Also in Room 108 at the time was Gabrielle's 3-year-old brother, who is now in custody of the Department of Children and Families.

When questioned about the incident, Lopez admitted to beating the girl, Carter said. He was charged with aggravated child abuse.

Additional charges stemming from the toddler's death are pending a Medical Examiner's review.

Danielle McClery is the bio mom of both kids and Kenneth was just the boyfriend. It kind of sound to me like the 3-year-old was the only other one in the room at the time of the beating. Mom must have been out working some night job of some kind and didnt get home till 5 am.


Lopez is the live-in boyfriend of the girl's mother, Danielle McCleary.

The sheriff's office said the beating occurred sometime Saturday when the girl did not want to go to sleep and would not stop crying. Lopez wrapped a white towel and a blanket around her arms and torso, then hit her repeatedly until she stopped breathing, the sheriff's office said.

The girl's mother called police at 5 a.m. Sunday. Gabrielle died at 1 p.m. at St. Joseph's Hospital.

A 3-year-old son of McCleary was in the room during the beating and is in the custody of the Department of Children and Families.

Fair comment. They had only lived there for 2 weeks and were living in a hotel, so the possibility of her being at work never occured to me. Did they both move there from Illinois? Did she move there to be with him? He is not named as either kids father, so I have to wonder how long she had known him. If it wasnt for very long, then she is at fault for leaving him to watch her kids (as so often happens in the stories on here). But as you rightly say, the whole story is not available yet, so I will try and wind my neck in. It just sounds suspicious.

My oldest son went to military school (he's 32 now) and he told me a couple times about kids who would do this to other kids (that they considered malingerers or members who were bringing their unit down). On March 7, 2009 the suspect, Kenneth Lopez, (which is the live in boyfriend of the victim's mother) abused the victim. The victim did not want to go to sleep, so the suspect wrapped the 2 year old with a white towel around the arms and torso then wrapped her in a blanket including her face and began to strike the victim repeatedly upon her body as she was wrapped within the blanket. As a result of the beating the victim became unconscious and stopped breathing. At approximately 5:00 A.,M.on March 8, 2009 the mother called authorities. The child was transported to St. Joseph's Hospital where she was admitted in critical condition. At approximately 1:00 p.m. Sunday, March 8, 2009 the child died at the hospital.

An autopsy will be performed by the Medical Examiner's Office to determine the cause of death. At the time of Kenneth Lopez' arrest, he admitted to detectives that he wrapped the child in a towel and a blanket covering her face and struck her several times to discipline her because she did not want to go to sleep and she would not stop crying.

TAMPA — An unconscious 2-year-old girl wasn't the only disturbing discovery authorities made when they arrived at Room 108 of the Homestead Studio Suites hotel last week.

The toddler's 3-year-old brother had "DumbASS" scribbled on his forehead.

He said his mother, Danielle McCleary, wrote it.

Authorities took the boy to foster care. They rushed his sister, Gabrielle Randel, to St. Joseph's Hospital, where she died hours later from injuries they said were inflicted by the mother's boyfriend of three months.

On Thursday, the Hillsborough Sheriff's Office accused the boyfriend, Kenneth G. Lopez, of murder. The agency previously said that Lopez, 21, admitted to bundling the little girl's body and face in a sheet during the early hours of March 8 and repeatedly striking her to get her to stop crying.

McCleary called authorities at 5 a.m. after her daughter stopped breathing. Authorities said Gabrielle suffered blunt trauma to her forehead, multiple marks and bruises to her entire body, a hand mark on her body and serious trauma to her genitalia.

Lopez, who was already being held on an aggravated child abuse charge, remains in jail without bail.

At the downtown Tampa courthouse Thursday, McClearly, 23, cried at a hearing to discuss custody arrangements for her surviving child.( Boo hoo hoo FUCK you bitch)

During the hearing, Hillsborough Circuit Judge Tracy Sheehan described the message on the boy's forehead. A sheriff's investigator said McCleary admitted writing it.

Officials said the boy has had some trouble sleeping and has made statements about his sister's death. But when he sees pictures of her, he says, "Look, Gabbie's not dead," according to his father, Michael Randel.

Randel, 24, said he drove 17 hours straight to Tampa from his Texas home when he got the call March 8 saying his daughter had been injured.

