View Full Version : Jessie James Dalton shouldn't have been sharing a cell with Paul Duran Jr.

Prison spokesman Jerry Massie says Paul Duran Jr. fought with one cellmate and then was put in a cell with Jessie James Dalton.

Duran was found beaten to death about 15 minutes later.

Massie says the two were not supposed to be put in the same cell and prison officials are trying to determine how it happened.

Duran and Dalton were co-defendants in the January 2002 shooting death of Billy Wayne Ray in Oklahoma City.

Duran pleaded guilty to a robbery charge and testified against Dalton who was convicted of murder and sentenced to life without parole.

Massie says investigators will present their findings to a district attorney who will decide if criminal charges will be filed.

Makes me wonder if this was a "mistake."

I find it really hard to believe this was a mistake!

They should have been in seperate areas of the prison.

There's no way this JUST happened.

Geeze, this Paul didn't stand a chance against the other guy. He got sent to prison when he was 16 years old. Jessie James Dalton was doing life with out parole for fucks sake, he had nothing to loose killing Paul. Well barley nothing. Paul still had quite a while till his first parole hearing , it wasnt till 2025.


Attorney Bill Smith worked out a plea agreement six years ago so Paul Duran Jr. would be young enough to enjoy life after he got out of prison.

Smith said he’s sad and disappointed Duran will never have that chance.

Duran, 23, was beaten and found dead Wednesday night just 15 minutes after being put in a cell at the Oklahoma State Penitentiary with a man he testified against, a state prisons spokesman said.

Duran was in an altercation with Jessie James Dalton, 32, authorities said.

Dalton was serving a life sentence for the March 2002 shooting death of Billy Ray Wayne, 19. Dalton, then 25, Duran and Warren Alan Plank, 16, carried guns as they broke into Wayne’s Oklahoma City home and demanded money from the family.

Duran testified against Dalton in exchange for a lesser charge and a 28-year prison term, Smith said.

“He was a scared 16-year-old kid who was hanging out with the wrong guy,” Smith said. Smith said Duran was extremely remorseful over Wayne’s death.

“I remember he apologized to the young man’s family,” Smith said. “If he could have changed what happened that night, he would have.”

Relatives seek peace

Duran’s sister, Candace Duran, said the family is treating his death as a private matter. Smith has been in contact with family members since Thursday. They’re crushed and ask the media to give them time to grieve, he said.

Smith said he’s trying to find out how Duran ended up in a cell with Dalton. Since Duran testified against Dalton, the two men were ineligible to share a cell.

That type of information is normally listed in a prisoner’s file, and it’s the responsibility of the supervising guards to check the file before assigning a prisoner a new cell mate, state Corrections Department spokesman Jerry Massie said.

He said to his knowledge, no agency employees were put on suspension in connection with Duran’s death. The district attorney will determine whether to file charges.

I am still trying to figure out why they were both in the same prison. They had to run into each other some time and you know there was going to be hell to pay if they did. Paul was doing like 25 years or so there, and Jessie Life. Thats a long time to keep a eye on them.

SS -- I agree with you completely. I think this kid made someone mad -- apparently he had just been fighting with a previous cellmate -- and someone decided to "teach him a lesson." I think they purposely made a "mistake" placing them together. If that's the case, I hope they get to the bottom of it and there are some charges.

Tazzzz -- Good point. I hadn't even thought of that. The other issue is that even if they did keep them separated in the same prison, the possibility always exists that Dalton could have found another prisoner who DID have access to Duran to take care of him. Don't things like that happen in prison all the time? They should have sent them to different prisons.

A brutal ending to a sad and pathetic life.

Why was a 16 year old in an Adult prison even tho he was convicted as an adult? I thought they housed underaged convicts in juvi? seems like that would be better for their protection.

OT- I DID see that article. I also saw how that all came to light weeks earlier because a bakery refused to put Happy Birthday Adolf of that kids birthday cake. Once CPS heard about that they came a runnin...

There's supposed to be an investigation ensuing at the OSP, but they've already gone into it with the whole "it was unintentional" mindset.

And maybe it was. However, any investigation that starts by shouting "it was an accident!" doesn't sound like much of an investigation to me. They could have prevented this.

When the crime originally happened, the 16 year old went with the other guy to a house and he carried in the gun/rife into the house. The older guy robed and killed the owner. So they charged him with accessory to murder or what ever thats called. So they bumped him up to the adult court on the murder charge. He made a deal with the D.A. to testify against the tard and got a lesser sentence. At that point it was to late, he was already in the big boy court, so he got the big boy crime time for it.

Looks to me like that was a bad deal for the 16 year old he was treated like fresh meat in there and he never had a chance.

A new and interesting article on the Tulsa World site today, regarding a letter supposedly sent by Dalton to his family after he killed Duran.



"Usually when I ask forgiveness I feel something,” Dalton, 32, said in the letter, parts of which his family gave The Oklahoman. "But this time, it just felt like my prayerz (sic) floated off in space or nowhere.”





Dalton and Duran were listed as separatees, meaning they should not have been allowed to share a cell. Massie said a preliminary investigative report states Duran and Dalton both told guards they would be able to get along if placed in the same cell.



They were still listed as separatees, for good reason.

That’s something Dalton’s father said he has trouble believing.

"Paul Duran wouldn’t have wanted him in there,” James Dalton said.

My thought EXACTLY. Why would they agree to share a cell unless they both wanted to have at each other? They were listed as separates for a reason. They should have never been put together.

From Dalton's father:

"It’s the prison’s fault for putting them in that situation,” he said. "They should have never been in there (together). ... It was self-defense, probably for both of them.”

Dalton wrote in the letter he felt his life was in danger when he fought with Duran, and he apologized to his mother for "the shame (and) heartbreak I keep bringing to you and dad.” He wrote he would tell more but felt he couldn’t because inmate letters are screened.

Massie said the fight occurred inside the cell, where there is no video surveillance, and no one else witnessed the fight.

Guards moved Dalton to segregated housing after the fight, and he won’t be allowed to send letters or get visitors unless his status changes, Massie said.


My first thought was BULL! But Duran had just been moved because of a fight and he might have gone into Dalton's cell angry and full of piss and vinegar.

I agree with Dalton's father that the prison is at fault. And if it only took 15 minutes of being together for Duran to be killed, how is it that no one was around to witness any of it. Did they really put "separates" in a cell together and just walk away? Without any cameras, I guess we'll never know for sure what happened in that cell.

It will be interesting to see what the "investigation" shows.

"Family may sue"


Prison officials fired Leroy Harris, 55, and suspended Darrell Wilson, 43, in connection with the March 11 death of Paul David Duran Jr., 23.



Harris put Duran in the cell with Dalton without checking to determine whether they were allowed to share a cell, prison warden Randall G. Workman wrote in the letter explaining Harris’ termination. The men were listed as separatees, which prohibited them from being cell mates.

Harris also failed to follow inmate housing policies and security plans, Workman wrote.

Wilson, a unit manager, approved a plan to house Duran and Dalton in separate cells, with one cell between the men. At the time of Duran's death, there were two other empty beds in the housing area, according to the letter.
