The Sun of Lowell reported that Miguel Diaz, 29, is scheduled to be arraigned Wednesday in Lowell District Court on a charge of assault and battery on a child causing serious bodily injury.

Police said Diaz was sleeping Tuesday morning while the baby's mother took another child to a bus stop, leaving him with alone with the crying infant. Diaz allegedly punched the baby in the head several times.

The child's mother noticed something was wrong and took him to the hospital.

The child was transferred to Boston Children's Hospital with serious injuries and is expected to survive.

...Police said Diaz was sleeping yesterday morning while the baby's mother took another child to a bus stop, leaving him with the baby for about 20 minutes. The baby was crying during that time, and Diaz punched the baby in the head two or three times, police said.

When the mother came home, she noticed something was wrong with the child and took him to the hospital. The mother is not facing charges.

The child suffered serious injuries but is expected to recover, police said. A hospital spokesman said he was listed in good condition last night. Police said the baby had just turned 3 months old on Monday.

Diaz was charged with assault and battery on a child causing substantial bodily injury about 9 p.m. A bail commissioner had not yet set bail on him last night. He was to be arraigned today in Lowell District Court.

If convicted, Diaz could face up to 15 years in prison.

Although the father initially gave police several false stories about what happened, a sobbing Diaz allegedly told police that he "lost his cool" and struck the crying baby several times, according to prosecutor Marisa Tagliareni.

At his Lowell District Court arraignment Wednesday, Diaz, of 14 Concord St., apt. 5, was ordered held on $10,000 cash bail after pleading innocent to a charge of assault and battery on a child with injury.

Tagliareni asked for $25,000 cash bail noting Diaz's 2000 conviction for assault with a dangerous weapon and 1998 convictions for stalking and threats.

A Lowell man has pleaded not guilty to punching his 3-month-old son in the head.

Police said 29-year-old Miguel Diaz hit his son several times Tuesday because the baby was crying while Diaz was trying to sleep. Diaz is charged with assault and battery on a child causing serious bodily injury.

Diaz was ordered held on $10,000 cash bail during his arraignment Wednesday in Lowell District Court. A judge also ordered him to have no contact with his son.

I went back and read the story again. looks like the web site might have got there facts mixed up. They have the baby at 5 months and other sites its 3 months. Not sure what is the correct facts ??? Maybe mom didn't have coke in her system, maybe she did.

The child's mother,

Sheena Buckley, 24, rushed the baby to Saints Medical Center in Lowell on Tuesday after she came home from dropping her oldest child at a school-bus stop and noticed the baby appeared to be having a seizure. She had been gone 20 minutes.

Tagliareni said Buckley returned home to see Diaz with his hand over the baby's mouth to muffle the child's cries.

"He was caught red-handed," the prosecutor said.

The child was transferred to Children's Hospital, where doctors determined he has a skull fracture and a possible bite mark on his left arm, Tagliareni said.

Diaz allegedly gave police several stories in which he claimed the baby had fallen from a baby swing, and then he said he dropped the baby.

"Miguel then broke down sobbing stating he had struck the baby in the head with his knuckles, two or three times," according to court documents. "He likened the blow to a rap on the door with his knuckles."

Diaz's next court date is Feb. 26.

Maybe the mom was going to leave this pieceofshit and was going to give the baby her name, (Buckley). My younger sister did this. Her then boyfriend loser, to this day is still pissed that their son, my nephew, does not have his last name or the first name he wanted.I I say, fuck off.
