Charges are pending against the teenage parents of a 6-week-old Darlington County girl in connection with her death.

“This case is under investigation, but I can tell you that the mother, 17-year-old Heather Pingitord, and the father, 19-year-old David Rush, will be charged with unlawful conduct toward a child by legal custodian,” Darlington County Sheriff Wayne Byrd said in a press release.

Deputies were called to an area hospital Tuesday morning after Victoria Nikole Rush was brought in by EMS with no signs of life and later pronounced dead. It’s not clear who called EMS.

“The child had injuries consistent with a non-accidental death,” Darlington County Coroner Todd Hardee said in the release.

Victoria’s body was sent to Newberry for an autopsy, after which Hardee ruled the child’s death as a homicide and turned the investigation over to the sheriff’s office.

Investigators called the her parents, who’d recently moved to 1634 Shilow Drive Lot 24 in Darlington from New Jersey, to the sheriff’s office Friday for questioning. Victoria was the only child living in the home with them, sheriff’s Capt. Andy Locklair said.

The nature of the injuries Victoria suffered aren’t being released because of the ongoing investigation, but more charges are possible, he said.

Lack of knowledge about child care is one reason why a teen parent might neglect a child, said Dr. Kathy Saunders, program director and medical examiner for the CARE House of the Pee Dee, a local child advocacy agency.

“The largest part would be lack of education,” she said. “There may be a lack of knowledge and resources and many aren’t able to take their children to the doctor. Kids parenting kids just doesn’t work. They are trying to parent and they are young kids themselves.”

Teen parents have trouble meeting their own basic needs, so they often can’t provide the basic needs for their child, Saunders said.

Others reason for neglect may be a lack of a bond between a baby and his or her parents. Some parents don’t form a bond with their baby at birth, she said.

“They really haven’t attached to the baby,” Saunders said. “If that bond isn’t established ... and they have no in-rooted feelings, then that can lead to neglect.”

In some cases, she said, a parent may have been abused or neglected as a child and, as a result, doesn’t have a role model for child care.

Saunders said many studies have been done over the years that show there are risk factors associated with young, unwed single mothers.

“I know that plays a role in (neglect),” she said. “We know that’s a reoccurring theme.”

Saunders also said she believes the economy has a lot to do with the neglect and abuse of children.

In 2008, the CARE House treated about 800 children. As of June 30, about 500 children have been treated by CARE House staff, with 62 percent of those being physical abuse cases, Saunders said.

“We are going to be over a thousand this year,” she said.

Child neglect can be prevented if parents take advantage of medical resources such as Baby Net, South Carolina’s interagency system of early intervention services for children under age 3.

The state Department of Social Services offers parenting classes and many hospitals offer classes prior to a new parent being discharged.

Additionally, parents can get information from Keeping Kids Safe at Home, a public awareness project that aims to educate residents about he prevention of the maltreatment of children up to age 3. Keeping Kids Safe at Home is offered through Prevent Child Abuse Pee Dee, a program of the Pee Dee Coalition Against Domestic and Sexual Assault. Adults can obtain information about child care through the coalition’s ChildHelp Pee Dee 24-hour helpline by calling (866) 867-9857.

Heather Pingitore is Innocent maybe the police in darlington should be question David Rush’s Mother about not letting heather see her baby during the 2 day period before the babys death. Pull up davids records and see how much of a messed up individual he is. Heather and I have been down since diapers she wouldn’t hurt a fly. Lack of education and knowledge hey chick she was reading everything she possibly could for 9 months to take care of this baby. There needs to be more questioning to David rush’s parents then anything 4 adults and they knew nothing how is that possible?

I know Heather she is my best friends sister and what these allegations state are completely false!!!! Maybe the jerk off father did it, but heather does not have that kind of mentality do harm a baby, especially her own. So hopefully the authorities down there get it right and not charge Heather with homicide cause she is totally innocent and theres many ppl who will back that up!! Be strong Heather and keep your head up!!!!

At 17 I would have stuck up for my friend too. So those comments don't sway me. And the list of reasons this may have happened piss me off. I was a young parent and she is still alive. Neglect because you are parenting ignorant does not cause death. Abuse by fucktards that shouldn't breed does. And if she was SO concerned over what her man or his mom may have done to her kid, why oh why was she not only still living with him, but had just gotten a new place with him???? I don't for a second believe she was so unaware of the babies injuries, 17 or not. Like Ucat said, that kid never had a chance.

Nell you said it very well. I was 17 when my daughter was born and she is not only alive but a wonderful teenager with a good head on her shoulders. Fuck the "She was a teenager" bullshit. As far as the comments go, I am kinda interested in the two days prior and why mom wasn't allowed to have the baby...

If they were seriously giving their baby's stuff away the day after they killed her they are more fucked up then I initially thought. Fuckers.


Police released the cause of death for a six week old baby in Darlington County Monday. They say the baby girl died of Shaken Baby Syndrome.

Police believe the 6 week old baby girl took her last breath last week at her parents home on Shilow Drive in Darlington County. An incident report says by the time the child was taken to the hospital, she showed no signs of life and was pronounced dead.

An autopsy was ordered.

"Based on the injuries that the child had, we believe the child died from being shaken," said Darlington County Coroner Todd Hardee.

Police have charged the baby's parents, 17-year-old Heather Pingitore and 19-year-old David Rush with unlawful neglect toward a child by legal custodian.

Lymeak Smallwood lives a few houses down from the couple. He says he ran into them a day after their baby died.

"They was like, the baby had suffocated on the little surrounding of the bed or whatever," said Lymeak.

Lymeak says the couple then gave him several of their baby girl's things including a crib, formula, and clothing.

"They was like, do you know anybody who has a baby? I was like, my God sister, and she was like, Do you know want a crib, stroller, whatever?"

Police say Rush and Pingitore could face more charges as the investigation continues.

"We just want to find out what the details are exactly what happened in this case," said Darlington County Sheriff Wayne Byrd.

Byrd says the couple just recently moved to Darlington County from New Jersey.

Bond was denied for the parents on Saturday.

.... I think that the parents were trying to get rid of evidence, first of all. Which is probably the bitter DD part of me. If it wasn't to get rid of the evidence, perhaps it was the first humane thing they have done.... unable to bare looking at things that belonged to that innocent baby...

Sooo...three+ years later I got this PM from Heather.


i would like to tell you personally im not a murderer im a good person and i never hurt my child ive been out of jail almost 3 years and david is in prison if i was such a bad person i would still be locked up i asked for the autopsy because they told me they did not know the cause of death and also i took a lie detector test soo all the people trying to make me look like a monster you are wrong.. ive never even been in a fight before and yes i look crazy in my booking picture i was crying and pissed off ok so if u would like to know everything have some morals and ask dont spread rumors and just because u see shit on the news or press doesnt mean its true so ask me dont spread wrong information about me.

I was a teen Mum too, with a rather unpleasant sperm donor. Also worked with a lot of new Mums over the years, including teenagers. Generally post natal depression is picked up pretty quickly in the Mums in the UK, but very little support for the Dads, and even when the mum is so young she is still expected to take responsibility for the Dads behaviour. Just makes me Grrrrr that with a little support and advice this little one might still be alive.
