June 17, 2009 -- Police in northwest Indiana are searching for a missing 2-year-old girl.
The toddler disappeared after being left alone in a car while her babysitter ran into a gas station convenience store.
The search for Jada Justice began on Tuesday night. Her babysitter reported her missing around 9:30 p.m.
Jada will be 3 in August. She was staying with an adult cousin from Hobart for the last eight days, according to her mother.
Gary police were told that a little girl was taken from a gas station in Gary on Tuesday.
"I don't know what could be happening to her or where she's at or who she's with, if she's scared," said Melissa Swiontek, mother of missing child.
Two-year-old Jada Justice was with her babysitter on Tuesday night. The babysitter says she disappeared.
"She's saying she just went into the service station to purchase a gallon of milk at 9:30 last night and when she came back out she's saying Jada was gone," said Gabrielle King, Gary police.
"It's shady. It don't add up," said Clarence Justice, the baby's father.
Police in both Gary and Hobart have been searching around the gas station and the babysitter's home in Hobart.
The babysitter's neighbors say they noticed searches late last night.
As the search continues, baby Jada's mother pleads for help.
Relatives say that the babysitter and the baby-sitter's boyfriend have been questioned by police. ABC7 has learned that the searchers were able to cover a lot of ground. They had help from police recruits as well as a mountain biking class.
Gary police have reached out to other agencies, including the National Center for Missing and Exploited Children and the F.B.I.Source (http://abclocal.go.com/wls/story?section=news/local&id=6870550)

Let me guess....Babysitter got angry at kid and killed her then disposed of the body...then came up with the kidnapped story. I say torture the babysitter untill the truth comes flying out and hits the torturer in the face.

NR, I feel the same way, but I'm hoping this is not the case. Little Jada is missing and I sure as hell want her found.....alive and well, please.
That babysitter would have another thing coming to her if I had my hands on her. I am up to here reading about these disappearing babies only to find them dead and having a lying bitch all along tell a diff. story.
Where are you Jada? Your mama misses you.

Gallon of milk for the baby or a 40 for the babysitter?

Lots of farm land out there. Lots of places to hide a tiny body.
Sometimes I wish we used torture to get the truth out of people, but that's iffy. "Witches" of past times confessed just to stop the torture.

From the first frantic call about a missing toddler Tuesday night, police had suspicions about the baby sitter’s version of events.
A day later, Jada Justice, almost 3, has not been found, despite a massive search that spanned two neighboring cities and more than 18 hours.
The FBI has joined the search for Jada Justice, 3, a missing toddler who vanished from a car Tuesday while her baby sitter went into a convenience store in Gary. The FBI says the girl was apparently abducted.
Hobart K-9 officer William Granzow and his dog "Acky" search a wooded area Wednesday for the missing 3-year-old Jada Justice near 39th Avenue and Missouri Street in Hobart.
Anyone with information about Jada Justice, 3, should call Cmdr. Anthony Titus at 881-1237, Detective Chris Rodriguez at 881-1210 or Detective James Nielsen at 881-1229.
The baby sitter, Angelica Castillo, 18, of 3925 Missouri St., Hobart, is in custody facing charges of neglect of a dependent. She is a cousin to the missing girl's mother, Melissa Swiontek of Portage.
Castillo told Gary police she went to Glen Park Gas at 1401 E. Ridge Road about 9:40 p.m. Tuesday to buy milk, leaving Jada in her car seat with the doors unlocked.
When she returned, Jada wasn't there, Castillo said.
But other customers told police they saw no one around Castillo's 1991 maroon Cadillac Fleetwood while it was parked in the lot.
And police dogs brought into the search found no scent in the immediate area.
Nonetheless, Gary police devoted the next six hours looking for the girl in a wooded area south of the gas station. Cmdr. Jon Cooros and Sgt. Greg Martin flew the city’s helicopter through the top of trees as Gary Fire Department lights illuminated the scene, Cmdr. Anthony Titus said.
"We are leery of the baby sitter's accounting of the facts, but right now that's all we have to work with," Titus said.
Gary police contacted the National Center for Missing and Exploited Children, but learned the case involving Jada did not meet the criteria for an AMBER Alert because investigators do not have detailed information on a suspect.
About 3:30 a.m., police called off the search and focused on Castillo. Hobart police obtained a search warrant for her home, where they found bloody crib sheets.
Hobart investigators determined the blood came from a dog in heat, and shifted the investigation back to Gary. Police did find evidence of drug use at the house and members of the FBI-led Gang Response Investigative Team were at the home for a time Wednesday afternoon.
Hobart Chief Rod Gonzalez couldn't say how the blood was tested to convince detectives it wasn't human. "I don't know anything about that," he said. "I'm fairly certain the crime happened in Gary," he added.
All day Wednesday, police recruits attending the Northwest Indiana Law Enforcement Academy traipsed through muddy woods, fighting swarms off mosquitoes and turning over logs and brush in their search of the area between the gas station and Castillo's home.
Gary police also questioned Castillo's boyfriend, who complained he had suffered some serious burns recently.
Police would not comment on the 23-year-old man's condition. He was released Wednesday.
Investigators said the FBI and the U.S. Marshal's Service have joined Gary police in the search.
Swiontek could not be reached by telephone Wednesday evening.

Right now there is some confusion about Engelica's arrest and charges. Personally I think the cops jumped the gun a bit with her arrest, I think it was meant to scare her into a confession. The DA refused to press charges on her till they get more evidence as to what happened. I can totally understand the cops reasoning, they are wasting man hours looking for a little girl who is probly buried in the ground some were. All Engelica did is lead them on a wild Goose chase.
There was some talk about things found in her back yard, but it turns out to be stuff buried there for months now, what ever the hell it is.
Castillo was expected to be released from jail Thursday night after Lake County Prosecutor Bernard Carter rejected charging information presented by Gary police...
Jada's father, Clarence Justice, his wife, Elizabeth, and other members of his family spent Thursday at the gas station on Ridge Road passing out fliers and talking to customers. The family is offering a $5,000 reward for Jada's safe return.
Elizabeth Justice, Jada's stepmother, said the girl spent "every other weekend" at the couple's Hammond home.
"She loves McDonald's. We usually take her to the playground inside. She loves cheeseburgers and chicken nuggets," Justice said. "And she's tough. She sticks up for her little brother."
The FBI and U.S. Marshal Service joined Gary's investigation Wednesday as agents knocked on doors at every building and residence in the Glen Park-Hobart area where Jada was supposedly last seen.
Castillo claimed she went to the store to buy milk and left the girl in her car seat with the doors unlocked. She returned minutes later and Jada was gone.
But witnesses told police they saw no one near the car and tracking dogs didn't identify any scent outside of Castillo's Cadillac.
Castillo was expected to be released from jail Thursday night after Lake County Prosecutor Bernard Carter rejected charging information presented by Gary police. Police arrested Castillo after she related her story of the toddler's disappearance and hoped to obtain a felony charge of neglect of a dependent.

Shortly after their search began, the family learned someone had found suspicious items in the back yard of Castillo's home at 3925 Missouri St. in Hobart.
Federal agents joined Hobart police who used shovels in their search.
Investigators dug a small area in the easement behind Castillo's home but determined most of the dirt had not been disturbed recently and halted the search there after about an hour. They took some evidence but declined to provide details.

Authorities dug for evidence Thursday in an alleyway behind the Hobart home of missing 2-year-old Jada Justice's baby sitter.
What they found appeared to have no relation to the child's disappearance, Hobart police Lt. Steve Houck said.
"We don't believe it's related at all," Houck said.
Police detectives and FBI agents armed with shovels spent about an hour Thursday evening behind the home in the 3900 block of Missouri Street, where 18-year-old Engelica Castillo had been baby-sitting Jada, Castillo's cousin.
The search centered on an area in the alley where dirt appeared to have been disturbed, Houck said. The ground underneath turned out to be intact, he said.
Police bagged some items but wouldn't say what they found.
Clarence Justice, Jada's father, said police told him they'd found an old rusted knife that apparently had been in the ground for some time and was unrelated to Jada's disappearance.
Castillo was herself a subject of a missing child scare five years ago.
According to Times articles, in April 2004, Castillo's mother, Rita Rincon, told police she believed her then-13-year-old daughter had run off with a 21-year-old suspected gang member.
About a week after Rincon reported her missing, police found Castillo with the suspected man in Merritt Island, Fla., just south of Cape Canaveral.
At the time, Rincon said her daughter had a history of running away from their then-Hammond home. At the time she was picked up, Castillo also tried to give a false name and had been held in Brevard County, Fla.'s juvenile detention center on a false informing charge, Rincon said in 2004.
Jada's uncle Mike Valdez confirmed Thursday that Castillo had run off during a troubled time in her past. Rincon could not be reached for comment Thursday.

Armed with water bottles and fliers, family members and supporters spent the hot Saturday spreading the word about missing Portage girl Jada Justice.
Nearly 3-year-old Jada has been missing since Tuesday night, when her babysitter and cousin Engelica Castillo said she was taken from a Gary gas station.
"Everybody's just racking their brains," Stephanie Floyd, former stepsister of Jada's mother, Melissa Swiontek, said Saturday.
[...]
White said there no new leads in the case, but that his department continued to work with Gary police and the FBI in the search.
White said his department and the other agencies are expected to meet with Lake County prosecutor Bernard Carter's office Monday to discuss the case.
Makes me feel so anxious and sad. She's been gone since Tuesday....we know the odds on that.

