Sarah Sue Hawk arrested in cold case death of newborn

The mother of "Baby Mary," a newborn found in a backpack in a Fayette County creek by two fishermen in 2000, was charged Friday with criminal homicide and concealing the death of a child after a DNA analysis linked her to the child.

Sarah Sue Hawk, 25, of 202 Woodview Terrace, North Union, was arraigned last night and is being held without bond in the Fayette County Prison.

State police, District Attorney Nancy Vernon and Coroner Phillip Reilly have scheduled a news conference for noon Tuesday. A preliminary hearing is set for Wednesday before District Judge Wendy Dennis.

In a news release, Trooper James Pierce said tests by the New Jersey State Police Mitochondrial DNA Laboratory and Marshall University Forensic Science Center determined Hawk was the biological mother of the girl, found on June 4, 2000, in Cove Run Creek in North Union.

"It took a while for the technology to evolve," Vernon said last night. "The police never stopped looking and searching and researching and investigating."

Asked if Hawk implicated herself during interviews with authorities, Vernon said: "Obviously, she has, or we wouldn't have filed." Reilly declined to comment until the news conference.

Eeek, that was a big ole skeleton in her closet. That was damn sneeky how they caught her ass. The town had collected a bunch of DNA samples over the years and never got a hit. Then some one notices Sarah Sue was a suspect but there was no DNA sample. They got her sister to give a DNA, because she had nothing to hide it wasnt hers. She had no problums with it. Opps her bad it was a relitive DNA match. Busted.

I dont know how there going to get any kind of murder charge on her. They couldnt figure out how the poor little thing died. Looks like Sarah was only 16 at the time and hid it from everyone.


Eight years ago, he ruled the girl's death a homicide after an autopsy showed she was 8 to 8 1/2 months' gestation when born. The body of the child, whom the coroner named "Baby Mary," was so badly decomposed that investigators could not determine the cause of death.

From the day a dead newborn baby was found in a Fayette County creek more than eight years ago, police operated on a theory: A local girl likely was her mother and a likely suspect.

Trooper Pierce said that over the years, police had gotten DNA samples from various young females living near where the baby was found in Cove Run Creek

Ms. Hawk was among those initially interviewed after the newborn's body was discovered. "She said at the time she wasn't pregnant. The investigators back then, they were pursuing other suspects," Trooper Pierce said.

Then last year, he started reviewing the list of girls who lived in the area. "I discovered that she was never looked at," he said of Ms. Hawk.

The trooper contacted one of Ms. Hawk's four sisters, who voluntarily gave her DNA sample. State police then sent the sample to the New Jersey State Police Mitochondrial DNA Laboratory for analysis.

"It came back a hit," said Trooper Pierce, explaining that the results showed the baby was a relative of the woman.

"From there, I got search warrants (to gather DNA) for all five sisters, including Sarah."


Mr. Pierce said Ms. Hawk was 16 at the time the baby was born and had hid her pregnancy from her family and friends.

State police filed homicide charges Wednesday against an Adah man accused of killing a newborn baby in 2000.

State police Trooper James A. Pierce said Warren Ernest Bircher, 33, of 560 Palmer Road was charged before Magisterial District Judge Wendy D. Dennis with criminal homicide, two counts of criminal conspiracy to commit homicide and concealing the death of a child.

The infant's mother, Sarah Sue Hawk, 25, of 202 Woodview Terrace, North Union Township, also was charged with homicide late last year and is scheduled for a preliminary hearing next week.

Police received information in June about Bircher's potential involvement in the case from an informant in the Fayette County Prison.

Pierce said the informant told police that he was at a party in a wooded area called "The Moon" off Braddock Road a few months prior to the discovery of the baby's body in the creek.

Pierce said the informant told police that Bircher, who was married to Hawk's sister, allegedly told him at the party that he got someone pregnant and Bircher intended to "get rid of the kid."

Pierce said the informant told police that Bircher allegedly said he was "going to put the child in a bag and drown it just like he does his animals."

Hawk told Pierce that she realized that she was pregnant and told Bircher that she was pregnant to a "black boy."

Pierce said that Hawk told investigators that Bircher, fearing the child might be his, allegedly told her not to worry about it and that he intended to put the baby in the creek.

"Hawk stated that Bircher told her that the baby could not be born because if it was a black baby her father would not accept it and if is was his child, his wife would hate him," Pierce stated in the criminal complaint filed against Bircher.

Hawk told Pierce that more than a month later she was at her sister's home watching television while Bircher was drinking.

Pierce said that Hawk told police that she and Bircher had sex after her sister went to bed.

However, while engaged in intercourse, Hawk told police that her stomach started to hurt and she eventually went and sat outside where Bircher came to check on her and told her he thought she was in labor, Pierce said.

"Hawk stated that she laid down on the ground and the pain got worse and the baby came out," Pierce said.

He said that Hawk told police that Bircher allegedly then went inside the house and retrieved plastic bags and a backpack.

Pierce said Hawk told investigators that Bircher allegedly put the baby in the bags and she started to cry.

Bircher allegedly told her not to worry "because she didn't want the baby anyway in case it was black," Pierce said.

Bircher then allegedly put the baby into the creek.
