Two Joplin residents have been jailed in connection with the death of 11 year-old Tyler Fecko.
Dale Phillips, 27, and his girlfriend Linda Petrait, also 27, are in custody at the Joplin City Jail pending the filing of formal charges in connection with the suspected alcohol-related death of Phillips’ nephew, Joplin police Cpl. Chuck Niess said.

Tyler Fecko was discovered unconscious and not breathing shortly before 10 a.m. inside the couple’s home at 813 Central St. The boy died Monday of suspected alcohol poisoning.

Fred Phillips said his great-nephew ... apparently awoke during the night, went to the refrigerator and drank from a bottle of whiskey unbeknownst to the family.
“He (Tyler) woke up during the night and they didn’t know it,” Fred Phillips said.
Tyler then returned to bed.

In the complaint filed in Jasper County court today, the two knowingly "acted in a manner that created a substantial risk to the life and body and health of Tyler Fecko.

Adults don't realize children can't metabolize alcohol. They think they just get drunk faster. And unfortunately they find out the hard way, the child dying.
I've seen parents feed their children liquor. They think it's funny. I've been on calls where this scenario played out for the worse. What started as a game of "see the kids act stupid" quickly turned into the mother scratching the hell out of me as we tried to establish an airway and start CPR. Her child didn't make it. And the whole time her screams of "We came here for fun. This ain't fun" No shit people. It "ain't" fun watching a child die from alcohol poisoning. Ain't fun at all.

this pisses me off SOOO EFFING MUCH!!! This is because this reminds me all too well of my inlaws the kind of people who like to get drunk and get the police involved NIGHTLY.
They used to tell my husband and his 3 brothers that they were PARTY POOPERS and PUNISH THEM when they wouldn't drink with them when they were in fuckin ELEMENTARY SCHOOL. They all got taken away so many times once for the 2nd oldest going to school drunk in SECOND GRADE!!!
Oh god I hate them just as I hate these idiots here on this page. Real fuckin funny to give a kid alcohol.
Also these are some ROUGH looking 27 year old adults. But alcohol will do that.
And they wonder why they aren't allowed to see my daughter / their granddaughter. My sister in law however has no problem dropping her one year old off.... sigh.

It "ain't" fun watching a child die from alcohol poisoning. Ain't fun at all.I know first hand that this is not fun watching a child die in this way. You try to do all you can to help a child like this and you stand helplessly there when they die. Yes, nurses do cry when a child dies.

That is so sad!
I doubt it was an accident where the kid took a drink by mistake from the fridge. If he did take a drink of whiskey by mistake, would that be enough to kill him? If he did take a drink by mistake I doubt he would take another! Whiskey!

Child endangerment charges have been filed in the death of an 11-year old Joplin boy who might have gotten so drunk that he died.
Tyler Fecko was found unconscious yesterday morning at his uncle's home. He was taken to a Joplin hospital where he was pronounced dead.
Court documents say the uncle, Dale Phillips, challenged the boy to a drinking game in which Phillips' girlfriend, Linda Petrait, also took part. Both are being held on 50-thousand dollars bond.
The preliminary cause of death is listed as alcohol poisoning. An autopsy and toxicology tests will determine the official cause of death. Officials say the results might not be back for several weeks, however.

Joplin resident Linda Petrait pleaded guilty today to second-degree murder in the alcohol-poisoning death two years ago of 11-year-old Tyler J. Fecko.
The trial of Petrait, 29, was scheduled to start Tuesday in Jasper County Circuit Court on charges of second-degree murder and first-degree child endangerment. Instead she changed her pleas to guilty on both charges in a deal with the Jasper County prosecutor’s office.
The plea bargain would limit the prison time she might receive on the murder conviction to 13 years and five years for the other conviction. The deal calls for both terms to run concurrent. Circuit Judge David Mouton has ordered completion of a sentencing-assessment report prior to sentencing of the defendant in January.
Petrait, the girlfriend of Fecko’s uncle, Dale G. Phillips, 29, was accused of playing a drinking game with the boy that led to his death. Phillips also faces charges of second-degree murder and first-degree child endangerment. Missouri woman sentenced to 13 years in prison in alcohol poisoning death of 11-year-old boy
JOPLIN, Mo. — A southwest Missouri woman has been sentenced to 13 years in prison in the alcohol poisoning death of an 11-year-old boy.

Her family told the court she loved Tyler Fecko. But his mother, Angie Edwards, asked rhetorically, "What was she thinking?"
Petrait pleaded guilty in October to second-degree murder and felony child endangerment. Without the plea, she could have faced a much longer sentence.
Her 29-year-old boyfriend, Dale Phillips, also was charged in the July 2009 death of Tyler, who was his nephew. Authorities said the two Joplin residents were playing a drinking game with the boy while he was staying at Phillips' apartment.
Phillips is set to go to trial Feb. 7.