For four full days, Jada's family and friends have canvassed the region begging for the little girl's return. Her family was sweaty and exhausted Saturday, but still clinging to hope.
"You have to believe, you have to pray," Jada's mother, Melissa Swiontek, said. "I can't think the worst."
Swiontek said she was overwhelmed by the community's support. The group held its prayer vigil Saturday in the parking lot of the gas station where Jada was reported missing.
"I don't have a bad feeling," Jada's grandmother, Lisa Huerta, said. "I have to be realistic, but I really think she's going to come back."
Huerta said the family has no ill feelings toward Castillo, who was watching Jada when she reportedly disappeared.

Investigators on Friday released photos of Castillo and boyfriend Tim Tkachik. They asked people to contact the FBI if they saw the toddler since Sunday, or if they saw Castillo or Tkachik -- with or without Jada -- Sunday through Tuesday.

Castillo had been held by the Gary Police Department as a person of interest but was released Thursday and not charged, Gary police Cmdr. Anthony Titus said. Titus, who joined White at the news conference, said police remain skeptical about details surrounding Jada's disappearance.
"At this point, it's still where it was Tuesday night," Titus said. Police are not currently pursuing charges against Castillo, Titus said, but he did not rule out the possibility.
He said police have not ruled out any leads or potential suspects or interested parties. "Everybody's a suspect until we can say they're not," Titus said.
He said blood found at Castillo's home in Hobart is still included as possible evidence to investigate. "I don't think anything has been nipped in the bud," Titus said.

Missing girl's cousin is released in Gary
An 18-year-old cousin of a toddler reported missing Tuesday who had been held on possible child neglect charges was released Friday by Gary police without being charged.
Angelica Castillo had been in custody for 48 hours and questioned in connection with the disappearance of Jada Justice, 2. Officials close to the investigation said Castillo refused to take a polygraph test.
The investigation into Jada's disappearance continued, police said.
They issued a statement late Friday asking the public to report any sightings of Jada between Sunday and Tuesday.
Castillo told police that Jada disappeared at about 9:40 p.m. Tuesday when she left the toddler alone in a car to get milk at the Glen Park Gas Station in Gary.
Jada is described as 2 foot 2, 35 pounds, black hair, brown eyes and light brown complexion. She was last seen wearing an orange skirt, white tank top with orange and green stripes and white sandals. Jada will be 3 in August.
Anyone with information should call 1-800-CALL-FBI.

Near as I can piece together the days events. The mom (Melissa) had gone out of town that weekend with the boyfriend and wasn't going to be back till the middle of the week. I didn't see anything about why the dad (Clarence) didn't take her.
Tim was in the hospital for some reason after he Flambéed his ass. He got out of the Hospital the same day as Jada's disappearance. From looking at his photo he had to have been high as a kite on meds or was in a lot of pain from the burns. Heck even the meds wouldn't have helped 100% with that. I highly dought he was in any mood to deal with kids.
The cops found a blanket with menstrual dogs blood on it, so there was a dog there as well in "HEAT". I am going to go out on a limb and guess its a Pit Bull, nothing personal about it just a logical guess.
Because of the amount of days gone by and the obvious lies told by both Engelica & Tim, I am assuming Jada was killed accidentally or from abuse of some kind. I don't see any possibility she was taken or kidnapped, there was only a 90 second window of opportunity to take her and Engelica drove by quite a few other store to get to that one. It just doesn't add up.
I feel pretty sorry for both the mom and the dad, Hoping and praying for her return. I am sure Melissa will spend the rest of her life regretting ever going away for a few days. Thats a hard thing to live with , but nobody's fault. A parents entitled to a little her time, especially a hard working one.

I agree with you Tazzz on the Pit Bull ONLY(before anyone jumps me)a married couple in Detroit here last month had their pit bull 5 yrs and they tried for 17 YEARS TO GET PREGNANT and they were playing with the baby boy he was 11 months old and the pit bull grabbed the babys head and the dad shot him 5 times to get him off the baby. But the baby died!!And Im not saying only pits b/c I have a rescue and we arent allowed to have pit bulls in the city or counties anymore. So at first we were swarmed with people dumping them,I was lucky I found a rescue for pits only in London (150 miles away) but some rescues began re naming them weird mixed breed names lol.I am not saying pits are worse then the rest everyones entitled to their own opinion. Before all the controversy with pits we had one when my son was 4.His name is Casey and we got so sick of everyone asking him where Finnigan was,so he got a puppy named it Finnigan(Mr.Dress.Up)And we gave him a bath one day and were going shopping and Heaven was 5 let him out the back door and we didnt know.So whenever anyone asked Casey where Finnigan was after that he would say "hes dead my dad killed him with the car"!!I just went back and re read the story of the baby in Detroit it was a Pit Mix heres the link if anyone wants to read it ,but its completely possible the dog attacked,,,http://www.detnews.com/article/20090423/METRO03/904230375/1409/METRO/+Miracle++baby+dies+after+mauling+by+family+s+pit+ bull

I agree a parent is allowed their time.I feel so bad though b/c this story isnt like some of the others. This baby had a loving family that adored her and not abused,no drugs involved, not 1/2 relatives or friends that are RSOs !This is a child like yours and mine that are totally loved and mom deserved a break and look what happened.I can almost promise you mom will never leave her son with anyone again!!

Missing toddler from Portage, Ind., still a mystery
Tribune staff report
June 22, 2009
Police and FBI agents in Indiana plan to meet with the Lake County prosecutors on Monday to review the case of a missing 2-year-old Portage girl.
Lake County Prosecutor Bernard Carter said his office would sit down with police representatives from Gary, Hobart and Portage, as well as the FBI, to decide how to proceed in the case of Jada Justice, who disappeared Tuesday outside a Gary convenience store.
"We want to talk about the case in its entirety," Carter said. "We would like to find the child. Once we know the status of the child, that will help us decide how to proceed with the case."
Jada's 18-year-old cousin and baby-sitter, Angelica Castillo, told police she left the girl in the car while running into a Gary convenience store to grab a gallon of milk Tuesday night. When she returned to the car, Jada was gone, Castillo said.
Police presented Carter's office with a request for a charge of neglect of a child this week against somebody connected with the disappearance, but the prosecutor declined to approve the charge.http://www.chicagotribune.com/news/local/chi-missing-girl-22-jun22,0,6465205.story

Here is some background on Tim, He came from a very abuse home, his mom finally got up the courage, after years of abuse, to leave her husband. When she went back with her sister to get some stuff, Daddy dearest killed them both, then blew his brains out. That was back in 2003, six years ago.
An Otis man apparently shot his wife and sister-in-law to death in a domestic dispute Tuesday and then turned the gun on himself.
According to a statement released this morning by the LaPorte County Sheriff’s Police, a preliminary investigation appears to indicate that Barry L. Tkachik, 41, of 10833 W. Division Road, used a shotgun to kill his wife, Michelle Tkachik, 39, of the same address, and his wife’s sister, Jean M. Dakin, 38, of 3640 Ash St. in Portage.
Two deputies were initially dispatched to the Tkachik residence at 1:20 p.m., when the LaPorte County E-911 Center received a “panicked call” from a male subject asking police to check on the welfare of individuals at that location following a report of gunshots there. At 1:35 p.m. the deputies arrived at the scene and discovered the bodies of Michelle Tkachik and Jean Dakin, one in a Chrysler mini-van parked in the driveway and the other on the ground outside the vehicle. Police said they appeared to have suffered fatal gunshot wounds.
At 1:48 p.m. EMS personnel arrived at the scene and were unable to find vital signs in either victim. Meanwhile, the deputies established a security perimeter around the residence and attempted unsuccessfully to contact anyone inside the home by loudspeaker. LaPorte County and Indiana State Police emergency response teams were subsequently mobilized and at 4:45 p.m. ERT members entered the home and after a brief search found Barry Tkachik’s body in an upstairs bedroom.
Police said that Barry Tkachik appears to have committed suicide by a self-inflicted shotgun blast.
“Although the exact sequence of events is still under investigation, it appears some type of domestic disturbance culminated” in the double-murder and suicide, police said.
The investigation of the incident is continuing, police said. Posted 2/19/2003

Nearly 100 Tips on Missing Portage, Ind. Girl2-Year-Old Girl Missing Since Tuesday4:03 PM EDT, June 22, 2009
FBI officials say they've received nearly a hundred calls on a tip line established to help find a missing 2-year-old Portage, Ind. girl.
The FBI set up the hotline on June 16 after they became involved with the case of Jada Justice, who disappeared that day when a baby-sitter left her in a car outside a Gary convenience store.
FBI Special Agent Wendy Osborne said dozens of investigators are reviewing the 89 tips placed on a FBI hot line devoted to the case. She called the case, "an ongoing investigation that has been operating around the clock.''
On Monday FBI officials met with Lake County Prosecutor Bernard A. Carter, who led a meeting with police from Portage, Gary, Hobart and Indiana State Police, along with the U.S. Attorney's office, officials said.
Jada's 18-year-old cousin and babysitter, Angelica Castillo, told police she left the girl in the car while running into a convenience store to grab a gallon of milk. When she returned to the car, Castillo said, Jada was gone.
Some family members and police officials have expressed skepticism with Castillo's account. Castillo was questioned by Gary police but was released Friday afternoon.
Police presented Carter's office with a request for a charge of neglect of a child this week against somebody connected with the disappearance, but the prosecutor declined to approve the charge.
"We weren't interested in that," Carter said. He declined to say who the requested charge was against.
Saturday morning, detectives in Hobart canvassed the neighborhood around Castillo's home, police said.

