A former Vancouver resident who won the right to withdraw her 2007 guilty plea to murder in the death of her son has returned to the Clark County Jail.

Kelly N. Meining, 34, arrived at the jail June 19 from the Washington Corrections Center for Women in Gig Harbor.

Meining made a brief court appearance Monday in Clark County Superior Court, and will return to court Thursday for arraignment.

Prosecutors have re-filed a charge of first-degree murder in the May 19, 2006, stabbing of 20-month-old Bryce Jasper Meining.

The married mother of three pleaded guilty Sept. 12, 2007, to first-degree murder.

She was sentenced three weeks later to 24 years in prison.

But while at the sentencing she said, "I murdered my son, and there are no excuses. He was supposed to be safe with me, his mom," she later asked to withdraw her plea.

Her appellate attorney successfully argued that the prosecutor, judge and defense attorney failed to give adequate warning that first-degree murder carries a mandatory minimum sentence of 20 years.

In a March ruling, the Court of Appeals noted, for example, that the written plea offer from prosecutors said the "statutory minimum" sentence is 20 years but did not make it clear that the minimum sentence is mandatory.

Now prosecutors are back to square one.

Fighting to withdraw her guilty plea could be an indication that Meining wants to now try a mental-health defense.

At the 2007 sentencing, Meining’s parents said their daughter has been diagnosed with bipolar disorder, schizophrenia and postpartum psychosis. Meining’s court-appointed attorney said he had wanted to pursue an insanity defense, but Meining objected. Senior Deputy Prosecutor John Fairgrieve said, however, that Meining’s mental health problems were not serious enough to be a mitigating factor.

While I know that there are laws and sentences and bla bla fucking bla....does one really need warning that when you murder someone, especially YOUR BABY, that you are probably looking at some serious time in prison? Really? Seriously? The laws SHOULD be, murder your child, we murder you back...in the same manner. Fat fucking ham beast fucking murdering cunt. If I get on the presidential ballot one day...who will vote for me???

VANCOUVER, Wash. - A Vancouver mother pleaded guilty in Clark County Superior Court to first-degree murder in the 2006 stabbing death of her 20-month-old son.

Court records say that Kelly Meining, 32, told detectives that she killed her son, Bryce Jasper Meining, because she believed other people were going to kill him.

She had been scheduled for an insanity hearing in October. But Meining waived her right to any further mental evaluations in court Wednesday when she pleaded guilty.

Meining's father said he thinks she understands what she has done and would rather go to prison than a mental hospital.

"From her comments that she was remorseful, she decided for one reason or another she was going to plead guilty to his murder," Paul Reed said.

But Reed added that she suffered from post-partum depression and he was upset by the decision.

Meining's sentencing was scheduled for October 2. She faces a maximum of almost 29 years in prison.

She was willing to plead guilty until she found out what the consequences were, what a LOSER! She IS guilty, whether insane or not. She stabbed her baby to death and that is heinous...I don't give a fuck if she was crazy or not she needs to be locked up forever or die. If she is so crazy that she is willing to inflict that kind of pain and suffering on her own baby then she is a danger to society.

I do not believe she can have any remorse. If I flipped my wig and stabbed my child to death - when I came back around I would kill myself. There is no way I could live it down, the guilt would eat me alive. I think she is an evil bitch, because she wants mercy for committing an atrocity. The NERVE!

Seems she needed help for a lot of mental issues. Some background info.

Meining's husband and parents told Clark County Superior Court Judge Diane Woolard on Tuesday that doctors and child protective services had failed Bryce and his mother, because they knew she was mentally ill.
Every time his wife saw a doctor about her hallucinations, insomnia and paranoia, we left the hospital with nothing more than a bottle of pills,' Kris Meining said.
Sandy Reed (her mother) said that in the years leading up to her grandson's death, her daughter had been diagnosed with illnesses from bipolar disorder to schizophrenia to postpartum psychosis. She was prescribed 22 different medications, Reed said.

I love you, Kelly,' Reed said before returning to her seat in the courtroom.When it was the defendant's turn to speak, Meining told Woolard she was tired of people making excuses.'I murdered my son, and there are no excuses,' Meining said. 'He was supposed to be safe with me, his mom.'She said she knows her family is just trying to help, 'but I deserve to be in prison' ......

Her husband and parents told Clark County Superior Court Judge Diane Woolard that doctors never took Meining's claims of hallucinations, paranoia and depression seriously and ordered pills for her instead of hospitalization.

They said Child Protective Services should have done more to ensure the safety of Bryce Jasper Meining, who died when he was 20 months old.

The agency first got involved with Meining in 2003 when she left her middle child, now 4, in his car seat in a parking lot and then called 911 to report a kidnapping; she temporarily lost custody.I said before she didn't have remorse, but I don't think that is right. TRUE PSYCHOSIS is a real illness, does not take away from the heinous crime, does not bring baby Bryce back, but it does happen and should be taken very seriously, (This reminds me much of baby Scotty his mother Ottis). Unfortunately it appears family was trying to help her but dr's. just sent her away with more meds. The meds themselves could havecaused the psychotic break. On that note, I don't know if I agree with denying an insanity plea. It was a horrid, vicious killing but I am concerned about woman who truly have this illness and are dismissed by it.
I cannot imagine living with this kind of horror behind me, the demons have come to rest on her very soul, what a torturous existence; I read she got 24 yrs not 20. Long time to think on this. IF only something more might have been done...but what exactly? Dr's, husband, CPS did they fail her? dunno, what I do know is baby Bryce was failed, failed completely, but I don't think it's just the mother to point the finger at. 22 meds. Can't even begin to wrap my mind around that.

Baby Bryce...you should have been safe with your mom, protected by those closest to you....so sorry little one.
