Breathalyzer Demo PicA Long Island man with a history of DWI rented a car to avoid driving his own - which is outfitted with a court-ordered Breathalyzer - but was busted for driving drunk again when he smashed into a pole.

Marvin Rice Jr., 27, of Shirley, totaled a brand-new Volkswagen Jetta when he slammed into a pole in Brentwood just before 6 a.m., according to cops.

"The man was driving a rental car because his personal vehicle is equipped with a court-mandated anti-drinking-and-driving device" as part of Suffolk County's Interlock Ignition program, according a police spokesman.

It requires drivers to submit to a breath test before the car ignition starts.

Rice, who was alone, had to be cut out of the smashed-up rental.

He broke both legs and his pelvis and was airlifted to Stony Brook University Medical Center for surgery.

He was charged with DWI.http://www.nypost.com/seven/02152009/news/regionalnews/li_breath_a_liar_rents_car_to_drive_drun_155351.ht m

Good thing he banged the utility pole and not another vehicle! Fucking asshole. They better not let this alcoholic back out - continued to let him drive, although w/ the installed device - he should've been thankful and smart enough to still be able to drive! To blatantly step around the law by renting a vehicle! REVOKE his driving privileges period. No driving anywhere, ever.