I keep finding conflicting storys about Tims burns, so I am not sure about them at this time. Some people are saying there fresh burns that he self treated and self medicated. Originally it was reported the burns were about something not related to the case.
I am not sure at this time when was the last time some one saw or talked to Jada, well some one besides Tim and Engelica. I guess at a minimum it could have been 24 to 48 hours before the Tuesday disappearance. Thats allot of cover your ass time.
I do know they called off the search on Sunday and are having a big Pow Wow today with everyone all together so they can all be on the same page as far as the info goes. I am pretty sure there not going to find Jada's body anywere near that mini mart. It was just a decoy.
They issued a statement late Friday asking the public to report any sightings of Jada between Sunday and Tuesday
Officials close to the investigation said Castillo refused to take a polygraph test.
Other concerns involve fresh burns on the boyfriend’s arms and face for which he has not given a reasonable explanation. The boyfriend and babysitter are still being questioned by Gary, Indiana police.
According to the child’s mother, the babysitter is her cousin and her daughter has been staying with the cousin for about eight days. She says the last time she spoke to her daughter it was either Thursday or Friday.
Lake County Prosecutor Bernard Carter said his office would sit down with police representatives from Gary, Hobart and Portage, as well as the FBI, to decide how to proceed in the case of Jada Justice, who disappeared Tuesday outside a Gary convenience store.

It didn't cross my mind, that his burns could have been from a meth fire. I do know he was wearing a back wards baseball like cap and squinting when the fire went off in his face. you can tell that from the burn patterns on his face. That kind of made me think, he was trying to lite a fire that had a bit more flame than he expected. I thought maybe he was trying to burn up her body and used to much accelerate.

Police did find evidence of drug use at the house and members of the FBI-led Gang Response Investigative Team were at the home for a time Wednesday afternoon.
The gang Response Team made me think of the meth b/c alot use that as income but not all meth cookers are in gangs

Where's Jada? Missing Black Child Ignored by Major Media
Date: Tuesday, June 23, 2009, 3:02 pm
Two-year-old Jada Justice of Portage, Indiana has been missing now for a week. But you wouldn’t know it from watching national television news shows.
The child, a black toddler, was last seen last Tuesday when her cousin said she left the child alone in a car at a Gary, Indiana, convenience store while she went inside.
Justice is now listed on the Web site for the Center for Missing and Exploited Children and on the "America’s Most Wanted" Web site. Television stations, radio stations and newspapers around Gary and Chicago have followed the story and shown photos of Justice with numbers to call to alert authorities if she is spotted.
But unlike the recent cases of Kaylee Anthony of Orange County, Florida and Haleigh Cummings of Satsuma, Florida, the search for Jada has not received the same kind of national attention.
“Unfortunately, in cases like this, it’s not until someone writes about the fact that there is no national attention that they start doing stories,” said Eric Deggans, media and television critic at the St. Petersburg Times.
Gary, Indiana is technically part of the Chicago media market, which is actually larger than the markets where others have lived whose cases of either abduction or exploitation were featured prominently on national television, Deggans said. Major networks often pick up stories from their affiliates in those markets and develop national stories.
“If there were reporters who cared about this, they could be all over it,” Deggans told BlackAmericaWeb.com.
Yanick Rice Lamb, associate professor at Howard University and editorial director for Heart & Soul magazine, said missing children cases are something that people care about, regardless of color.
“People are concerned about their children and their children’s safety. This is something people can relate to,” Lamb told BlackAmericaWeb.com.
There are a couple of factors that can go into a decision on whether or not to give a story national news coverage, she said.
“Who are the decision makers? How great is the public outcry? The squeaky wheel gets the grease,” she said.
Also, more than 40 years after the Kerner Commission Report pointed to the impact of a lack of newsroom diversity on coverage in urban communities, there still are issues in our nation’s newsrooms, Lamb said.
While the case has not received lots of national attention, Gary Police Commander Anthony Titus said he is getting strong support from local and federal law enforcement agencies.
Representatives from the FBI, U.S. attorney’s office and local district attorney’s office met Monday to discuss the search and investigation, Titus said Monday evening.
“We have some work going on tonight, and if they don’t turn up anything, we’ll be back out in the morning,” Titus told BlackAmericaWeb.com.
“Our goal is to get Jada back home and to see if there is anything criminal involved in her disappearance,” he said.
Angelica Castillo, 18, told police Jada was missing when she returned to the car after buying a gallon of milk.
Family members said they are suspicious about the way Castillo told authorities the child went missing.
Melissa Swiontek, Justice's mother, said, "I don't know. I don't know what to feel. I don't know. I feel there are so many speculations, there's so many things. I feel like I'm going to find her. I mean, I do feel like she can't be gone ... like this is not even happening."
Titus said the search for Jada has been ongoing. “Anytime we’re out, we’ve got helicopters. We’ve got bodies on the ground,” he said.
Interviews and pictures have been posted on YouTube.com, and the Center for Missing and Exploited Children has developed fliers that family members and friends have been distributing in the Gary area.

$10,000 Reward Offered in Search for Jada
The search continues for a toddler missing in Northwest Indiana, and the reward for information leading to her return is up to $10,000.
Jada Justice, 2, has been missing for seven days, but her family and friends has not given up hope of finding her safe, the Times of Northwest Indiana reports Tuesday.
Jada has been missing since June 16, when her baby sitter -- and cousin -- Engelica Castillo said Jada was taken from a car at the Glen Park Gas station in Gary, the paper says.
On Monday, volunteers went door-to-door handing out flyers and asking residents to keep their eyes and ears open for anything that might lead to the little girl.
"It's a beautiful thing," Jada's father, Clarence Justice, said of the volunteer effort. He said the support the family has received has touched him.
The NWI Times reports:
(Clarence) Justice said he plans to come back to the Gary gas station every day to continue to inform people about his missing child.
"I'll keep doing that until Jada comes back," he said

Police: Baby sitter appeared high during 1st interviewJune 24, 2009
Jada Justice's 18-year-old baby sitter appeared to be under the influence of some sort of substance the night she reported the 2-year-old girl missing, Gary police Cmdr. Anthony Titus said Tuesday.
"We know there was something she was intoxicated with," Titus said, without going into further detail. "I can't say it was cocaine, but there was something. ... It was obvious."
But police will never know for sure because they never tested the baby sitter, Engelica Castillo, Titus said.
He said police feared any tests would have meant stopping the interview, strapping handcuffs on the girl and getting her to consent to be tested. And that could have meant a lack of cooperation in trying to find the toddler, who remained missing Tuesday, one week after the initial report.
Castillo couldn't be reached for comment following multiple attempts Tuesday.
"Our concern was with finding the missing child," Titus said of why police failed to test her for the use of any substances.
Castillo, who initially was held by Gary police as a person of interest, later was released without being charged.
Titus said Castillo also has been interviewed by Hobart police and the FBI.
Castillo, who had been baby-sitting the Portage toddler in Hobart, reported Jada missing on the night of June 16.
She told Gary police she had driven from her Hobart home to the Glen Park Gas station, at the intersection of Louisiana and Ridge Road in Gary, to buy some milk and cigarettes.
Jada, who was left inside the car, was missing when Castillo came out of the grocery store after making her purchases, she reported to police.
Titus said Gary police have sent via computer a nationwide notice of Jada's disappearance to other police agencies.
He said a meeting Monday among local police, Lake County Prosecutor Bernard Carter, the FBI and the U.S. attorney's office went well but he would not elaborate further.
"We wanted to make sure everybody is on board with the communication. ... We want to make sure that everyone who needs to be involved is involved," Titus said.
Investigators, who on Friday sought information from the public, did receive quite a few leads, he said.
"We're still following any leads, and we're still doing searches," Titus said.
Police are asking anyone who has information about the case to call (800) CALL-FBI. http://www.nwi.com/articles/2009/06/24/news/top/doc0c8f5880d6e7bcc7862575de00829045.txt

That's interesting about the babysitter being under the influence. It's also a bit chilling as it gives this all a different slant. The way these bits of info trickle out is maddening to me. It seems like this has already been going on for a month and it's just at a week.
The mother hasn't said anything publicly yet has she? Not that I am faulting her if she has or hasn't, I'm just wondering about her. I'm just thinking she may be way too upset to talk and is stressed out to the max by all of this.
Whispers....you naughty thing teasing your grandpa like that!! Used to be pretty common for babies to be left outside the stores in their strollers. There is a thread about that very thing and the young boy who was abducted while waiting outside the store with his baby sister while his mom grabbed a couple of things. It has been 50 years I believe since he went missing. Scary.

