MURRIETA — A man accused of raping a 63-year-old woman twice and trying to do the same to a 74-year-old woman, who died of head injuries she suffered in the assault, must stand trial on murder, rape and burglary charges, a judge ruled Friday.
Riverside County Superior Court Judge F. Paul Dickerson determined there was enough evidence to order 22-year-old Kenneth Daniels Jr. of San Jacinto to stand trial on charges that could result in the death penalty.
The defendant is charged with murder and a special circumstance allegation that the killing occurred during the commission of a rape.
He is also accused of inflicting great bodily injury on an elderly person, resisting arrest, forced oral copulation and attempted rape, and could be charged with being a sex offender who committed a burglary and committing a sex offense during a burglary.
Dickerson dismissed one count each of causing great bodily injury or death to an elderly person and attempted burglary, as well as allegations of committing great bodily injury on an elder under 70 years old and using a firearm.
The attacks happened at Oak Terrace Apartments, a complex for residents 55 and older.
The murder charge stems from the death of 74-year-old Rosemarie Edwin, a wheelchair user who was attacked Dec. 11. Edwin suffered head injuries and died at the scene.
