An Omaha man charged with child abuse resulting in death is being held on $500,000 bail in connection with the death of his infant daughter.

Augustine Rubio, 28Tatina Riveria, 7 1/2 months old, was pronounced dead Friday night at Creighton University Medical Center.

Douglas County Attorney Don Kleine said her father, Augustine Rubio, 28, is responsible for the death. The infant died of severe head trauma, Kleine said.

Douglas County Judge Susan Bazis said today that Rubio must pay 10 percent of $500,000 - $50,000 - to be released from jail.

Kleine said Tatina died from severe head trauma. She was in Rubio's care when the injuries occurred, he said.

According to a police report, emergency personnel were called to 11115 R St. about 9 p.m. Wednesday and discovered that the child was not breathing. She was taken to Bergan Mercy Medical Center and then transferred to Creighton.

Rubio was arrested on suspicion of felony child abuse at 4 a.m. Thursday.

Kleine said Rubio faces 20 years to life in prison if convicted of the felony charge

Is he the stepfather? baby has a different last name....

I know there are a lot of wonderful men out there, (I have one), otherwise, we would have complete chaos....

Non of the articles I read say he was her boyfriend, just that he was a baysitter and not the bio-dad.


On the day of her death, Tatina Riveria appeared to have a cold but otherwise behaved like a typical 8-month-old.

But by 9 p.m., long after her 19-year-old mother had gone to night class and 28-year-old Augustine Rubio had taken over child-care duties, Tatina was unconscious and fighting for her life. Doctors later determined that Tatina died of injuries consistent with being shaken and thrown against a hard object.

Rubio, a Douglas County judge ruled Wednesday, will stand trial on a charge of felony child abuse resulting in death. If convicted, the Honduran native faces 20 years to life in prison.

Rubio is being held at the Douglas County Correctional Center on $500,000 bail. To be released before trial, he must pay 10 percent -- or $50,000.

Police testified that Tatina was home with her mother until 5:25 p.m., when Rubio arrived at their apartment, 11115 R Plaza.

A caseworker who visited earlier in the day told police the baby was happy, smiling and beginning to crawl backward. The baby's maternal grandmother later told police that when she stopped by about an hour after her daughter left, Tatina appeared groggy, possibly because of her cold, but smiled and otherwise seemed fine.

About 90 minutes after the grandmother left, Rubio ran to a neighboring apartment in a panic, asking to call 911.

He told authorities that he had given Tatina Tylenol for her cold, after which she had fallen unconscious, police testified. Police told him later that tests showed Tatina had suffered skull fractures.

At that point, police said, Rubio claimed that Tatina had fallen off the bed before he called 911. Officers at the scene found a mattress on the floor. They estimated that it was no more than 14 inches tall -- not high enough to cause the kind of injuries found in Tatina's brain and eyes, doctors told police.

Rubio's attorney argued that police had no evidence that Tatina had suffered her injuries while with his client, who initially was portrayed as the dad but is not Tatina's biological father.

Police, however, testified that doctors assured them that the baby would have been in grave condition soon after being harmed.
