Scott Wynkoop will have to wait until at least May 1 to learn whether he will be sent to prison for an alleged probation violation -- showing up drunk for a weekend in jail.

Eleven months ago, Wynkoop avoided a 10-year prison term for a manslaughter conviction in the death of his 9-year-old stepdaughter while trying to beat a 138-car freight train.

Instead, Brown sentenced Wynkoop, 43, to 10 years of probation with a special condition that he serves 364 days of weekends in the Palm Beach County Jail.

But the break came with a stern warning: Slip up and you're going to prison for the full 10 years.

In 2005, Wynkoop, 43, drove his Mazda around flashing lights and railroad guard gates and into the path of a oncoming 138-car freight train whose horn was sounding.

The train pummeled his car, killing Wynkoop's stepdaughter, Samantha Rosales. Wynkoop testified at trial that he never heard the train or saw the lights.

So, are they handing out driver's licenses to blind and deaf people these days? And I thought the roads were already unsafe enough.... :eek:
