Hong Kong's top court has overturned the conviction of American woman Nancy Kissel for the murder of her investment banker husband.
The court ordered a retrial for Kissel, jailed for life for putting sedatives in her husband Robert's milkshake and bludgeoning him with an ornament.
Her lawyers say prosecutors breached evidence rules during the trial.
The 2005 case heard tales of wealth, adultery, cocaine abuse, violent rows, greed and unhappiness.
"The court unanimously allows the appeal, quashes the conviction and orders a re-trial," Court of Final Appeal Chief Justice Andrew Li said.
The 45-year-old mother of three, who lost her first appeal, has been serving a life sentence since she was convicted.

Kissel had admitted killing her husband, a banker at Merrill Lynch, in November 2003, but had denied murder, a charge that requires premeditation.
Prosecutors said she had given Robert, 40, a strawberry milkshake spiked with sedatives, before cracking his skull several times with a heavy statuette.
Kissel had tried to dispose of his body by rolling it up in a carpet and putting it into a storage room at the luxury Parkview apartments complex on Hong Kong island.
But the stench soon gave her away.
The BBC's correspondent in Hong Kong, Anne Marie Evans, says the case involving expatriates who seemingly had everything has enthralled Hong Kong.
Revelations at the original trial about the lifestyle of some members of the territory's wealthy elite gripped the public imagination.
Kissel lost an appeal in 2008 based on her claim that she acted in self defence as her husband was threatening her with a baseball bat.
At the trial prosecutors argued that she planned the murder due to her uncontrolled passion for a new lover, a TV repairman in the US.
They alleged that Kissel stood to gain up to $18m (£11m) in life insurance payouts from her husband's death.

wasnt this story the basis of the movie 'The Two Mr Kissells'?? it was on a lifetime channel movie....if so wheres the other wife's charges?? (i think both wives killed off the brothers...i may b wrong....but i remember watching this movie on LMN) and to top it all off, in the movie...the milkshake was delivered to him by his little girl!!

What a crock of shit. She took the time to drug him first. That involves going and getting the sedatives, mixing it with the milkshake, giving it to him, and waiting for the drugs to kick in. And THEN she killed him.
If it was truly self-defense, and she was afraid for her life, why didn't she just drug him and leave? Even if he was a total asshole - which I don't know if he was or not - she didn't have to kill him. That wasn't her only option here.

Nancy Kissel will be indicted again for murder after Hong Kong’s top court overturned her 2005 conviction for killing her husband, a Merrill Lynch & Co. banker, Deputy Director of Public Prosecutions Kevin Zervos said.
“An indictment on a count of murder will be refiled,” probably by the end of next week, he said in an interview today.

The court ruled that hearsay evidence on her intent to kill and cross-examination on bail material made her original trial unfair. Four of the five justices didn’t accept a third ground of appeal, that the trial judge had misdirected the jury on the definition of self-defense.
Clarke also said yesterday that Kissel may apply for an indefinite delay on a retrial, citing the publicity the case has received and the difficulty in getting an unbiased jury.
“The community very broadly has been exposed to very prejudiced views,” Clarke said, referring to how the media dubbed her the “milkshake murderer.”

An American housewife accused of drugging then clubbing her banker husband to death in Hong Kong seven years ago stood trial for murder for a second time Tuesday after the Chinese territory's highest court tossed out her earlier conviction.

Kissel delivered at least five blows to her husband's head while he was lying face down in the bedroom, subdued by a mix of six drugs, Perry said. An American woman twice convicted in Hong Kong of killing her investment-banker husband is now seeking an appeal, MSNBC reported.
Nancy Kissel, 48, was handed a life sentence last March after a jury found her guilty of drugging Robert Kissel with a sedative-laced strawberry milkshake and bludgeoning him to death with a lead ornament.
During the trial -- which newspapers dubbed the "Milkshake Murder" -- Kissel denied the charge of murder, but pled guilty to a charge of manslaughter for causing her husband's death.
Legal counsel for Kissel originally said she was not going to appeal the conviction and hoped to serve her sentence in the U.S., but a court official told the AFP on Friday that the mother of three filed an application to appeal.
With the 28-day deadline to file for appeal already passed, the native of Adrian, Mich., must be given court permission to try to overturn the conviction.
"No date has been set for the hearing," a court spokesperson told the AFP.
Kissel was first convicted and sentenced in 2005, but Hong Kong's Court of Final Appeal cited legal errors and threw out the conviction in February 2010, the Wall Street Journal reported. A retrial began in January 2011 and ended two months later.

April 27 (Bloomberg) -- Nancy Kissel, who was retried in Hong Kong for the murder of her Merrill Lynch & Co. banker husband, didn’t appeal her second conviction and may apply for a transfer to a U.S. prison, her lawyer said today.
“My understanding is that she wishes to make an application to serve her sentence in the United States,” said Kissel’s lawyer Colin Cohen. The 28-day period for Kissel to file an appeal expired on April 23.