Lakeesha Alert: 2-Year Old Jada Justice is Missing
The Amber Alert system isn't working for our nubian toddler, Jada Justice. It is time to see if the Lakeesha Alert system can make a difference.
The search for a missing northwestern Indiana toddler has entered its second week as the FBI and police continue to investigate her disappearance.
Authorities say 2-year-old Jada Justice of Portage was apparently abducted from a car June 16 while her 18-year-old cousin who was baby sitting her went into a convenience store in Gary. The cousin was briefly held as a person of interest but has since been released.
Melissa Swiontek, Justice's mother, said, "I don't know. I don't know what to feel. I don't know. I feel there are so many speculations, there's so many things. I feel like I'm going to find her. I mean, I do feel like she can't be gone ... like this is not even happening."Clothes worn at time of abduction: Jada was wearing an orange skirt, a white tank top with orange and green stripes, white sandals and purple underwear.
Circumstances: She was last seen on June 16, 2009. Jada may be with an adult companion. She was last seen wearing an orange skirt and a striped shirt.
Gary police are searching for a young girl who disappeared when a cousin who was taking care of her left the toddler alone in a car to get milk at a gas station.
Jada Justice, who turns three in August disappeared from the car at a gas station near the intersection of East Ridge Road and Louisiana Street in Gary about 9:30 p.m.
Jada was in the back seat of the car when her cousin stopped at the gas station about 9:30 p.m. Tuesday, June 16. When the cousin returned to the car, Jada's car seat was still there, but Jada was missing.
Jada had been staying with her cousin temporarily, but was due to return to her mother on Saturday. No family member is involved in a custody dispute with the mother over Jada, and there's no reason to believe a family member may have taken her.
Anyone with information is asked to call 1-800-CALL-FBI, or Gary police Cmdr. Anthony Titus at (219) 881-1237, (219) 881-1229, (219) 881-1209 or (219) 881-1210.http://www.edpadgett.com/blog/2009/06/lakeesha-alert-2-year-old-jada-justice.html

Search for Jada 'hopeful'
* Team of local officers, FBI agents sifting through tips on missing 2-year-old.June 24, 2009
By Andy Grimm, Post-Tribune staff writer
The search for Jada Justice enters its second week today, as a joint team of local police and FBI agents continued following leads in the disappearance of the 2-year-old.
Justice was reported missing June 16 by 18-year-old cousin Eugelica Castillo, who told police she left the toddler in her car while she went to buy a gallon of milk from a gas station on Ridge Road in Gary. When she returned, the girl was gone.
A team of two dozen police from Hobart and Gary, and FBI agents are working around the clock, exploring tips flowing into a special FBI toll-free number, and this after a six-hour search that involved police dogs, helicopters and sent more than 100 police officers scouring through the wooded, one-mile area between the gas station and Castillo's home in Hobart.
"In all my years in police work, I have never seen these kinds of resources dedicated to anything like (the search) for Jada," said Hobart Deputy Chief Jeff White, who said investigators now need more information from the public to close out the investigation.
"Statistically, a lot of time passing is not good for the victim," White said. "But we are hopeful and our goal remains to return Jada to her family."
Tuesday night, Justice's father, Clarence Justice of Hammond, was to appear on the CNN show "Nancy Grace" to discuss the case.
Gary police said last week they were "leery" of Castillo's account. Castillo had been watching Justice since June 8 while Jada's mother, 27-year-old Melissa Swiontek, was on a trip. White said investigators have been frustrated with a lack of cooperation from Castillo and her live-in boyfriend, 24-year-old Timothy Tkachik.
White declined to comment on specifics Tuesday, saying only: "If I was responsible for someone else's child and she had disappeared while in my custody, I would have done everything and anything to help find them.
"Let's just say that has not been the case."
Police last week circulated photographs of Jada, Castillo and Tkachik. Tkachik's photograph appears to show multiple burns on his face, though police have not said how Tkachik explained his injuries.
Police had canvassed the neighborhood between Castillo and Tkachik's home and the gas station twice by Tuesday, and FBI agents had interviewed registered offenders living in the vicinity.
Last week, investigators searched Castillo's home, where they discovered bloodied sheets and dug up an area in the back yard. The blood was determined to have come from a female dog in heat, and police stopped digging after determining the soil didn't appear to have been disturbed prior to their search.
White said anyone with information about the whereabouts and movements of any of the three, or the 1991 maroon Cadillac Castillo was driving on June 16 or the days before and after Jada's disappearance can help investigators.
"There is no doubt in my mind someone out there knows where Jada is," White said. "Their conscience, their religion, whatever, needs to come through and have them call us."

I will admit, I left my kids in the car lots of times to get a pack of cigarettes. I don't know where she was parked but I'm curious because everytime I ever did that I parked right in front of the doors even though it was a no parking area.
I heard today...she parked on the side of the gas station....and it was very dark...no lights on that side...which investigators found suspicious....why would she not park right in front...if she was telling the truth?
It was on HLN...that I heard this...dont know if anyone has mentioned or linked...sorry if this has already been posted.

Indiana girl, 2, missing more than a week)June 25 2009 --
The mother of a missing 2-year-old Indiana girl said police are working "around the clock" to find her daughter, who was apparently taken from a parked car while her baby sitter was in a convenience store.
Jada Justice was last seen about 9:40 p.m. on June 16 when her cousin stopped at a convenience store.
Jada Justice was last seen about 9:40 p.m. on June 16, when her 18-year-old babysitter and cousin stopped at a Gary, Indiana, convenience store to buy milk and cigarettes.
The baby sitter, identified as Engelica Castillo, told authorities that when she came out, Jada -- who had been in the back seat of the car and in a car seat -- was gone.
Asked by HLN's Nancy Grace if she questioned why Castillo left Jada in the unlocked car -- which was parked to the side of the gas station, not in front -- Jada's mother, Melissa Swiontek, said Tuesday, "I've asked her, and she just keeps telling me 'I don't know, I don't know. I was just running in real quick.'
Prosecutors met Monday with authorities to review the case, but are waiting to see how the case plays out before taking action, said Diane Poulton, spokeswoman for the Lake County prosecutor's office.
"Nothing's been rejected," she said. "Nothing's been filed."
Swiontek told Grace she had spoken with the attendant at the gas station, who confirmed Castillo was there, and said her demeanor was normal until she left and then returned "hysterical."
Authorities have received more than 100 tips, and leads are being followed, Wendy Osborn, spokeswoman for the FBI's Indianapolis, Indiana, office, said on Wednesday.
Swiontek said Tuesday she and Jada's father had taken polygraph tests in the case. The two get along well, she said, and Jada's father has regular visitation with her.
Castillo had not taken a polygraph test as of Tuesday, Swiontek said. Asked whether authorities had requested that Castillo take a polygraph, Swiontek said, "They couldn't tell me for sure they asked, but I'm assuming if they asked me and him, they asked her."
Swiontek said Jada had never opened a car door and Swiontek said she didn't believe Jada could have opened the door of Castillo's car, which Grace reported was a 1991 Cadillac.
Jada is described as an African-American child about 2 feet 2 inches tall and weighing 35 pounds, with black hair, brown eyes and a light brown complexion. At the time of her disappearance, she was wearing an orange skirt, a white tank top with orange and green stripes, white sandals and purple underwear, the FBI said.

HOBART, Ind. (AP) - A prosecutor says a body found in rural northern Indiana is believed to be that of a 2-year-old Portage girl who vanished more than a week ago.
Lake County Prosecutor Bernard Carter said he's quite certain that the body found Thursday afternoon in rural LaPorte County near the town of Otis, Ind., is that of Jada Justice.
But he said a formal identification still needs to be done. An autopsy is scheduled to be performed Friday on the body.
Justice was apparently abducted from a car June 16 while her 18-year-old cousin who was baby sitting her went into a convenience store in Gary.
Carter said two people are in custody in connection with the toddler's June 16 disappearance.
He said that charges are expected to filed Friday in the case.

Investigators believe they have found the slain body of missing 2-year-old Jada Justice in rural LaPorte County and have taken two suspects into custody, Lake County Prosecutor Bernard Carter said Thursday.
"We have reason to believe that we have recovered the body of Jada Justice but we do not know from forensic standpoint," Carter said. "We feel very comfortable that we do, in fact, have Jada Justice."
Carter said two people are in custody in relation to the murder investigation into the toddler's June 16 disappearance. He would not confirm the identities of those in custody, saying it was still an active investigation.
However, other sources with knowledge of the investigation said Thursday that the baby sitter Engelica Castillo and her boyfriend Tim Tkachik were arrested at a rural Porter County residence near Valparaiso Wednesday night in connection with the case.
Carter said charges are expected to filed in the case Friday.
LaPorte County Coroner John Sullivan told The Times Thursday that he was aware police were searching an area near U.S. 421 in rural LaPorte County in connection with the Jada Justice case, but he said he could not comment on the matter as it was not his agency's case.
As of 4:30 p.m. Thursday, police and FBI agents had closed off Snyder Road, just north of the toll road and one-half mile west of U.S. 421 near Otis, Ind.
Sullivan said the recovery is a LaPorte County case, but an autopsy on the remains will be performed Friday in Lake County.
Authorities believe Tkachik burned his face when he tried to burn Jada's dead body, a source close to the investigation said. Mug shots released by authorities clearly show blistered and burn-damaged skin on Tkachik's face.
The source said Jada did not die of those burns, and authorities believe Jada may have died two weeks ago Saturday -- several days before Castillo reported the toddler's disappearance.
Interviewed near the rural Porter County residence where Castillo and Tkachik were reportedly arrested, Jamie Napier, of Portage, said her estranged boyfriend, Castillo and Tkachik along with three others were arrested during a police raid of the house. She said she was told by FBI agents Thursday that she could come to the house, where her estranged boyfriend lives, and collect belongings for her sons, ages 5 and 7. Napier said she shares custody of her children with the estranged boyfriend.
Napier said she first learned of the raid at the cottage when a neighbor called her Wednesday evening. She said she then drove to the house and saw her estranged boyfriend, Castillo and Tkachik being arrested.
Investigators had been searching the area near the 3900 block of Hobart's Missouri Street since June 16, when the 18-year-old Castillo reported the little girl missing.
Gary police investigators, who also are involved in the case, have since said that Castillo appeared under the influence of a substance when she spoke to police.
Castillo's mother, Rita Rincon, denied police criticism that Castillo has been uncooperative with authorities in the investigation.
Rincon said Castillo and Tkachik -- both questioned by police -- have been out with other volunteers passing out fliers with Jada's information, trying to find the girl.
"We've been doing everything we can," Rincon said. "That's all of us."

