuck a long trial, fuck life in prison, do the world a favor and eliminate these evil creatures.

Convicted Child Killer Now Wants Lawyer for Trial
An already condemned child killer who is currently representing himself against charges stemming from the kidnap-murder of a Beaumont boy now says he wants a lawyer, a public defender confirmed Friday.
Joseph Edward Duncan III, 47, faces first-degree murder and other charges stemming from the April 1997 abduction and slaying of Anthony Martinez.
Duncan, who has already been sentenced to death for the slaying of a boy in Idaho, could receive another death sentence if convicted in the Riverside County case.
"He's asked to have counsel appointed," said Deputy Public Defender Richard Verlato, who was part of a defense team that previously represented Duncan, who began acting as his own attorney in September 2009.

"Of course it is all up to Mr. Duncan. He has to say the words, `I want an attorney," and the court, I think, would appoint an attorney for him," Verlato said, adding that he could not discuss the reason Duncan changed his mind.
Duncan is due in court Oct. 4 for a hearing on the matter.
Last month, Riverside County Superior Court Judge David Downing told Duncan he would have a year to prepare for trial.
The judge recently allocated funds for Duncan to have access to a personal laptop to help prepare his defense.
Duncan has indicated he does not deny the allegations against him, but cannot plead guilty because of a California law that stipulates a defendant must be represented by an attorney and have that lawyer's consent to enter a guilty plea in a potential death penalty case. ..

Truly he has to be one of the most evil people to ever exist. I am all about giving people a fair trial and (trying to) presume their innocence and plead their case. then there a few that just need put down, fuck a long trial, fuck life in prison, do the world a favor and eliminate these evil creatures.

It's a stall tactic. First he wants to rep himself, waits a few months.. then wants a lawyer. He's just dragging his heels because he knows this time he WILL see that needle coming for him in the end. At least, he will if there is any justice at all.

Duncan Attorneys Propose Plea Deal To D.A.'s Office
KESQ.COM - Attorneys for already-condemned child killer Joseph Edward Duncan, III, have presented a proposed plea agreement to the Riverside County District Attorney's Office, which is slated to make a decision on whether to accept the offered deal on March 7.
Duncan is accused in Riverside County in the 1997 kidnap-murder of a Beaumont boy and was convicted in another state of other killings. Details of the settlement were not made public.
Duncan, 47, who has already been sentenced to death for the slaying of an Idaho boy, would face capital punishment if convicted by a jury of abducting and killing 10-year-old Anthony Martinez.
He was extradited to Riverside County in January 2009 to stand trial in the Beaumont killing.
Duncan had been representing himself until a new defense team was appointed last October. He relieved his earlier attorney in August 2009, when he was deemed competent to stand trial by a jury.

Duncan ultimately shot the boy point-blank in the head while his sister, then 8, watched. He was arrested after returning to Coeur d'Alene, where a waitress recognized Shasta as the two ate at a Denny's restaurant.
The videos and photos taken at the cabin show Duncan forcing the boy to perform a sex act, whipping him with a belt and hanging him with a wire noose until the boy passed out.

Part of me says California should have stayed out of this.....only because even if he does get the Death Penalty the worst that happens to him is he sits on Death Row at San Quentin until he is old and frail, AND he will most likely be in solitary confinement for the duration of his sentence. So to me it seems they should have just let him rot at Supermax in Colorado.
Although in CA at least their is a chance that a guard could "accidentially" let him out into general population and let karma take over........

Court records show Joseph Edward Duncan III entered the plea in Riverside County Superior Court on Tuesday.
Duncan was charged with killing and torturing 10-year-old Anthony Martinez, who was abducted in 1997. His body was later found near Joshua Tree National Park.

Jet Duncan deserves his own section of Hell.
I think, were I a judge, I'd have Shasta testify on videotape. There are ways to circumvent the kind of trauma Duncan would put her through on the stand. Duncan wants to hurt Shasta, he will enjoy it, and he will do it in such a way that it is more painful to her than it needs to be.
This is a case where a well-placed bullet to Duncan's head would be a blessing for that little girl.
Duncan will surely a person who don't want to loose a case. I hope that the judge will be objective in that case. :D

Death sentences overturned for Joseph Edward Duncan III
Federal death sentences imposed on a child killer whose victims included a 10-year-old Beaumont boy were overturned Monday by the U.S. Ninth Circuit Court of Appeals, which questioned the defendant's mental competence.
Joseph Edward Duncan III, 48, was convicted in August 2008 of murdering an Idaho family, two of whose members — both children — he abducted and used as sex slaves for weeks before one was rescued.
More than a decade earlier, Duncan abducted Anthony Martinez from his Beaumont neighborhood after luring the youngster to his car with the promise of money for helping him find his lost cat. He then raped and killed the boy.

At his federal trial in Boise, Idaho, Duncan confessed to all the murders and special circumstance claims.
Before his penalty trial got under way, the previously convicted child rapist insisted on representing himself. His attorneys objected that he wasn't mentally competent and asked for a competency hearing.
Three psychologists retained by the defense raised doubts about Duncan's ability to comprehend the legal process. However, two state-appointed psychologists found that the defendant was not delusional and ‘‘could understand the nature and consequences of the proceedings against him,'' according to the Ninth Circuit's findings.
The trial judge allowed Duncan to represent himself, and he offered no defense, resulting in unanimous jury recommendations that he be executed for the Idaho killings.
He had already pleaded guilty in Idaho state court and was sentenced to multiple life prison terms. Prosecutors in Kootenai County, Idaho, have reserved the right to conduct a penalty trial, leaving open the possibility that Duncan could yet face capital punishment at the state level.
According to the Ninth Circuit's ruling, there was sufficient basis for the judge who presided in the federal case to order a competency trial for Duncan before the penalty phase of his murder trial began.
The panel quoted the defense's experts, who referred to Duncan's bizarre ramblings about religion and his way of life as evidence of ‘‘delusional beliefs, paranoia, grandiosity and psychotic breaks from reality.''
The appellate court also pointed out that a magnetic resonance imaging study showed the defendant had an ‘‘unusual brain structure consistent with behavioral deficits in the ability to make rational plans and modulate emotions.''
The Ninth Circuit remanded the case back to the trial court for a review of whether Duncan is competent. If there's a finding that he isn't, the previous death sentences must be vacated and a new penalty trial held.

Justice is not only served by death. A LWOP sentence suffices in most states. Is that any less justice? Do states without the DP not serve up justice??
All the Federal Court is doing by overturning the Death Sentence is sending it back to reexamine if he was a nut case. We don't execute cuckoos. If he's found sane, he will be resentenced to death. If not, he'll get LWOP.
The state of Idaho could also rule to put him to death. However, if he's found to be incompetent, they probably wouldn't do it. They don't execute cuckoos either.
I would like to see him dead. Why should any prison system have to put up with him? I doubt he adds much entertainment value for the guards and isn't allowed out of his room often. Maybe they can medicate him to sanity. But justice is served even if he's allowed to live and spend his days alone in a little cell.

No state can execute a looney because it has been deemed to be against the 8th Amendment (cruel and unusual punishment) by the Supreme Court.
I just really need this fucker to die so I can feel better. It's Justice for most people to get LWOP, but like I said before this asshole just NEEDS killing, IMHO. What he did was beyond evil and I would rather live in a world where people like this don't exist or are not allowed to continue to anyway.

Court Denies Joseph Edward Duncan's Appeal
The U.S. Supreme Court has refused to hear an appeal from a man who killed three members of an Idaho family so that he could kidnap their small children. The court decided that it would not consider the appeal of Joseph Edward Duncan III on whether or not he was competent when he decided to waive his appeal in his 2008 death penalty case.
The high court's decision returns the decision to the U.S. District Court which will conduct a hearing on the issue.
Duncan was sentenced to die for the kidnapping, torture and murder of 7-year-old Dylan Groene after he killed his mother, brother and mother's boyfriend in their home. He also abducted 8-year-old Shasta Groene.
During the sentencing phase of his trial, Duncan decided to represent himself in spite of being appointed three defense attorneys who were ordered to help him as he represented himself.
Retrospective Hearing Ordered
At the time, Duncan's attorneys objected to the plan because they believed he was not competent to represent himself. U.S. District Judge Edward Lodge had Duncan examined by a psychologist who found that Duncan was not delusional and was capable of representing himself.
But Judge Lodge did not hold a hearing on the issue. Last year, the 9th U.S. Court of Appeals ruled that the judge should have held a hearing before making a decision. [...]

BOISE, Idaho (AP) -- A man convicted of killing children in Idaho and California has returned to U.S. District Court in Boise to prepare for a review of part of his death penalty case.
Joseph Edward Duncan III was in court Thursday while U.S. District Judge Edward Lodge began the process of selecting an attorney to represent him in a competency hearing. An appellate court ordered the hearing last year after Duncan's former attorneys argued he wasn't competent to waive his appeals.
Duncan was sentenced to death for the 2005 murder of 9-year-old Dylan Groene. Prosecutors said Duncan snatched Dylan and his sister from their Coeur d'Alene home after killing three family members. Duncan also was convicted in California of killing a 10-year-old boy. He confessed, but wasn't charged, to killing two Washington girls.

The father of two children who were kidnapped by registered sex offender Joseph Edward Duncan III in Idaho is suing his sister-in-law who set up a bank account for donations to benefit the two siblings. Steven Groene filed suit against Brandy M. Hoagland, the aunt of Shasta and Dylan Groene, who were kidnapped in May 2005.

The case made national headlines and during the height of the media coverage, Hoagland set up a donation fund for the children. Hoagland is the sister of Brenda Groene who was killed along with her boyfriend, Mark McKenzie, and son, Slade, on the night Duncan abducted the children.
Misappropriated Funds?
The lawsuit claims that Hoagland has refused to account for the $48,000 donated by the public to the children's fund and has failed to use the fund for the children's best interest.
The lawsuit also claims that Hoagland paid some of the money to third parties who weren't entitled to be paid. When the "Shasta and Dylan Groene Fund" was established the children were listed as the beneficiaries.
Steven Groene's lawsuit also asks that Hoagland replace "all funds misappropriated or mismanaged by her."
Duncan Facing Execution
Duncan was sentenced to death in August 2008 by a federal judge for the murder of 9-year-old Dylan Groene. After abusing and torturing both children for several weeks, Duncan shot Dylan in the torso and head while 8-year-old Shasta watched.
Duncan received three life sentences in Idaho state court for the murders of Brenda, Mark and Slade. The Groene case investigation led authorities to charge Duncan with the 1997 death of 10-year-old Anthony Martinez in Beaumont, California. Duncan received two life terms in California for the Martinez murder.
