HANCOCK — A Pennsylvania man has been charged with injuring a 5-week-old infant in his care on Sunday, according to a Washington County Sheriff’s Department press release.

Nicholas Ray McKee, 22, of 453 Flickerville Road in Warfordsburg, Pa., was charged Friday with first-degree assault and first-degree child abuse, deputies said.

The Department of Social Services contacted the sheriff’s department and the Hancock Police Department about the injuries, which appeared to be caused by nonaccidental trauma and happened Sunday at a home in the 100 block of Washington Street in Hancock, deputies said.

The infant was transported to Children’s Hospital in Washington, D.C., deputies said.

The investigation included interviews with family members, social services personnel and medical personnel at the hospital, deputies said.

He's accused of assaulting his daughter the evening of Jan. 3 while her mother, Jordan Appel, was visiting her grandmother across the street, according to court records. The child died Saturday at Children's National Medical Center in Washington.

Dr. Tanya Hinds told investigators that the girl had brain injuries consistent with vigorous shaking, according to court records.

Although McKee gave police a Pennsylvania address, investigators wrote in charging documents that he lived in Hancock with his daughter and girlfriend when the child was injured.

Police say McKee told a social services investigator his daughter had been wheezing and her lips had turned blue. He said that while he was changing her diaper, her legs went limp and he panicked, according to the police report.

McKee said he pushed on her forehead and stomach, trying to get a response, and then flipped her back and forth on her back and belly.

McKee said he then placed the girl on the living room's hardwood floor and listened for her breathing and heartbeat. He told police that when he didn't hear breathing, he started cardiopulmonary resuscitation and then called 911, the report states.

Nicholas Ray McKee, 22, of 453 Flickerville Road, did not have an attorney present at the hearing, but told Circuit Judge Daniel P. Dwyer he intended to hire Benson Thompson III.

“We’ve been speaking with him but haven’t officially hired him,” McKee told the judge.

Monday’s ruling came three days after the Maryland Senate Judicial Proceedings Committee approved a bill that would increase the penalty for child abuse resulting in death to 40 years from the current 30 years. The bill now goes to the full Senate for a vote. A similar bill has been introduced in the House.
