James Hawkins had help when he killed and dismembered his girlfriend....their 12 year old daughter.

The girl told authorities that the headless torso found on Valentine's day was her mother, and that Hawkins made her help him dump the body. She also says she witnessed the killing, and the chopping.

Hawkins admits to slicing up Charlene Gaither of Memphis and attempting to get rid of the body, but he says he didn't kill her.

Hawkins' 12-year-old daughter testified about what happened leading up to the day police found Gaither's body.

The girl said that during an argument, her father got a knife from their kitchen and stabbed Gaither in the neck, before ultimately choking her to death.

Afterward, the girl said, her father made her help cut off her mother's head.

Then, she testified, she helped cut off Gaither's hands and feet.

The 12-year-old said she then rode along with her father into DeSoto County, where they dumped Gaither's body.

The girl said her father discarded her mother's hands and feet at nearby factory, and threw her head into some water under a bridge.

In court, Memphis Police Sergeant Tony Mullins testified that Hawkins bought a circular saw used to dismember the body at a local K-Mart.

Hawkins later returned the saw to the store, Mullins said.

When police originally interviewed the 12-year-old, she told them she didn't know what happened to her mom.

A young girl who told police her father forced her to help as he cut up her mother's body with an electric saw said she could only look away when the head fell to the floor.

The girl is the chief witness against James Hawkins, 31, a prison parolee charged with first-degree murder in the death of Charlene Gaither, 28, a longtime companion with whom he had three children. His trial is scheduled for September and prosecutors are seeking the death penalty.

Police say Gaither was killed in February 2008 at the apartment she shared with Hawkins, their then 12-year-old daughter, Keyuna Thomas, and two boys, ages 9 and 11.

Keyuna, now 13, told police she saw Hawkins stab her mother in the neck with a knife and then strangle her after she threatened to call police during an argument.

The girl told police her father forced her to help as he cut up the body a day after the killing.

Hawkins denies killing Gaither, but police say he acknowledged dumping her body along a rural highway after severing her head, hands and feet.

"We hope to establish that he, in fact, gave no statement," said defense lawyer Larry Nance. "That's his position, that he didn't say that."

But prosecutors say Hawkins, who had filed a missing person report on Gaither, blurted out to police that he had disposed of her body.

"It was a voluntary statement, a spontaneous statement," assistant state prosecutor Patience Branham said.

Branham spoke Monday after a scheduled court hearing was postponed until May 22 on a defense petition to dismiss the alleged statement.

Hawkins, who is being held on a $4 million bond, has denied speaking with detectives about the killing.

Authorities say Gaither died on Feb. 9, 2008, about five months after Hawkins was paroled on a 15-year prison sentence for a string of robberies. His parole was set to end in December.

His daughter was 4 when Hawkins was convicted of armed robbery in 1999.

Hawkins reported Gaither missing Feb. 12 and her torso was found two days later in rural Mississippi, just south of Memphis. The severed body parts were not found, and the body was identified through DNA analysis.

The girl, now in the custody of her mother's family, said her younger brothers did not witness the slaying nor see their mother's body. But, she said, she was forced to help clean up the bloody scene and drag the body to a freezer where it was stored temporarily.

"I told my dad I didn't want to do this anymore," she told police. "He says, 'You want to die, too?'"

How do you ever recover from witnessing something like this? Not only did he viciously murder this child's mother, but what he did to the child is unimaginable. It hurts just to read about it. God bless Keyuna. Death by lethal injection would be too kind for this man.

The November capital murder trial of a man charged with killing and dismembering his girlfriend was reset Thursday because of a new indictment charging him with rape of a child.

State prosecutors want to consolidate the charges in one trial for James Hawkins, 33, who is accused of killing Charlene Gaither, 28, on Feb. 9, 2008, in their Raleigh apartment.

I can hardly wrap my mind around this. That child lives and breaths but isn't living anymore.

My heart goes out to her I cannot imagine the horror she relieves everyday.

Rest in peace Charlene Gaither, your nightmare continues throw your daughter. So sorry.

I know one thing, this is one apartment complex I would not live in. This is the same apartment complex that the woman that gave away baby Lauryn lives in (Sept 18 2010 posting). Sounds like a lot of bad shit happens here.
I am just beyond words as to what they should do to this man. We had a case like this around Mobile where the man, a reverend, kept his wife that he killed in front of his daughter in the freezer, then kept his daughter pregnant. Finally she got away from him and was able to get to the police and all hell broke lose. They are still trying to sort all that shit out. You just shake your head and pray for all the children involved and hope that some how they can survive this. GOD BLESS THIS CHILD.

MEMPHIS, TN - (WMC-TV) - Action News 5 is blogging the trial of James Hawkins, a Memphis man charged with first degree murder in the death of his live-in girlfriend, Charlene Gaither.

Hawkins is accused of killing Gaither. After the murder, Hawkins admitted to police that he cut of Gaither's hands, head and feet, before dumping her torso in a secluded area, and other body parts in another location.

Hawkins allegedly forced his daughter, who was 12-years-old at the time, to help him dismember her mother's body.

Hawkins defense is arguing that his daughter killed her mother, and then he helped her cover it up.

Hawkins tried to plead guilty to dismembering the corpse, and filing a false report, but the judge would not consider his pleas, since he said they should have been entered before the jury was sworn in. The judge says now that the jury has already heard the charges it would prejudice them.

Trentham spoke with Charlene Gaither outside between two apartment buildings. Her two sons were with her. Gaither advised that she believed something inappropriate was going on with her daughter and Hawkins.

Jury chooses death sentence for Tennessee man who killed, dismembered wife


MEMPHIS — A jury issued a death sentence Saturday for a Memphis man found guilty of murdering the mother of his three children and then dismembering and disposing of her body.

The jury reached its decision shortly before 7:30 p.m. EST in the case against 33-year-old James Hawkins.

Hawkins' 15-year-old daughter, the prosecution's chief witness, had testified that her father repeatedly sexually abused her when she was 12 years old.

The girl said she saw her father stab and strangle 28-year-old Charlene Gaither during an argument on Feb. 9, 2008. Hawkins' two sons, ages 13 and 14, also testified against him.

It took less than two hours for the jury to convict Hawkins on Friday.

You know, murderers are selfish people. They don't think about the families of the victim. They just think about themselves & solving their "problem"/exacting their "revenge" on people that wronged them.

Murderers that end up CUTTING up their victims are EVEN MORE SELFISH because they don't think about those who happen across the body parts (although I think finding the head is the worst part of all). They don't care how they ruined the nice lake/fishing trips little Tommy had with grandpa where they spent time together. They don't care about the teenagers/kids that will find the body while they're out for a walk with the dog or playing (& not video games/computer games) outside in the woods.

A man convicted and sentenced to death for the murder and dismemberment of the mother of their three children was given an additional 18 years in prison this morning.

James Hawkins, who has 19 prior felony convictions, was sentenced to the maximum 12 years for filing a false missing person report and six years for abuse of a corpse.

The judge called Hawkins a dangerous, professional, career offender who has little regard for human life.

"Society needs to be protected from him," said Criminal Court Judge Chris Craft, adding that the death penalty was not a certainty. "The laws could change. Charles Manson once was under the death penalty and now he comes up for parole every year."

He also has a pending charge of rape of a child, the victim being his own daughter.

No trial has been set.
