ALTOONA, Pa. -- A 19-year-old central Pennsylvania woman is jailed for child endangerment and her live-in boyfriend is charged with beating her 3-year-old son in the face.

Altoona police are not releasing the name of the boy who they say was flown to UPMC Children's Hospital of Pittsburgh in critical condition after the incident Sunday.

Police have charged boy's mother, Emily Brogden, with endangering the welfare of a child. Police charged her boyfriend, 22-year-old Ryan Brothers, with aggravated assault, the endangering charge and other offenses.

Police said Brothers admitted to "various aspects of the abuse."

The suspects pleaded not guilty when arraigned on Sunday. Court records don't list attorneys for them.

A boy who turned 3 years old in January was beaten so badly early Sunday that he was flown to Children's Hospital in Pittsburgh for treatment, Altoona police said.

A hospital spokesman reported Sunday afternoon that the child was in critical condition but that he could not comment further.

The boy's mother, Emilee Brogden, 19, of 1939 W. Chestnut Ave., Apt. 3, was charged with endangering the welfare of a child, a felony.

She was sent to Blair County Prison in lieu of $30,000 cash bond by Magisterial District Judge Steven Jackson.

The man she was living with, Ryan Brothers, 22, was sent to jail in lieu of $250,000 bail after he was charged with aggravated assault, endangering the welfare of a child and other offenses.

Police said Brothers admitted to "various aspects of the abuse."

He too was arraigned before Jackson.

In addition to the high bail set for Brothers, a state parole detainer was filed against him, which means he will remain incarcerated at least pending the outcome of a parole violation hearing.

A representative of Blair County Children and Youth Services contacted Altoona police requesting that they check on the welfare of the two boys in the home, ages 2 and 3.

Police said the 3-year-old was suffering from "severe facial trauma."

The boy was transported to Altoona Regional Trauma Center, then flown by medical helicopter to Children's Hospital in Pittsburgh.


He underwent emergency surgery for the injuries caused by the abuse, police said.

Brothers has a prior criminal record. In 2007, he was sentenced in Blair County to serve one to two years in prison for burglary and resisting arrest. The mother of a 3-year-old boy delayed seeking medical treatment Saturday for what police say were obvious injuries to her child because she didn't want to be blamed.

The child is suffering from a broken nose, a broken wrist, life-threatening injuries to his pancreas and small intestine and "multiple burns about his body."

A police affidavit of probable cause that accompanied arrest documents in the Brothers case stated that the boy's nostril appeared to be partially burned away.

Investigators don't know what caused the burns, but the investigation is continuing. Two city detectives assigned to the case were not available for comment Tuesday.

Brogden told police that when she arrived home from the hospital Saturday, she observed the 3-year-old suffering from severe trauma to the face. The boy was lethargic and vomiting.

She confronted Brothers about the boy's condition, and he said the boy had fallen in the bathtub, according to arrest documents.

Arrest papers state that she "did not feel that the injuries were consistent with Brothers' story."

She tried to care for the child but did not seek immediate medical treatment, police said, "because "I didn't want all of this coming back on me."

She told police both her children suffered from "recent unexplained bruising over recent time."

Hospital Fund Collecting Donations for Abused Toddler

Family and friends have set up a fund to help pay for the medical care of a 3-year-old boy found badly beaten inside a Chestnut Avenue apartment over the weekend.

The Altoona Regional Health System Credit Union is now accepting donations for the toddler. The money will be used to pay for ongoing medical treatments and future plastic surgery. Altoona Police say the boy was taken off life-support on Wednesday, but he’s still in critical condition at Children’s Hospital in Pittsburgh.

Police say the toddler nearly died from the abuse. Court documents say there was severe swelling to the victim’s face, bruising on his body, and burns on his head and lower back. The toddler underwent emergency surgery to repair his small intestine, liver and pancreas.

Police arrested the boy’s mother, 19-year-old, Emilee Brogden, and her 22-year-old boyfriend Ryan Brothers in connection with the abuse. Both remain lodged in the Blair County Prison awaiting their preliminary hearings.

The 2 year old was brought to the doctor for blood coming out his ear and CPS was called about it, the mom snuck him out the next day and went home, so CPS called the cops, They went out to the home and found the 3-year-old all messed up. I don't think the Heroin is a excuse to abuse kids, But I do expect kids to not be left with them.


HOLLIDAYSBURG - A 3-year-old Altoona boy, who has been in critical condition at Children's Hospital in Pittsburgh since being badly beaten and abused 12 days ago, will live, according to his court-appointed guardian.

The guardian, attorney Mary Ann Probst, attended a hearing before Blair County Judge Tim Sullivan Wednesday in which Blair County Children and Youth Services was given custody of the boy and his 2-year-old brother, also a suspected child abuse victim.

Probst visited the 3-year-old in the hospital, talked to his doctors and reported to the court that the boy is progressing.

An attorney for Children and Youth Services, William R. Brenner, also reported the boy is doing better.

Sullivan; several attorneys; CYS officials; the boy's mother, Emilee Brogden, who is awaiting a hearing on charges of child endangerment; and Altoona Detective Sgt. Ben Jones conducted a telephone conference with a Children's Hospital doctor prior to the hearing.

Afterward, Sullivan decided the boys will remain in the custody of CYS.

The younger brother is in a foster home, and a caseworker said that when the 3-year-old is released from the hospital the agency will attempt to place the boys together.

Several of the boys' relatives are being considered as foster parents for the long run, including their natural father.

Jones testified Wednesday that on the evening of March 13, Brogden noticed blood in the ear of her 2-year-old and took him to Altoona Regional Health System, Altoona Hospital Campus.

Jones said Brogden asked her boyfriend, Ryan Brothers, 22, who lived with her and the two boys at 1939 W. Chestnut Ave., to watch the 3-year-old.

Jones reported that Brothers "reluctantly" took responsibility because he was withdrawing from a high.

CYS was notified by the hospital about the 2-year-old after it was discovered he had bruises and a punctured eardrum.

Brogden stayed with him at the hospital until he was released the next day. When she failed to notify a CYS caseworker when she took the 2-year-old home, CYS officials called Altoona police for assistance. Officers went to Brogden's home and threatened to forcibly enter if she did not open the door.

When police checked the 2-year-old, he appeared happy and was playing. Officers said, however, that they noticed the badly beaten 3-year-old.

He was taken by ambulance to Altoona Regional, then quickly flown to Pittsburgh.

The boy had bite marks; bruises from head to toe; a battered face; a damaged pancreas, liver and small intestine; and a badly burned right nostril.

Jones said that Brothers, who faces charges of aggravated assault and related offenses, admitted striking the 3-year-old on the night of March 13 three times with an open hand and roughly shoving him into the bathtub.

Jones said Brothers admitted he was "just frustrated with [the boy's] behavior that night ... and his withdrawal from heroin."

As investigators put the story together, they learned Brothers left the house between 11 and 11:20 p.m. March 13 to get heroin.

Preliminary hearings for Brogden and Brothers, scheduled Wednesday before Magisterial District Judge Joseph L. Moran, were postponed until April 8.
