"It was emotional and stressful for him," says J. Clark Stankowksi, Troy MacDonald's attorney. "Any human in a situation like that with the guards around him and all the people, it's emotional."
"I've seen some people cry just for the television cameras," says Baldwin County District Attorney Judy Newcomb.
During the preliminary hearing, prosecutors outlined detailed information about what they say happened the night Parish went missing.
Prosecutors say Parish was raped, sodomized then strangled to death. The district attorney's office also says Parish was beaten over the head with an object.http://www.wkrg.com/crime/article/capital_murder_suspect_cries_in_court/23136/
When Brianna Parish arrived at the Jubilee Lounge on Nov. 11, she turned the head of the man now charged with her murder, according to court testimony.
"He told some of the witnesses that he noticed Brianna and pointed her out to several people and indicated he was going to hook up with her," said Daphne Police Cpl. Jason Vannoy in Baldwin County District Court.
On Nov. 14, a search party found Parish's nearly nude body near a concrete ditch. An autopsy indicated the 21-year-old died from strangulation and a single blow to the back of her head.
On Dec. 22, Troy Robert MacDonald, 43, of Daphne was arrested and charged with capital murder.
MacDonald and Parish met for the first time at the Jubilee Lounge on Nov. 11. Parish, who was noticeably intoxicated, and her friend Callie Robertson arrived at the Bay House Pub about 12:45 a.m. Parish and MacDonald spoke on the phone on the way to the pub. Robertson told police that MacDonald was sitting in his car near the pub's back entrance when she walked into the bar.
"(Parish) told Ms. Robertson that she would be in shortly, and that was the last time she was seen," Vannoy said.
MacDonald told police that he parked his car on the side of the pub, where he and Parish kissed for about 45 minutes. MacDonald said he then watched her walk into the pub. If that was the case, Vannoy said, Robertson would have seen MacDonald and Parish when she searched the lighted parking lot area about 15 minutes after the two arrived.
"I did ask him if they had sex, and he said, 'absolutely not'" Vannoy said.
Testing of semen found on Parish indicated that MacDonald was a possible contributor, with that specific profile linked to one in every 8,000 white males. Two others, including Parish's boyfriend, were excluded.
MacDonald told police that when he was pulling out of the bar about 1:40 a.m. he received a phone call from a male friend, who invited him to his Fairhope apartment.
"He did indicate that he had sex with (the man)," Vannoy said.
Phone records also indicate that MacDonald received the call from his Fairhope friend around 3:32 a.m. Cell tower records indicate that MacDonald was near the Bay House Pub at that time, and had driven several miles south by 3:48 a.m.
Police identified scratches on MacDonald's legs and knees and one on his buttocks.http://www.al.com/news/press-register/metro.ssf?/base/news/1233310589113870.xml&coll=3
