A 20-year-old Hopkins man pleaded guilty Thursday to punching a friend's pregnant girlfriend in the midsection, leading to the unborn baby's death, in exchange for money.

In exchange for admitting in Hennepin County District Court to second-degree murder and first-degree assault, Paul A. Petersen agreed to testify against his friend and fellow defendant, Dameon Gatson.

Gatson, 24, and Petersen were charged last year in the attack on Shyloe Linde in her St. Louis Park apartment in April 2007. Gatson remains in the county jail, his next court appearance scheduled for Jan. 5. Petersen, also jailed, awaits sentencing.

Petersen knocked on Linde's door, and when the woman, who was six months pregnant with Gatson's child, answered the door, Petersen punched her two or three times in the abdomen, according to the charges. She went into labor; the baby girl weighed less than 2 pounds at birth and had significant health problems, including bleeding on the brain. She died May 1, 2007.

Petersen told police that Gatson offered him $200 to cause Linde to miscarry and that Gatson told him he feared she was cheating on him and that he didn't want another baby.
Petersen noted that Gatson gave him $40 after the assault.

Police say after an emergency c-section, the victim gave birth. The baby would survive 9 days before she was taken off life support. Police say the victim, the mother that lost her baby, named the child Destiny.

The plan worked, and the baby died. Now, Gatson and his roommate are charged with murder. "This began with a young man learning the inconvenient truth that he was about to be a father," Police Chief John Luse said.

The woman, who has another child with a different man, was recovering at home Wednesday while Gatson and Petersen were being held at the Hennepin County Jail.


The mother of the child asked a police officer to be with her when the child died and officer who was with her said he was humbled.

"We say this is a thankless job and one of the best calls I have gotten in my entire 15 years with this department is when the victim asked me to be present when they removed the baby from life support," said St. Louis Park Police Officer Mike Merwin.

According to a criminal complaint, Petersen and Gatson were driving around the night of the assault, smoking pot and getting drunk.

The teen, who told investigators that Gatson paid him $40 after the attack, said he only pushed the woman after she "disrespected him." However, the pregnant woman and her friend both said she was punched, and they picked Petersen out of a police lineup.

Meanwhile, Gatson allegedly concocted a story the night of the assault so that his girlfriend would think he was in St. Louis, Mo., for a funeral. He even called her shortly before the assault, acting as if he was just checking in, Merwin said.

Later, he admitted he hadn't gone to St. Louis. Rather, he said that after picking up Petersen he drove to the apartment complex and sent Petersen up to the apartment, but only to find out whether his girlfriend was cheating on him. Luse said Gatson is laying the blame for the baby's death on Petersen.

Police say a witness at a nearby gas station tells them she saw Gatson inside the store at the time of the alleged assault, Gatson told police he was at a funeral in Missouri.

The same witness says she saw a man in a blue sweatshirt run towards Gatson?s car in the parking lot. The victim told police, her attacker was wearing a blue sweatshirt. Police say Petersen was the man wearing the blue sweatshirt.

Supporters of convicted killer Dameon Gatson wept Friday morning and stormed out of court, slamming a door before Hennepin County District Judge Daniel Moreno could finish reading the third guilty verdict against the 25-year-old Hopkins man.

Moreno had warned several people in the gallery to refrain from making "hoots or hollers," but Gatson's younger brother, Cashmir Smith, couldn't control his emotions as the jury convicted Gatson of hiring a friend in 2007 to punch his pregnant girlfriend to kill her fetus.

Gatson showed no emotion as he was convicted of first- and second-degree murder and first-degree assault.

But Gatson's fiancée, Jackie Morris, collapsed outside the courtroom, sitting on the floor and crying with her head on a bench. His supporters were too distraught to talk after the verdict, but they said earlier in the week that he is innocent.

Prosecutors said their case was dealt a severe blow when Petersen refused to testify earlier this week. Prosecutors contended that Gatson had threatened Petersen to keep him from testifying. But Gatson's attorney, Emmett Donnelly, denied the allegation, saying that his case was harmed when Petersen didn't testify because the defense "couldn't cross-examine him and expose his lies."

Donnelly said he will seek a new trial for Gatson "so a jury can hear all the evidence."

The defense's strategy appeared to center on the idea that Destiny's death was precipitated by the removal of life support and not Gatson's actions. Sweasy attacked that strategy in her closing argument, noting that if not for Gatson's "absolutely crazy plot," Destiny wouldn't have needed life support.

"You can't blame the doctors that Destiny died," Sweasy said. "You can't blame Shyloe for discontinuing life support. ... It is an out-and-out absurdity, such an argument that it was a failing of medical science."

Donnelly said Gatson is deeply saddened by the verdict and "absolutely denies" any involvement in harming his child.

He faces life in prison for the first-degree murder conviction alone. Sentencing is set for Nov. 10.
