A 44-year-old man described by police as a serial peeping Tom was ordered Thursday to stand trial for allegedly watching girls in their locker room at Brighton High School in October.
Brian Richard Lee hid behind a shower curtain -- possibly for several hours -- while scores of girls changed clothing, fixed their hair and practiced for a dance performance.
"It was shocking to see an older man in the girl's dressing room," according to the 16-year-old girl who initially spotted Lee crouching behind the curtain at about 5 p.m. on Oct. 29.
"I saw hands and feet," the girl testified during a 3rd District Court preliminary hearing.
When another girl pulled open the curtain, Lee arose, "pulling up his pants," and fled, the girl told Judge John Paul Kennedy.
The 17-year-old girl who pulled aside the curtain testified that as Lee stood he put a finger to his lips and said, "Shhhh."
She said she saw Lee "pull up his pants a little bit," but that his pants did not appear to be "undone."
The judge ordered Lee to stand trial on one count each of third-degree felony burglary and class B misdemeanor lewdness, and five counts of class B misdemeanor lewdness.
But defense attorney Rudy Bautista had argued there was no evidence Lee's pants had been down, and therefore no lewdness, which is the underlying crime supporting the burglary count.
Lee was caught by Cottonwood Heights police officers in the school parking
lot. Officer Barry Larsen testified a tube of petroleum jelly was later found in the pants pocket of Lee's sweat pants.
Larsen said Lee claimed he was watching the girls practice on stage, then ended up in the wrong locker room while attempting to find a restroom.
There were about 50 girls in the locker room when Lee was discovered. Some girls had arrived at the school as early as 2 p.m., and no one saw Lee arrive, meaning he could have been hiding there for several hours, according to testimony.
