Jose Santiago told deputies it all happened Monday at the Murphy USA Gas Station at 2517 Lee Boulevard in Lehigh Acres.
He says he was trying to hold a spot at the gas pump for his wife when Miguel Neira pulled into the gas line.
Santiago said he put his hands up signaling Neira to stop. But a sheriff's office report states that he instead lunged forward with the Chrysler Voyager minivan, hitting Santiago in the knees.
Santiago wasn't badly hurt by the car and even turned down medical treatment. But he has hired a lawyer and plans to press charges.
Neira was arrested on the scene. He is facing battery charges and is currently at the Lee County Jail.
