Authorities say Penny Anita Lowry was 19 when she gave birth to a baby girl on the banks of Jake’s Lake in McIntosh County.

She was 37 when investigators received the DNA test results they say proves she was the mystery mother who ran away from the lake 18 years ago with the man investigators said smashed the newborn’s head with a brick and stuffed the body into a light green trash bag.

Oklahoma State Bureau of Investigation agents interviewed Lowry in 1991, six days after the baby’s body was found. Lowry denied she had recently given birth or that she had even been pregnant, according to an arrest affidavit.

When agents approached her again last week with DNA evidence, she confessed, the affidavit states.

A man witnessed the death, authorities said. Before he was sent to prison for burglary in 2000, Joseph Barnes was seeing a psychiatrist to help him deal with the things he told investigators he saw on Nov. 12, 1991.

Barnes was hunting near Jake’s Lake, about 10 miles east of Checotah, when he heard a woman scream, the affidavit said. He said he continued to watch as a man squatting in front of the woman raised his right hand and swung downward.

Because of the distance across the lake, OSBI spokeswoman Jessica Brown said, Barnes didn’t realize he was watching the woman give birth until he tore open the bag and found the dead infant. He found a towel and brick next to the bag, the affidavit said.

Barnes told authorities he tried to catch the man and woman, who ran from the scene, but they reached a car and left the lake "real fast.”

McIntosh County investigators found a newborn baby girl of mixed race and DNA evidence from the mother at the scene. Barnes told police the man and woman he saw were white.

State investigators asked for the case to be opened again in 2003 and reworked with the latest DNA methods, Brown said.

Last month, the FBI was able to use the DNA profiles of the parents to identify the child’s father as a man in California. The mother was identified as Lowry.

The newborn’s father was not considered a suspect, Brown said, because he was a different race from the man described by Barnes.

Imagine being told that you were the father of a baby who's head was smashed in the day it was born.....

The child you probably never knew existed. Until that day they knocked on your door and told you....

damn, it makes you wonder why she was so callous. Could it have been like so many before, where they cheated on their boyfriend/spouse, and when the child was born, it was tossed away?

I hope she answered this. And I hope to hear why she let it happen.

i saw this story years ago on "America's Most Wanted"; it's stayed with me ever since. the only witness (who was not shown or heard) was quoted as saying he believed the man who murdered the baby was native american. that just stuck in my mind. since this story tells us the husband is not the father of the baby b/c he is of a different race, could be we have a motive? evil, evil . how could they live 18 years with the memory of that murder?

Yikes...I would be a mess too seeing such a sight. I cant even begin to imagine. If thats what guilt does to ones face....I will be sure to not indulge.

How can you look a newborn baby in the face, and then smash it with a brick? Whether the child is of relation to you or not, how can you be so inhuman as to do such a thing?

Damn that bitch killed her baby six days before I had my oldest one.. I read that and the memories of all that the last 17 and 1.5 years flooded me. I wouldn't trade any of those moments for a million dollars.
I remember when she was 5 months old and cut her first bottom tooth and when she was 13 1/2 months old she cut 4 teeth the night before I had Tina.. We did not sleep that night because all she wanted was mommy to hold her. I gave her baby ty and rocked her and everytime she went to sleep I would lay her down and she would open her eyes and whine not cry just whine and I would pick her up and she would hush. I was dilated 6 ci when I went to hospital at 6:30 that morning and had no idea I was in labor. Broke my heart to leave her with mommy but she was able to stay with me at the hospital for awhile. There are so many other memories that I won't bother you all with but they are priceless and precious

That bitch has robbed her child the chance to laugh for her, dance and sing with her. Play basketball in school: learn to ride a bike: learn to ride a 4 wheeler and it fricking pisses me off and makes my heart hurt thinking about the pain that baby went through before she died.. I would love to kick her fat fucking ass!

I had my first child when I was very, very young, so young that all I will say is I am 35 and will be a grandma in Sept. age is no excuse. I did it, I am sure women younger than me have done it. My kids survived their years with me. This bitch is stone cold, when I see a baby, not even mine, I want to hold it. How in the fuck can you bash one's head in?

I hope every single day of those 18 years was filled with guilt.

Wouldn't it be strange if she can't remember the last name of the guy who "helped' her? Maybe she will do time for both of them. Don't get me wrong, he needs to pay too, but I hate her more because she was the mother.....she should have died to protect that baby. Maybe the guy died some kind of horrid death and is now getting his in hell and she will still need to take the fall for both of them. Fuck she is UGLY!

One of my best friends had a baby at 12 years old. She was in Ukraine, and it was only by the grace of her parents that she wasn't forced to marry the father (26 years old), but she WAS forced to grow up real damn fast, take care of her baby, AND essentially raise her two younger siblings at the same time.

Her kid is now 7 years old and is probably the sweetest and least bratty kid I've ever met.

I admire that the cold case guys picked this one back up (or kept it going) for so long. I know they had suspicion back in '91 and it was just a matter of getting the DNA, but it's probably a lot more gratifying to work on a cold case where there are people begging you to re-open it, or where there are loving parents who lost a kid. These people took up a fairly thankless case, but they stood up for a life that wasn't able to be lived.

Lowry staunchly refused to name the man who authorities believe either killed or helped kill the newborn, Iski said.

The outpouring of emotion for the infant was immense in 1991, she said. Several Checotah residents and others donated money so the infant could be buried properly, she said.
