MARTINEZ — State authorities charged a Contra Costa County sex crimes prosecutor with 12 felony counts Friday, claiming he raped and sodomized a fellow deputy district attorney at his Martinez home in early May, tying and binding her and using a handgun and an ice pick.
Michael Gressett, a 21-year veteran of the county district attorney's office, pleaded not guilty Friday morning and then proclaimed his innocence outside the same courthouse where he tried cases before his Oct. 2 arrest. His lawyer says the sex, if rough, was consensual.
"I can say it's been very difficult after all these years of prosecuting the bad guys," Gressett said. "The truth will come out ... I stand in the shadows of fear in a false accusation. I know the accuser knows they are not true."
Gressett remains free on $1 million bail and is scheduled to return to court Jan. 27. His accuser is identified in court papers only as "Jane Doe." Contra Costa Superior Court Judge Charles Treat ordered them to stay away from each other.
The charges include four counts of sodomy by force, three counts of forced sexual penetration, two counts of forcible rape, and single counts of oral copulation by force and false imprisonment. In the last charge, state prosecutors claim Gressett threatened a crime "which would result in death and great bodily injury to Jane Doe, with the specific intent that the statement be taken as a threat."
That threat, the charge states, "was so unequivocal, unconditional, immediate and specific as to convey to Jane Doe a gravity of purpose and an immediate prospect of execution."
Deputy Attorney General Peter Flores said the charges stem from "multiple acts on the same day." Police say they took place May 8 at Gressett's home on Village Place in Martinez and that they were notified of the allegations through the district attorney's office on Sept. 26. The judge has sealed information from a search of the home.
If convicted, Gressett, 51, could face a nearly 23-year prison sentence, although with the enhancements he could also face life, Flores said. Among them, Gressett is accused of using a handgun in 10 of the counts against him. He is accused of using the ice pick in three counts, including forcible rape and forced oral copulation. According to the charges, Gressett used both a handgun and an ice pick when he falsely imprisoned Jane Doe "by force, menace, fraud and deceit ..."

Wait. It happened on May 8th and not reported until September 26th? Why the almost 5 month delay? I mean, she could have been terrified, who wouldn't be? But still, that's a long time................

I don't think he would last long in Cell Block D. They won't put him in with general population.

Its still to hard to tell if this guy is being set up or guilty. Way to long a time period went by before it was revealed and a coworker?? and you let them go? and you used a gun and a freakin ice pict? Sounds pretty hookey to me.
I am sure there was a relationship between the 2 of them though and it might have been on the consentual ruff side.
What ever way it goes his life will be trashed and stained forever.
Not saying he isnt guilty , just that its to much like a set up so far.

I think that's kinda the point here once someone's been charged. Sorta what we do.
If the charges get dropped then we do the "mea culpa" thing.

Hey if people think hes guilty , flay away , I always say.

and child porn. He was an obvious pedo. So far this ones still got a Hmmmm to it for me. Its to Michael Douglas & Glenn Close "Fatal Attraction" to me so far. I want to know who the person is not no stinkin Jane friggin Doe.

Note that the police were notified THROUGH THE DA's OFFICE. Sounds to me like maybe it was reported to the employer and they might have investigated prior to bringing cops in just in case it was a scorned lover seeking revenge.
I could see the top DA wanting to make sure it was a legit complaint before wrecking the career of a veteran prosecutor. That and making sure he had to cases in process that could have been compromised by the charges.
There may have even been cooperation by the victim in the above. We really don't know if state authorities knew about it long before local police were notified.
It kind of stands to reason that an employee of the DA's office would know to report offenses inside their own office to the state level.
That may explain the time differences noted in the story.

While I appreciate your point, I'm guessing they must have something special up their sleeve to charge one of their own.
This is going to be an interesting one to keep an eye on.

