It's fourth-degree sexual assault.
According to the petition filed in July by Williams, here's what happened:
Two girls at Steffen Middle School in Mequon told officials June 6, a Friday, that the boy, 13 years old at the time, during class had grabbed the buttocks of one girl, 14, and unhooked the bra of the other girl, 13.
Under questioning by police, officials learned of other unreported incidents going back to October 2007, when the boy was 12, when he grabbed other girls' buttocks or their breasts, licked a girl's neck and tickled another girl in the stomach, according to the petition
This kid's parents wanted him to go to the police station so he could man up to what he did. They sent him to a boot camp for troubled teens for two months. They definitely do seem like the type of parents to laugh this behavior off and say "boys will be boys."
Mequon police Capt. Dan Buntrock, who recommended the charges to Williams, said the charges are appropriate for the behavior.
"If someone touches someone sexually in a bar, is that fourth-degree sexual assault? Yes," he said. "It doesn't really matter where it occurs. And when the victim is of a certain age, it's even more serious."
I doubt that even 0.01 percent of butt-grabbing that goes on in bars results in any kind of court activity. To Buntrock's second point, this was a 13 year old touching other 13 year olds. I hope that a 13 year old touching 7 year olds would result in more serious charges than this boy is facing, but for some reason I doubt it. This has "Treat a less-serious crime in the same manner you would treat a more-serious crime because rules are rules" written all over it.
State law says fourth-degree sexual assault occurs when someone intentionally touches another person to gratify himself sexually, or sexually degrades or humiliates that person.
Essentially, the boy's defense breaks down to, "He didn't touch those butts or snap those bras in order to gratify himself or humiliate the other party. He's just an immature dumbass." I tend to agree. I don't think he should go unpunished. Two months of boot camp was more than appropriate. I could see charging him with disorderly conduct and giving him a ticket he has to pay off, suspending him from school and grounding him. Charging this kid with five counts of sexual assault and possible sex-offender registration is ridiculous.
