A Melrose man remains in jail, facing a hearing for allegedly abusing his baby daughter. Phillip Holmes is in the curry county detention center for what police are calling abuse.

The baby was taken to a hospital last week with reported wounds like skull fractures, bleeding under the scalp and broke ribs. Holmes' son also reportedly told police his dad likes to choke the baby.

During an interview, police say holmes first said the baby had fallen off a bed and was then mauled by a dog, but changed it to say he accidentally dropped her.

His hearing is set for March 26th

A 25-year-old Melrose man is being held at the Curry County Adult Detention Center on a $25,000 bond, charged with first-degree child abuse after hospital officials found that his 3-month-old daughter had numerous broken bones, the Clovis News Journal reported.

Phillip Holmes was arrested after health-care workers were called to Plains Regional Medical Center around noon on March to report a possible case of abuse, the News Journal said.

A doctor told the officer that based on X-rays she had taken, the child's arms had been grabbed "with a lot of force" and "torqued" until they broke, the paper reported.

The doctor also told police that she found skull fractures, bleeding beneath the baby's scalp and broken ribs that had been healing for about three weeks, according to a police report.

There was also evidence that the child had been grabbed by the neck, the doctor told police, and when an officer spoke to family members waiting in the hospital lobby, Holmes' son volunteered that he knew how the baby got hurt, saying "dad chokes (the baby)," the News Journal said.

Police said a family member silenced the boy before he said anything further and told police the boy was an "unreliable source," the paper reported. ( Ha HA )

Holmes later told police that the baby had fallen off a bed and was mauled by a dog, but the child's injuries did not appear consistent with that account, according to the News Journal.

A preliminary hearing for Holmes has been scheduled for March 26 in Magistrate Court, the paper reported.

The child’s mother said she called 911 after she came inside and tried to feed her but became worried when the baby’s arms were unable to hold the bottle and she cried when her arms were touched.

Holmes told police several times he didn’t mean to hurt the baby and that it was an accident, records show.

Holmes faces a March 26 preliminary hearing in Magistrate Court. According to New Mexico statute, a first-degree felony is punishable by up to 18 years imprisonment.

Thought about that too, and I believe mine couldn't two years ago when he was 3 months old. I don't think they can coordinate that well at that age, as in getting the bottle into their mouth on purpose.

A Melrose woman who called 911 to report her infant daughter was crying when touched and couldn’t use her arms to hold a bottle is now facing child abuse charges along with the baby’s father.

A warrant was filed Friday for the arrest of Crystal Broeder on a felony charge of child abuse, according to court records.

Broeder has not been arrested as of mid-Monday afternoon, according to jail and court officials.

The baby’s father, 25-year-old Phillip Holmes, was arrested March 6, charged with child abuse resulting in great bodily harm after doctors discovered the 3-month-old girl’s arms were broken, she had skull fractures, broken ribs that had been healing about three weeks and damage to her neck bones, court records show.

A doctor told officers the only explanation for the injuries was the toddler was grabbed or handled with force.

Broeder called 911 March 5 and the child was transported to the emergency room at Plains Regional Medical Center.

Holmes told police he dropped the baby and tried to catch her while her mother was outside, explaining that he didn’t mean to hurt the infant and it was an accident, records show.

Holmes remains in jail on $25,000 bond and is awaiting a March 26 preliminary hearing in Curry County Magistrate Court.

Is little Caylee out of the hospital? In the one pic where Crystal is holding her, there is a dog in the chair next to them. Sure looks like a bruise on her cheek - a pretty significant bruise. It's hard for me to see her arms, but they do look wrapped or perhaps casted.

Clovis, NM — Ninth Judicial District Attorney Matthew Chandler announced today that Phillip Holmes, age 26, of Melrose pled guilty today to charges of 1st Degree Child Abuse and was sentenced today to twelve (12) years in the Department of Corrections.

The charges stem from March 5, 2009, when the Melrose Police Department responded to Plains Regional Medical Center concerning a 3-month old baby girl suffering from two broken arms and multiple areas of bruising. Upon arriving, authorities found that the mother rushed the baby to the hospital after the child started displaying signs of impaired motor skills. The mother told authorities that she stepped outside the house for a short period of time and left the child under the care of the child’s father, Phillip Holmes. Phillip Holmes attempted to explain to authorities that his daughter sustained the injuries after she fell off the bed and was attacked by a pit bull puppy at the residence. As the investigation continued, Holmes changed his story and claimed that he accidently dropped the child. However, both of Holmes stories were inconsistent with the injuries to the child and the medical doctors’ examinations.

The Honorable Judge Stephen K. Quinn presided over the sentencing hearing and Chief Deputy District Attorney Andrea Reeb prosecuted the case for the State. Judge Quinn sentenced Holmes to serve twelve (12) years in the New Mexico State Penitentiary. Once Holmes finishes his prison term, he faces an intensively supervised probation period of an additional two (2) years. The court also ordered Holmes to participate in mandatory counseling while incarcerated and continue the counseling as a condition of his parole.

WOW! Sis really pulled a 180 with this new revealation! She was really quick to condemn him which leads me to believe she thought he was capable of doing something so horrible.