Let me elaborate on my point a bit. None of us know for sure if he raped the woman or not, and in a just world where nobody lied, we'd be able to say for 100% certainty that he did it, because women wouldn't lie about something so horrible. However, that's not a world we live in and women lie about being raped (for various reasons), and as some of you have noted, there is just cause for speculation that she has her own motivations beyond seeking justice for this.
However, there is also a valid point about the prosecutors going after another prosecutor. I always try to be just in my judgments, it's kinda silly to call someone a rapist and hoping they get raped themselves if, you know, they haven't raped anyone.

I'm just saying that using your logic the same can be applied to most any case presented here. Just because I said I saw Joe stab Henry and Joe is charged may mean I lied or told the truth. In any case, until otherwise shown, I believe the charges to be valid.

I totally get what you're saying, but in the majority of the other cases, their is more evidence to back up the charges, therefore making them more valid.

And this is not a court room. This is a site that simply takes available published information and shames the scumbags at will.
In a court of law, reasonable doubt is the standard. Here, just looking like a scumbag is usually enough. One might say that DD is the polar opposite of a court room in that for an accused to find sympathy here, they best come to the table with some evidence of their innocence.
Here you'll find that reasonable assumptions are made quite often and are rarely found to be incorrect. You will find one or two instances where those assumptions have been found to be wrong, along with retractions acknowledging same, but only one or two that I am aware of.
As for the article stating the scumbag is accused of rape and does not state that he did in fact rape. Charges are always an accusation and not a definitive statement of fact. That comes later in the trial. Again, this is not a court room.
This particular story does rise to a higher standard than most reported here. I find it rare that LEOs or DAs turn on one of their own without some pretty stiff evidence. That alone cause me to be more inclined to believe the charges are true. Given the time frame noted in the story, I'm also inclined to believe more than one investigator has been over these accusations prior to charges being filed against a long time prosicutor.

Ok, I get the charges now, I thought the sodomy part was anal sex, but there was talk of "penetration with a foreign object".
It looks to me like what they are saying is Gressett was having an affair ( relationship ) with Jane Doe. Then during one of the sexual encounters, she agreed to be tied up and Gressett got out of hand and used his gun? as a uhh uhh sex toy, oraly and analy. While saying threatining things.

Gressett adamantly denied the allegations after Friday's court hearing, and his lawyer says Gressett and his accuser had a romantic relationship.
The charges, which were filed Friday in Martinez, include two counts rape, four counts sodomy, three counts forced sexual penetration, one count forced oral copulation, one count false imprisonment and one count of making criminal threats for allegedly threatening to kill the alleged victim, according to the complaint.
Gressett, 51, also faces multiple enhancements for allegedly tying up the alleged victim and using a handgun and an ice pick during the alleged assault. If convicted, Gressett could face a life sentence, Deputy Attorney General Peter Flores said. Because Gressett is a county prosecutor, the state attorney general’s office was prosecuting the case. “As firmly and uncategorically as anyone has ever entered a not guilty plea, we enter a not guilty plea,” Gressett’s attorney Michael Cardoza said in court.
If convicted, Gressett, 51, could face a nearly 23-year prison sentence, although with the enhancements he could also face life, Flores said. Gressett's attorney, Michael Cardoza, insisted that his client and Jane Doe were in a romantic relationship and called it "a he-said, she-said" kind of case. He denied that Gressett ever threatened the woman's life and said her actions later, including going back to work and not reporting it to police, made it implausible.
"This is as creative a fantasy as one can get, what this woman has conjured up," he said.
Cardoza lamented the delay, saying evidence that could prove Gressett's account, such as the contents of text messages, has long since disappeared.
"He didn't do anything to force sex upon that woman — anything at all," said Cardoza. "Unfortunately, it's going to air and hurt a lot of people. A lot that went on in that office, politically, is going to be aired." Cardoza said the investigation, with participation from the district attorney's office, "smacks of politics at a very deep level."
Asked whether Gressett denies using a handgun and an ice pick, Cardoza said, "Absolutely. Not in the way she is saying."

I object to the title of this thread. It says the accused "likes to use an ice pick."
Now, I don't think we have any evidence of that. It could be that he likes to use a flamethrower or a scalpel but didn't have one available.