Engelica Castillo's (Mom) , Rita Rincon has been trying to cover her Fuck Tard daughter ass the last few days. She filed a police complaint on Clarence Justice, ( Jada's Dad) for intimidating Engelica. Bitch is lucky, if it was me it would be a hell of allot more than intimidation.
Also the 2 murdering Fuck wads, have been with the rest of the family handing out flyer's and pretending to actively search for Jada. Geeze, again I cant tell you how pissed I would be about that, what a betrayal it would be to me, to have them there the whole time while they both knew she was dead. I hope Engelica's Mom get a charge for something now. I think she is Mellisa's Aunt or something like that.
Also today before they found Jada, the family, requested that Texas EquuSearch (TES) provide assistance. TES is a mounted search and recovery team that joined search efforts for Caylee Anthony, Haleigh Cummings and Stacy Peterson, to name a few.
Castillo's mother, Rita Rincon, said she has filed a police complaint against the father of the missing girl, alleging he has intimidated the babysitter.
Clarence Justice, the father of 2-year-old missing girl Jada Justice, said he has done no such thing. Rincon, spoke out in support of her daughter Thursday, saying information about Castillo is being misunderstood or misconstrued.
"She wants the baby home," Rincon said of her daughter. "We all want her home."
++++++++++++++++++++++++++++++++++++++++++++++++
Rincon said Jada's father, Clarence Justice, has threatened Castillo, once named a person of interest in the case.
Rincon filed a complaint with Hammond police on Sunday, claiming she was a victim of intimidation that night.
Justice denied the threat accusation on Thursday, saying, "That's not true."

A body has been found in Indiana that may be the remains of 2-year-old Jada Justice. She disappeared last week.
Police were called to search an area of western LaPorte County Thursday morning based on information they had received in relation to the missing girl. A coroner was called to the scene early Thursday afternoon, after police found a body in the fields there.
Police will only say at this point that it appears that the body is the remains of 2-year-old Jada Justice. The little girl has been missing since a week and a half ago when her cousin told police she had disappeared.
Jada's cousin, Angelica Castillo, 18, of Hobart, was watching the girl at the time she disappeared. Castillo said she left Jada in a car while she went to buy some milk at a gas station in Gary. And when she came back Jada was gone.
"It is with deep sadness that I report this morning investigators discovered what are believed to be the remains of Jada Justice in rural LaPorte County east of Highway 421," said Chief Rod Gonzalez, Hobart Police Dept.
"You always have a hunch of what's going on. A mother knows, I'm a mother my own self, and when stories aren't adding up and stuff like that you just know something. And for it to happen like this, it's devastating right now," said Angie Balboa, family friend.
Police said they have two people in custody at this point. They have not charged them, however, so they are yet to release the names of those two people. They say if the investigation goes as anticipated, charges could be filed by Friday afternoon.

The arrested 18-year-old baby sitter of slain Jada Justice now has a lawyer.
Engelica Castillo's family has hired Merrillville defense attorney T. Edward Page, Page confirmed Friday.
Page said the family retained his services Thursday night after Castillo was taken into custody.
Castillo is being held in Crown Point, awaiting possible charges in Jada's case.
The nationally publicized search for Jada came to a gruesome end Thursday, as investigators said they believe they discovered the missing Portage girl's remains near rural Otis, Ind.
A source close to the case said they found the remains in a concrete-laced plastic bin in a shallow waterway in LaPorte County that they believe are the toddler.
The remains have not been positively identified as those of Jada, but an autopsy was scheduled for this morning in Lake County.
Police had cast doubt on Castillo's account of the toddler's disappearance since Jada was reported missing 10 days ago.
Castillo reportedly had been baby-sitting Jada in her home in the 3900 block of Hobart's Missouri Street on June 16. She told police she left Jada in her unlocked Cadillac about 9:30 p.m. that day outside Gary's Glen Park Gas Station.

By looking at the charges it almost looks like Jada died as the direct result of Babysitter stupidity. Though there is a battey charge so that could mean she got beat by one or both of them.
Engelica Castillo, 18, and her boyfriend, 24-year-old Tim Tkachik , both of Hobart, were charged Friday with murdering the Portage toddler. They also were charged with two counts of neglect of a dependent, battery and false informing.
Both Castillo and Tkachik each could face up to 65 years in prison if convicted.
A source close to the case has said investigators believe Jada had been killed and dumped into the waterway three days before she was reported missing.

Jada's mother, Melissa Swiontek, has said she dropped her daughter off with Castillo on June 8, having planned to travel out of town. Swiontek said she last spoke to her daughter June 12.
The next day, Jada -- placed in a plastic bin in which concrete was poured -- was dumped into a shallow waterway near the small LaPorte County town, according to a source close to the case.
Three days later, on June 16, Castillo reported Jada missing from the Glen Park Gas station in Gary. Soon, the FBI joined the investigation with Gary and Hobart police departments.

CROWN POINT | Jada Justice was killed, an autopsy performed in Lake County Friday revealed. LaPorte County Coroner John Sullivan ruled Jada's death a homicide.
He said he knows the 2-year-old's cause of death, but cannot release the details until arrest warrants are issued. He could not elaborate early Friday afternoon.
Jada's body had not been positively identified by the family early Friday, but Sullivan said he expected the family to arrive at any moment.
Investigators on Thursday were called around noon to rural Otis, Ind., to collect the remains.
Charges are expected to be filed related to the case sometime today against Jada's 18-year-old baby sitter Engelica Castillo, and her boyfriend, 24-year-old Tim Tkachik.

Every family member who defended these fucks I am sure are just beside themselves. I understand a mother not wanting to believe her child is capable of such a heinous act, but anyone who defended them with such questionable facts and uncooperative stance on their part, fuckem' I say. These baby killers do not deserve a moment of sympathy. Not a single fuckn' moment. I hope they cry like babies and get no compassion.
I do not know what Jada's last moments were like, but I'm sure she cried for mama and got death instead.

They still might get the Death penalty, guess we have to wait and see what the real cause of death was from. Also I forgot about the grand jury thing, like the woman who tossed her 2 kids off the bridge, they didn't put that on the table till after the incitements. So I guess its still a possibility , but it probly is still dependent upon how she actually died. And we dont know that yet. At least we dont have to worry about the insanity plea in this case.

I was so sorry that I was exactly right on this little girl, but once I heard babysitter....I guess that I have been a member of DD too long to hope that this child would have just been kidnapped from a vehicle driven by a babysitter and be found in the backyard of the convenience store playing with something that interested her.
Her cries didn't go unheard....I just hope these idiots who killed her, remember and hear her cries each and every night they go to sleep.

Police said Castillo and Tkachik told officers Justice had been abducted at a Gary gas station June 16. In fact, according to court documents, the couple took Justice along with them to purchase heroin in Porter County. They realized while in the car that Justice wasn’t breathing. They first tried to dispose of the body by burning it in a remote location in LaPorte County.
When they failed, they encased her body in concrete and buried it in a swamp near Snyder Road in Otis, Ind.
“This tragic ending is not the outcome we were all hoping for,” Lake County Prosecutor Bernard Carter said. “My condolences to all the family and friends of this precious child.”

The babysitter, Engelica Castillo, and her boyfriend, Tim Tkachik, are charged with the murder of Jada Justice.
The details offered thus far are disturbing to say the least. According to a statement Tkachik reportedly gave to authorities, he said Castillo killed little Jada and the two of them worked on a plan to dispose of her body, first lighting it on fire and then burying it in a barrel filled with concrete.
During questioning, Castillo allegedly stuck to her original story that Jada disappeared from her car when she went to a Gary gas station. Her boyfriend, however, offered a different version of events and his information is what led authorities to her body Thursday in west LaPorte County.
"A plea of not guilty will be entered at the first opportunity, and we believe that once all of the evidence is presented to a fair and impartial jury she will be cleared of responsibility for her cousin's death," said T. Edward Page, Angelica's attorney.
Prosecutors say he said he told investigators he walked in on Castillo as she was beating and spanking Jada. They later discovered she had stopped breathing and they devised a plan to dispose of her body.
Tkachik told authorities, according to the statements, that both he and Castillo smoked marijuana before he says that Castillo beat Jada.

Back a bunch of posts ago, I mentions Tims past and how his dad shot and killed his mom and aunt. Well guess were it turns out Jada's body was found???? yep right near there. It the house were Tim grew up in. The murder / suicide house.
Jada Justice's body was discovered Thursday only a short distance from a six-year-old crime scene that sources close to the investigation say may help link the girl's disappearance to the boyfriend of her baby sitter.
A source with direct knowledge of the investigation said authorities believe Tim Tkachik was involved in the transport and disposal of the 2-year-old's dead body in rural LaPorte County, near Otis, Ind. "I have no belief whatsoever that my little brother could've done anything close to that," Tkachik's brother, Nicholas Tkachik, said Thursday. "That's just not him."
The brothers experienced their own family tragedy in Otis more than six years ago, an act that occurred near the rural site where sources close to the investigation say Jada's body was discovered.
The brothers' father, Barry Tkachik, is believed to have murdered their mother and aunt before turning the gun on himself in February 2003 at the family's home. Their parents were reportedly going through a divorce at the time, new reports from the time state. Neither of the brothers was home when the double homicide-suicide took place.
Nicholas Tkachik said his brother took their family tragedy the hardest because he was close to their mother, Michelle Tkachik.
Tim Tkachik was arrested three times in seven months on drug-related charges after his parents' and aunt's deaths, police and court records show. He was charged in summer 2003 for possession of marijuana, police records state. And he was charged in September 2003 with multiple criminal counts, including drunken driving, battery to law enforcement, fleeing and criminal mischief. In February 2004, Tkachik was charged again with possession of marijuana, police records state.
"Like anybody, he's made bad choices, but who hasn't," Nicholas Tkachik said of his brother. "He's definitely had the worst luck I've ever seen in my life." The brothers grew closer after their parents' death, Nicholas Tkachik said.
"He's always been there for me when I needed him," he said. "He has a big heart."

According to court documents, an autopsy showed Jada had numerous skull fractures.
Castillo had claimed that Jada disappeared from a car while the teenager went into a convenience store in Gary. Police and the FBI took part in the 10-day search, and the FBI opened a hot line that received more than 100 tips.
The child's remains were found Thursday encased in concrete in a swampy area near rural Westville, according to a probable cause affidavit.
"This tragic ending is not the outcome we were all hoping for," said Lake County prosecutor Bernard Carter.
According to the affidavit, Castillo told police that she routinely took care of the toddler for days and was scheduled to return the girl to her parents on June 20.
The affidavit says Tkachik told police that Castillo had beaten the child severely on the head on June 13 after they had both used heroin, and they noticed Jada wasn't breathing when they drove to buy more heroin that evening.
"I told you to stop. I told you enough is enough," Tkachik said he told Castillo, according to the affidavit. The pair allegedly repeatedly tried CPR to revive the child.
According to the affidavit, the pair took Jada home and, thinking she was still breathing, took her into the house. Once they realized she was dead, the document says, they decided to get rid of the body.
Tkachik allegedly put the body in garbage bags the next day and took it to a wooded area in LaPorte County, where he tried unsuccessfully to burn it, causing an explosion that burned his face and required hospital treatment. Tkachik blamed the burns on a propane grill, police said.
Castillo and Tkachik then took the body home again, the affidavit said, and on June 15 entombed the remains in a tub full of concrete. After the concrete dried, the pair took it to a rural area near Westville and sank it in a swamp, according to the document.

I love when the perps roll all over each other like this. Its going to make this case a slam dunk in the court room. I highly dought it will ever see a jury now. If what they are saying is true, (though they better put Timmy on a suicide watch). Instead of getting a Murder charge, he can plea deal to a few of the lesser felonys and probly get 15 to 30 years.
Engelica is totally fucked and will probly spend the rest of her life in jail. Her mom will probly be crossed off the family gatherings list and spit on, every time one of them See's her in town.

I would take great pleasure in beating the life out of these two, especially the female, the bitch. Today, I am far more upset at the mother than I initially was. A more caring, diligent mother, who's priorities were to protect her child from ALL possible harm. That was her job. She failed IMO. Like I have said, she had to know there was questionable things going on with that cousin, and that boyfriend, fuck, she let her baby around that creep? Mother's have got to be more involved in anything and everything they expose their children too....it could mean life or death.
And the potty training issue. You get advice and guidance, but ultimately training should be done by the parents as it is a trust issue when it comes to learning. It's really potty learning not training. Did this cousin even have children? how was she more qualified? Bitch.
What pisses me off to no end, as I have read and seen this kind of shit time and time again, is the heinous killing of children for drugs. At the end, these fuckers were using and abusing drugs and then turned on baby Jada and abused and used her like a punching bag, (I'm not convinced it was just the cousin who beat her). The killing of a child, all for the pursuit of drugs.
Children almost always lose. In this case, baby Jada loss in the highest order.

I'll play devil's advocate here for a moment. Maybe mom didn't know the cousin was a druggie. There are actually places (at least where I live) that are daycare centers where they say they'll potty train your kid for you. For people who "don't have time" or IMO don't want to deal with it. Personally, I wouldn't dare leave my kid at any of those places. I wouldn't dare leave potty training to anyone else. It's frustrating enough for parents at times. Now imagine someone getting frustrated with your child. Someone who maybe just wants a paycheck and couldn't care less about your kid. I would think of these things, but a lot of people don't. Maybe the mom felt because this girl is family, that sort of thing wouldn't happen.

True DP, she may have not known she was a druggie, but considering she left Jada in her care many other times, I'm inclined to think had a clue something was up with the cuz, and she let things slide. And that boyfriend, one look at him and I would be like fuck no, but then I would have checked his background out, 'cause I don't trust no one.
The potty training thing, yeah, I know lots of parents don't want to deal with it or have the time, PT is hard shit..lol, I'm not against the help of a daycare at all, I just think the mother could have been more aware of whom she was leaving her child with, and dumping her off for potty training issues, that doesn't fly with me...but that's me.
My sister got pissed at me once as I would not leave my son to play with her son, because her asshole boyfriend & loser brother were going to be there. I sad NO, and didn't think my nephew should have ever been left in his care alone either. We got into many a fight over this subject. I don't care if its family, that certainly does NOT mean a better, safer, more trusting person, not by a long shot. A lot of the children we see killed here are killed by family. I think that is part of the problem. As family we get too complaisant and trusting, like they are not capable of mistakes or worse, so sad but true.
I'm sure there are many details we will never know about his case but I can't help but wonder, had this mother and so many others just like her taken some precautions, used some sensibilities we might just have far less dead children.
Bah........ I'm just pissed and really sad. Jada deserved life.:dong:

Jada Justice's mother, Melissa Swiontek, left, and father, Clarence Justice, speak with Wayne Millerhttp://images.townnews.com/nwitimes.com/content/articles/2009/06/27/news/top/doc99f48010ba24f8d2862575e20001eefb.jpg
Hmm , good points about Melissa, I never gave it much thought. It turns out Melissa is being investigated for "abuse or neglect". Something turned up during the investigation and "CPS" is looking into it. To me its sad, she just got hit with the worst possible news imaginable, a living nightmare. Now the state is taking away her other kids. But I do see the states reasoning behind it, not to mention if your child goes missing, and the FBI is called in, you can bet , every ones life is going to be fine combed for info and suspects.
HOBART | The Department of Child Services is investigating the mother of 2-year-old Jada Justice, a spokeswoman for the department confirmed Friday.
Child Services spokeswoman Ann Houseworth said an assessment into the safety of Melissa Swiontek's four surviving children was opened after the report of Jada's alleged abduction.
"While I can't speculate on whether the assessment was a result of her disappearance, I can say the assessment was opened as the result of a valid report," Houseworth said.
She said the allegations in the report met the level of abuse or neglect listed in the state statute.
Houseworth could not say whether that information surfaced during the investigation into Jada's disappearance. She declined further comment, citing rules of confidentiality.
Neither Swiontek nor Clarence Justice, the biological father of Jada and two of Swiontek's other children, could be reached Friday for comment. Justice's wife, Elizabeth, declined comment on his behalf.
Swiontek has said she dropped Jada off with baby sitter and cousin Engelica Castillo on June 8. Swiontek previously told The Times she intended to leave Jada with Castillo until Father's Day – nearly two weeks after she dropped her daughter off.
She said she last spoke to Jada on June 12. Swiontek called June 13 and spoke to Castillo, but not to her daughter. Castillo and boyfriend Tim Tkachik told police Jada was dropped off at their Hobart home to be potty-trained, court records state.
Both Castillo and Tkachik admitted to using drugs while they watched the toddler, according to court records.
Tkachik told police he and Castillo did several lines of heroin the night before Jada died, records state. He said he and Castillo were on their way to buy more heroin in Porter County, with Jada in the back seat, when he first realized the little girl wasn't breathing.
Castillo, who has not confessed to involvement in Jada's death, told police she and Tkachik were smoking marijuana while Jada played on the bedroom floor the day she was reported missing from a Gary gas station, records state.
Houseworth said Child Services was working with the Hobart Police Department in its investigation into Swiontek's other children.
Hobart Deputy Police Chief Jeff White said he expressed to Child Services his opinion on the timing of their investigation while the family is dealing with the loss of Jada. He acknowledged, though, that the safety of the other children is paramount. White said he has not visited Swiontek's home and could not comment on whether the surviving children lived in a safe household.
"Unfortunately it became my responsibility to inform Jada's parents of what we found," he said. "I can tell you the emotions I witnessed from both are legitimate and very real. If that's any indication of how other children in the home are being cared for, I would say, yes, (they are safe)."
White said he will meet with Child Services on Monday and intends to cooperate with its investigation. http://nwi.com/articles/2009/06/27/news/top/doc99f48010ba24f8d2862575e20001eefb.txt

This story pretty much goes over the arrest Affidavit info with a bit more info. The coroner, spared the Granny and uncle seeing the mutilated remains of Jada and just took a photo for them to identify.
Engelica is till sticking to her Tard story and is going to plead not guilty, her lawyer swears she is innocent. I noticed on the reports Engelica, only really claimed to have smoked Cannabis, I am pretty sure she never mentioned any Heroin, it was only Tim who did.
CROWN POINT | Fueled on heroin and fear, Jada Justice's baby sitter and her boyfriend tried to burn the toddler's lifeless body before encasing her in concrete and dumping her into a swamp, authorities charge.
Engelica Castillo, 18, and her boyfriend, Tim Tkachik, 24, both of Hobart, were charged Friday with murdering the 2-year-old Portage toddler. They also were charged with two counts of neglect of a dependent, battery and false informing.
"This tragic ending is not the outcome we were all hoping for," Prosecutor Bernard Carter said Friday in a statement. "The relentless efforts by all involved shows that Northwest Indiana has a big heart."
In their case against Castillo and Tkachik, prosecutors describe the two in a frantic, two-day spree of varying attempts to dispose of Jada while making intermittent stops to purchase and use heroin and marijuana.
Jada's mother, Melissa Swiontek, told investigators that she dropped her daughter off with Castillo, Jada's cousin, June 8 for a two-week stay. Though Castillo and Tkachik's accounts surrounding Jada's death differ, both admit to using drugs while she was in their care.
In his testimony to police, Tkachik blamed the girl's death on Castillo, saying the girl died hours after Castillo beat her in the head with her knuckles and after the girl struck her head against a table.
Tkachik said Castillo spanked Jada in an attempt to potty train the girl, but that it escalated June 13 into harsher beating that he claimed to have tried to stop.
That night, the couple realized Jada wasn't breathing in a car seat in the back of Tkachik's car on the way to Porter County to buy heroin, Tkachik told investigators.
The two stopped the car, tried administering CPR to the girl, but realized she was dead, court documents state. "'I told you to stop,' Tkachik told investigators he said to Castillo. 'I told you enough is enough.'"
They returned to Hobart where they left Jada covered in the back seat of Tkachik's car for hours while driving Castillo's car to Porter County, then to Chicago and back to Hobart, records state. Back in Hobart, Tkachik placed Jada -- covered in bumps and bruises -- in garbage bags in the home's basement before he and Castillo went to sleep, court records state.
The next day, in the couple's attempt to burn Jada's body in a hole in the ground in rural Westville, Tkachik badly burned himself trying to ignite the fire, he told police. The couple then drove to Hobart, leaving Jada's body exposed in the burned-out hole, he said.
The following day, the couple drove back to Westville, where Tkachik encased Jada in a slab concrete and dumped her into a nearby swamp, records state. A Lake County coroner's spokesman confirmed Friday that Jada died of blunt force trauma. Numerous skull fractures were revealed during the girl's autopsy, charging documents state.
Jada was positively identified Friday by a family member from a photograph, LaPorte County Coroner John Sullivan said. He said he wanted to spare the family from seeing Jada's body in person. Sullivan could not determine when the girl had died.
"This probably ranks as one of the most difficult cases of my professional career," he said.
Castillo's lawyer, T. Edward Page, said Castillo plans to plead not guilty to the charges.
"We believe that once all of the evidence is presented to a fair and impartial jury at trial, she will be cleared of responsibility for her cousin's death," Page said. "She is distraught over her cousin's death and distraught that she has been accused of it."
It was unclear Friday if Tkachik has retained a lawyer.
Castillo and Tkachik each could face up to 65 years in prison if convicted. The two were arrested Thursday, the same day investigators found Jada's remains in rural LaPorte County.
According to charging documents, Jada was still wearing an orange skirt and tank top with orange and green stripes, the outfit described in national broadcasts of her disappearance.
Police had cast doubt on Castillo's account of the toddler's disappearance since she was reported missing June 16 -- 11 days ago -- and as the hunt for Jada grew volunteers and gained national attention.
Court documents show that while Tkachik revealed gruesome details of the toddler's final moments, Castillo relied on the story of a possible abduction at Gary's Glen Park Gas station.
She drove to that particular station instead of several others nearby, she said, for fear of driving in Hobart without a license.
According to charging information, Castillo showed investigators the route she claims to have driven June 16 from her Hobart house to the station, and pointed to three male black patrons in the station's lot at the time.
She told police Jada was missing around 9:30 p.m. from her unlocked Cadillac after she went inside to buy milk and cigarettes.
When police accused her of lying, appearing calm and showing no emotion, Castillo became combative and slapped away a picture of Jada they had shown her, court documents state.
"'You are lying and don't know what your (sic) talking about,'" police say Castillo said. When questioned further, she told police, "'God is taking care of her, God is watching over her,'" records state.
Castillo and Tkachik are being held in Lake County Jail without bond.
They are expected to appear in court Monday.http://nwi.com/articles/2009/06/27/news/top/doc4c12ce588f925c78862575e200063c6d.txt

You know, since reading the affidavit report, the part where the boyfriend tells of Englica pulling Jada's hair and beating her, and she didn't cry, continued to beat her and still she didn't cry....if there is ANY truth to the not crying part, as I think she would, children that have a history of abuse start to not cry as easily and don't respond to pains so quickly because they are used to being treated as such. Got me thinking. I would not be surprised there was a history of abuse. I hope nothing turns up.
Indeed it is very, very sad what should be private days of mourning a child, is turned upside down. That's the least you an expect when a baby is killed under such circumstances. Sorry for those who truly loved baby Jada, my sympathies and heartfelt prayers.

I was wondering about the house were Tim and Engelica got busted at. Its #4 on the map I posted. It turns out, that Her and Tim went there to stay after she reported the kidnapping, the cops were all over her house (#2) so they went there, to hide out (#4) and get away from her home.
Fucking Dumbass Tards, went and hid out in a Heroin Drug dealers house. The fucking FBI was called in to help, What kind of idiots were these 2????? . They said Tim was the one supplying Chris Osborne and Susan Yamashita with the Heroin they were selling out of the house.
FYI: "Visiting a common nuisance" equates to knowingly being present where unlawful activity is taking place.
VALPARAISO | The house where 2-year-old murder victim Jada Justice's baby sitter, the baby sitter's boyfriend and two others were taken into custody Wednesday night was a known heroin dealing house, according to the Porter County Drug Task Force.
Task force Coordinator Robert Taylor said neighbors reported drug deals at the house – at 5402 2nd St., along Edgewater Beach Road in the Valparaiso area – about a month and a half ago. He said the task force arranged two undercover heroin buys there in recent weeks.
The renters of the home, Chris Osborne and Susan Yamashita, were involved in the drug operation, which was fairly prolific, according to Taylor.
He said the pair apparently were getting their heroin from Tim Tkachik, the boyfriend of Engelica Castillo, who was baby-sitting Jada when she died and then allegedly was falsely reported to have been abducted from outside a gas station. Tkachik and Castillo apparently wanted to escape the pressure that developed once Jada was reported abducted in Lake County, so they moved into the basement of Osborne and Yamashita's home, Taylor said.
Taylor said the drug-dealing evidence the task force developed against Osborne and Yamashita allowed federal authorities and the Porter County SWAT team to raid the house Wednesday night.
Task force Supervisor Jeff Biggs, who also is team leader of the SWAT team, said the SWAT team used "flash-bang" devices and raided the house without incident.
Police said Osborne was taken into custody and faces federal drug charges. They said Yamashita was not at the home, but she also faces federal drug charges.
Police said Tkachik and Castillo also were taken into custody at the home, him for questioning about Jada's disappearance and her on a visiting a common nuisance charge. They were charged Friday with murdering the 2-year-old girl. They also were charged with two counts of neglect of a dependent, battery and false informing.
Two others were at the home, one of whom – Matthew A. Hewitt, 25, of Valparaiso – was arrested on a failure to appear in court warrant. "It went really smooth," Biggs said of the raid. "No one got hurt and people were taken into custody, and it aided in the overall case."
Aside from the recent drug investigation into Osborne and Yamashita, Taylor isn't aware of any other reported drug activity at the home. Taylor said the task force stopped a drug dealing operation at a home near Osborne and Yamashita's home in the fall, and he said there have been complaints about a few other residents of that area.

Okay. She'll be on the front page tomorrow. Just wanted to say a BIG Thank You to all of you who helped contribute to this thread by finding the information and sharing your thoughts on the murder of this precious child. She's been haunting my dreams a lot lately as I'm sure she has been in yours. I know we all wanted her to be found safe and alive, like all the missing children we hear about, but that is not the way this fucked up world always works, so at least we have gotten her story out there for the world to see and know. I appreciate all your guys' help. I could not have done it without you! Thank you so much!

Man Pleads Guilty To Encasing Toddler's Body In Concrete
Body Dumped In Swampy Area
CROWN POINT, Ind. -- A 24-year-old man has pleaded guilty to charges in the death of a toddler whose body was encased in concrete and dumped in a swampy area of northwestern Indiana.
Timothy Tkachik, of Hobart, pleaded guilty to two felony counts of neglect of a dependent during a Lake County court hearing Monday.
The plea agreement requires him to testify against Engelica Castillo, who faces murder charges for the June 2009 death of 2-year-old Jada Justice.
Jada was the subject of a 10-day search after Castillo said she disappeared from a car while the baby-sitting 19-year-old went into a Gary convenience store.
Tkachik admitted to hitting Jada's head several times, holding her down while Castillo hit her with a belt and not seeking medical attention for her.

Ex-boyfriend admits abuse in Jada Justice case
The ex-boyfriend of a Hobart woman on trial for murder and neglect of a dependent in the death of 2-year-old Jada Justice said Thursday he held the toddler as she was being struck repeatedly with a belt.
Timothy John Tkachik, 25, whose cooperation in the prosecution of Engelica Castillo, 20, was required as part of his plea agreement to two counts of neglect of a dependent, admitted he “knuckled” the child four to six times on the top of her head after Castillo began striking the girl on June 13, 2009, at their home at 3925 Missouri St., Hobart.
Tkachik faces a 50-year sentence, while Castillo could be sentenced to life in prison without parole if convicted of murder. She also is charged with two counts of neglect of a dependent and battery, each punishable by a maximum 50-year sentence.
Tkachik, an admitted drug dealer who said he regularly used heroin with Castillo, said the toddler had made a mess by getting into the refrigerator and getting out strawberries and powdered drink mix the day before. Castillo yelled at the child and spanked her.
The next morning, Tkachik said Castillo got up at about 10:30 a.m., and discovered Jada had gotten into cabinets and spilled syrup and Hawaiian Punch. Tkachik said he could hear Castillo spanking the girl and “roughing her up.” At lunch time, Castillo again became irritated because Jada was feeding her food to the dogs, so she stood her in the corner of her bedroom and began cleaning up the mess.
When Castillo discovered Jada playing with toys and sitting down instead of standing in the corner, she spanked the girl again and grabbed her by the arms to stand her up. He saw her grabbing the child by her hair and “shaking her around.” At one point, Castillo hit the child and caused her to strike her head on a table in the bedroom, leaving a small cut above her right eye.
Tkachik said Castillo asked him to hold Jada while she beat her with a belt on her bottom.
“How is it you hold down a 2-year-old child while she is being struck with a belt?” trial supervisor David Urbanski asked Tkachik.
“I don’t know — drugs. Maybe I thought it was going to be done after this,” Tkachik said. He added he didn’t think the situation would end up like it did.
That evening, he and Castillo put Jada in his Chevrolet and Castillo drove to pick up a friend in Portage before heading into Chicago to buy 10 grams of heroin for $1,000. On the way to Portage, however, Tkachik said he saw Jada’s head hanging. He jumped in the back seat and discovered she wasn’t breathing. Tkachik said he started CPR, but didn’t call 911. Instead, they drove home, switched vehicles, picked up the Portage man and bought the heroin.
A few days later, after trying to incinerate the girl’s body, during which Tkachik was burned by a fireball of gasoline and lighter fluid, they tied Jada’s body with her knees tucked to her chest and encased it in quick-drying cement. She was left in a swampy area in Otis, near Tkachik’s childhood home.
Before Jada got the cut on her head, Tkachik said he’d told Castillo to stop after noticing bruises on the girl’s arm. “Look, I’m not taking credit for none of this (expletive),” he said he told Castillo.
“She said, ‘I don’t care, I’ll say the dogs knocked her down the stairs,’ ” Tkachik recalled Castillo telling him.