He had not seen his children in three months because McCleary and Lopez left town with them without saying where they were going, he said.

McCleary told deputies the couple had been living in the Homestead Studio Suites just off of Hillsborough Avenue and Veterans Highway for two weeks after moving from Illinois.

Sheehan said the 3-year-old could travel to Texas with his father for an extended visit until a permanent placement decision is made.

She said McCleary could have supervised visits with her son, but "no dumb a-- statements."

"He has been through more than enough," Sheehan said.

After court, McCleary didn't want to comment on her boyfriend's arrest.

Deputies say that when the girl, Gabrielle Randel, didn't go to sleep easily last month, her mother's boyfriend picked her up, wrapped her in a towel and began beating her. As Kenneth Lopez hit the tiny wrapped figure, Gabrielle stopped crying, authorities say.

She was eventually taken to St. Joseph's Hospital, where she was pronounced dead.

Lopez, 21, initially was charged with aggravated child abuse. He now is charged with first-degree murder, court records show.

Lopez is the live-in boyfriend of the girl's mother, Danielle McCleary. She turned herself in to authorities this afternoon. Deputies say she was in the room when the beating happened but did nothing to stop it.

Her attorney, Brian Gonzalez, said he and McCleary were surprised with the extent of the criminal charges against her.

"The state's theory under the circumstances is that she failed to protect her daughter from the act of her boyfriend," he said. "I think certainly no one can really have an idea of what a situation is like until they sit in somebody's shoes."

Gonzalez said McCleary is going to cooperate with the State Attorney's Office "to try to get the guy who belongs in prison for this in prison – that being Mr. Lopez."

McCleary remains heartbroken by the death of her daughter, Gonzalez said. He said the charges against her are difficult for her to handle.

Between 1 and 4:52 a.m. March 8, Gabrielle's hands and feet were bound in blankets, and Lopez beat and pinned her under a martial arts pad, an arrest report states. The girl suffered bruising to her head, torso, arms and legs.

Gabrielle's cause of death was compression of chest and abdomen, and the manner of death was homicide, sheriff's spokeswoman Debbie Carter said today.

TAMPA — How could a mother stand by and watch as a man beats her toddler to death?

Tampa attorney Brian Gonzalez says he knows people wonder that when they hear about his client.

Danielle Nicole McCleary, 23, surrendered to deputies Saturday on child neglect and aggravated manslaughter charges in connection with her daughter's death.

Deputies say McCleary watched and did nothing to halt her live-in boyfriend as he bundled the 2-year-old's body and face in a sheet during the early hours of March 8, then repeatedly struck the child to get her to stop crying.

McCleary called authorities at 5 a.m. after Gabrielle Randel became unconscious and stopped breathing. Gabrielle soon died at St. Joseph's Hospital, deputies say.

Gonzalez said McCleary was scared of Kenneth G. Lopez, who had lived with her for three months. They'd known each other for about a year and a half, but only recently started sharing a residence, Gonzalez said.

"Unless you're there and unless its happening in your life, you can't know," Gonzalez said, describing McCleary's relationship with her boyfriend as very volatile, but declining to go into detail.

The couple were staying in Room 108 of the Homestead Studio Suites when the incident happened. Gonzalez said they'd just moved to Florida from another state because McCleary was from here. They were trying to get their feet on the ground and had no car, no jobs, Gonzalez said.

Lopez, 21, remains in jail on charges of first-degree murder and aggravated child abuse, charges to which he has pleaded not guilty. McCleary was booked into the Orient Road Jail, then released a few hours later on $15,000 bail.

"Kenneth Lopez is a dangerous guy," Gonzalez said. "He's trained in the martial arts, and it was a very volatile relationship."

Told of the characterization, Public Defender Chuck Traina, who has represented Lopez until now, pointed to Lopez's not guilty plea.

"There's a solid reason for that," Traina said, declining to comment further.

Last month, during a hearing to discuss custody arrangements for McCleary's surviving child, a 3-year-old boy, a judge described a message written on the boy's forehead when authorities arrived.

"DumbA--" the words said. The boy told authorities his mother had written it.

McCleary is now living with her parents, Gonzalez said, and has been advised not to talk about the incident. She is trying to regain her parental rights through dependency hearings, he said.

For now, a judge permitted the 3-year-old to be placed with his father in Texas.
