Jose Leyva-Estrada, who goes by several aliases, including Erik Torres, strangled and bit Veronica Nunez, his then girlfriend on March 6.
"Victim Veronica Nunez' right eye was completely swollen shut and was still actively bleeding," an Evans police officer said in a warrantless arrest affidavit.
"I observed what appeared to be bite marks on the top of her upper right eyelid just under her eyebrow," the affidavit said.
Leyva-Estrada had no known criminal history, but the judge heard evidence of prior conduct, including allegations that he had earlier been violent with the victim, and that he had attempted to kill another former girlfriend.
Senior Judge Jane Tidball sentenced Layva-Estrada to 13 years for first-degree assault, and seven years in the Department of Corrections for second-degree assault. The sentences will run consecutively.
Following Leyva-Estrada's sentence, Weld County District Attorney Michael J. Rourke stated: "Domestic violence crimes are far more prevalent than many realize, so when a victim is able to step forward and give us the ability to prosecute these abusers, we do so knowing we are not only protecting that specific victim, but future victims as well," Weld County District Attorney Michael J. Rourke.

During her interview with police, Nunez said she and Leyva-Estrada, also known as Erick Torres, had a fight when she woke him up from a nap about 5 p.m. to tell him she was leaving to pick up her kids. Leyva-Estrada jumped out of bed, grabbed Nunez by the hair and threw her to the ground, reports stated. He then climbed on top of her and choked Nunez with his hands.
Nunez was able to escape the initial attack by punching Leyva-Estrada in the groin, records stated, but he grabbed hold of Nunez’s hair again, threw her to the bed and bit her right eye.
One of Nunez’s sons was able to enter the bedroom during the attack, at which point Leyva-Estrada ran out of the apartment and fled to Denver. He was arrested the next day by Denver police and returned to Evans.
Leyva-Estrada told police Nunez attacked him with a knife after she found a text message from another woman on his cell phone, records stated. However, he could not explain the choke marks and denied biting Nunez’s eye.
A roommate, Francisco Morales, did not witness the attack but told police he had to stop Leyva-Estrada from hitting Nunez on several occasions in the past.
Nunez was admitted to North Colorado Medical Center the day after the attack and underwent surgery to repair her eyelid, records stated.