There better be no mercy shown to these two mother fuckers. Straight torture, hurt and pain for the rest of their miserable existence. They did not respect a human life, especially one that was as innocent as the day is long. One that could have gone so far in life, if only allowed to be a 2 year old baby.
Fuck their lives....I'd kill them myself and I wouldn't have a remorseful bone in my body. After anyone murders a child, they stop being human in my eyes.

A Lake Superior Court jury deliberated for about 90 minutes before returning with the decision about 7 p.m.
Weeping, the 20-year-old Castillo sank to her knees while her sister, Amanda Valdez, cast her head into her hands to stifle her cries.
Formal sentencing was set for Sept. 9 when defense attorney Lemuel Stigler may pursue objections he raised Friday to the jury's decision.
The jury had sole discretion to sentence Castillo to life without parole or to a specific number of years in prison. The jurors had been given a range of 45 to 72 years based on the other four charges of which Castillo had been convicted Thursday.

I think that is a fair sentence. I hope that she sees the face of that pretty little girl everyday until she dies and goes to hell for what she did.
Not only was Jada beautiful, she was the niece of this woman; her own sister's child.
I don't care what happened to her as a child. It is no excuse to kill a child and it should have been a reason to champion all children everywhere so that others would have had a better life. That's the only way that there will be head way made against child abuse; when abusers use their pasts as inspiration to help, rather than an excuse to harm.

Melissa Swiontek / Engelica Castillo / Timothy Tkachik
The Indiana mother of a toddler who was beaten to death two years ago has been arrested in connection with the case.
Melissa Swiontek, 29, of Portage is charged with neglect of a dependent resulting in the child's death.
Prosecutors say Swiontek knew she was leaving her daughter, 2-year-old Jada Justice, with known drug dealers.
Jada died in 2009 after being beaten to death by Swiontek's cousin and the cousin's boyfriend. If convicted of neglect, Swiontek faces 20 to 30 years in prison.
Swiontek was arrested at about 8 a.m. Friday by members of the U.S. Marshals Service Great Lakes Regional Fugitive Task Force. Officers executed the arrest warrant at Swiontek's home in the 6900 block of Eisenhower Street and forced entry after knocking for about 10 minutes with no response, a spokesman said. She was home alone.
Swiontek's cousin, Engelica Castillo, 20, is serving a sentence of life in prison without parole plus five years for Jada's murder.
Timothy Tkachik, 25, pleaded guilty to two counts of neglect of a dependent in Jada's death and is awaiting sentencing by Lake Superior Court Judge Thomas Stefaniak Jr., on Sept. 9. He faces a maximum 50-year prison term.

Why did they wait for 2 years to charge the mother?
The woman convicted of killing her 2-year-old cousin lashed out at prosecutors who called her the "lowest of the low" during her sentencing in an Indiana courtroom on Thursday.
"How dare someone put that lable on anybody," Engelica Castillo spouted off. "You're not perfect."
Castillo was given a sentence of life without the possibility of parole for the murder of her young cousin, Jada Justice, who was found burned and encased in concrete last year.In a deal with prosecutors, her then-boyfriend, 25-year-old Timothy Tkachik, agreed to plead guilty to two counts of neglect of a dependent for his involvement in the crime in return for testimony against Castillo.
He faces 20 to 50 years in prison when he's sentenced Friday, a punishment that Castillo clearly felt was unfair when compared to hers.
"He couldn't keep his story straight. He kept adding things," said Castillo, referring to Tkachik's testimony during the trial.
Castillo testified that she felt threatened by Tkachik and was following his instructions.
"You couldn't hear... what was said to me, the things he told me," she said. "Tim told me, 'You'll be laying next to her.' I know what he's capable of."
Still, the plea had little impact on Judge Thomas Stefaniak Jr., who questioned if Castillo understood "the magnitude of what's going on here."
Aside from shaking her foot nervously, Castillo displayed very little, if any, remorse. It was a point noted in the remarks from Justice's mother, Melissa Swiontek.
"She got what she deserved. She had so many chances, but she never said, 'I'm sorry,'" said Swiontek.
A Lake County, Ind., jury last month took just two hours to convict the 20-year-old Hobart woman, who was babysitting Justice at the time of her death.
A week after the girl vanished, Tkachik led investigators to her body in LaPorte. She'd been burned and encased in concrete.
Tkachik testified that Castillo became irritated at the little girl for dumping a package of drink mix and spilling a container of syrup. Tkachik said an angry Castillo repeatedly struck the child.
He admitted to striking the girl several times on the head and holding the toddler down while Castillo repeatedly struck her with a belt. Tkachik said that Jada stopped breathing while in a vehicle with him and Castillo and they failed to get medical help for the child.

Children DO NOT NEED to be Potty trained, they will go when they are ready, they figure it out... Actually truth be told, Im not buying the potty training story for one second, Evilica was resentful she had to care for Jada while her mom went on vacation, it interupted her heroin marijuana using and fucking her boyfreind time so she took it out on Jada, and Timothy, will forever have the scars of this crime on his face... and what I find most evil about this bitch is not only did she pretend to be concerned and search for the little girl but after she found out the baby had died, she went on with her drug transaction as though nothing had happened, his the girls body in a car and went and bought drugs... how utterly uncaring and evil...

A region woman who one relative described as a "great mother" has twice been accused of neglecting her children, one of whom died in a high-profile homicide case, state records obtained by The Times show.
Melissa Swiontek faces felony neglect of a dependent charges relating to her daughter Jada Justice's death in June 2009. But nine years before Jada's death, Swiontek was chastised by the Indiana Department of Child Services for leaving her then 3-year-old disabled son at home alone in Portage, DCS records state.
The records recently were released to The Times through a public records request.
Swiontek told DCS investigators at the time that she thought it was OK to leave her son, Jesus Albanice, alone because he was immobile, DCS records state. He functioned at the level of a newborn baby, couldn't see and had a feeding tube, according to the records.
Jesus had Zellweger syndrome, a genetic disorder that affected his brain and liver. He died as a result of the disorder on Dec. 3, 2001, state records show.
Swiontek said she left Jesus home alone on Feb. 29, 2000, so she could go to the laundromat. She was arrested there after a confrontation with her ex-boyfriend's wife, DCS records state. When Portage police took her into custody, Swiontek told the officers she had a handicapped child at home.
DCS officials later substantiated neglect allegations against Swiontek for leaving Jesus by himself, DCS records show. She was ordered to take parenting classes and was supervised by a DCS caseworker for six months.
Swiontek's mother, Lisa Huerta, vigorously denies her daughter ever neglected Jesus — or any of her other children.
"She never neglected him, period," Huerta said in a recent interview with The Times.
Huerta said Swiontek took Jesus to regular doctor's appointments at Riley Hospital for Children at Indiana University Health in Indianapolis to treat his disorder. Life expectancy for a child with Zellweger Syndrome is 6 months, but Jesus lived until two days before his fifth birthday, she said.
Huerta claims Jesus was being watched by another family member when the incident at the laundromat took place — despite DCS records that say otherwise.
Huerta said police asked her to care for Jesus when Swiontek was arrested.
She called her daughter's arrest at the laundromat "a dumb childhood thing." Swiontek, who was 18 at the time, never was criminally charged for the incident.
"Teenagers do dumb things," Huerta said. "Who hasn't as a teenager?"
Huerta said she doesn't understand why people are trying to portray her daughter as a "bad witch" when she is a victim. She said Swiontek is a single mother who put herself through college while caring for five children.
"Everything I've seen from Melissa indicates she's a very good mom," Swiontek's attorney, John Vouga, said.
Swiontek, now 30, faces felony neglect charges relating to her daughter Jada's death at the hands of a cousin and the cousin's boyfriend in June 2009, Lake Criminal Court records state. Swiontek is accused of leaving then 2-year-old Jada with Engelica Castillo and Timothy Tkachik, knowing they were drug users and dealers.
Swiontek previously told The Times she intended to leave Jada with the Hobart couple for nearly two weeks.

Why did they wait for 2 years to charge the mother?
They can wait as long as they want. There is no Statuate Of Limitations on murder. It's like herpes, it's forever.
Maybe it took that long to develop a solid case. jumping the gun sometimes blows a case and obviously guilty people will walk on technicalities. That is my thought.
