I just can't believe they never checked the crawl space when he first went missing. Daniel reminds me of Trenton Duckett.

From what I remember at the time, the whole property was thoroughly searched...I remember seeing police and cadaver dogs on the news when this story first broke years ago. Police are speculating that perhaps Daniel was moved under the house later, as a decomposed nappy and a t-shirt that I think was identified as his was found in bushland a while ago. Perhaps he was dumped in the bush first and then moved back to the house later after the immediate focus went off the case. Personally I think the babysitter was planning on making it look like someone came into the house and killed Daniel while she was at the doctor's appointment with her own children and that he was always under the house. Trouble was, they found the nappy and tshirt first, before they found the baby's body.

I'm pretty interested in this case, as Donna is a distant relative of my husband, so when I hear anything new, I'll update it.

POLICE brief on the death of Myrtleford toddler Daniel Thomas is expected to go to the coroner within months.

Victoria Police say the eight-year investigation remains a high priority.

A spokeswoman for the Victorian Coroners Court yesterday confirmed the inquest would also take priority.

Police media’s acting Sen-Sgt Jo Stafford said they hoped to submit the brief in June-July.

“We are continuing to prepare the inquest brief and aspects of the investigation require specialist review,â€￾ she said.

“This is necessary to provide the coroner with the most thorough understanding of what happened to Daniel Thomas.

“Once complete, the brief will be sent to the coroner, before an inquest date is set.

“Victoria Police is confident this process will be completed by mid-year.

“Police understand the frustration the investigation would create for the family, and can ensure the investigation it is a high priority.â€￾

Daniel Thomas would have turned 11 this week.

He disappeared from his home in October, 2003 while being looked after by family friend Mandy Martyn.

His fate was a mystery until dogs dug up his bones in March 2008 at a house his mother, Donna Thomas, once rented.

In 2009, the family was told an inquest was likely to be delayed by the huge workload generated by the Black Saturday fires and almost two years ago, homicide detectives handed their evidence to the Office of Public Prosecutions.

But in July 2010, prosecutors decided there was not enough evidence to lay charges.


Member for Benambra Bill Tilley said he was frustrated with the delays but confident police had not “dropped the ballâ€￾.

“It is fair to say that we are all frustrated by the delays,â€￾ he said.

“But the coroners court has been inundated with matters related to the Black Saturday fire, while there are several matters in the Daniel Thomas case that I understand have also delayed finalising the brief.

“I’m confident police have never dropped the ball in the bid to find who murdered Daniel

One of Victoria's most frustrating unsolved cases was dealt a bitter blow with the homicide squad told they do not have enough evidence to charge anyone over the death of toddler Daniel Thomas.

The Office of Public Prosecutions advised detectives on Friday that the evidence was insufficient to lay charges based on a new murder brief submitted by investigators last November.

The new brief was compiled after a coroner found in July that babysitter Mandy Martyn inflicted the injuries that led to the Myrtleford toddler's death 11 years ago and ruled that his mother, Donna Thomas, contributed through her failure to protect her son.

"The investigation remains open and anyone with further information is encouraged to contact Crime Stoppers," a Victoria Police spokeswoman said in a statement on Sunday.

The only photos I found of this child are in infancy. (Mind you I did not look all THAT hard) however I PHOTOGRAPH my kids continuously. If my "baby" is missing I have a photo a week old at the OLDEST! What am I missing?

The coroner concluded Daniel was murdered because of statements given by the mothers
(Donna Thomas) boyfriend (Colin Bilney) via her own admissions to him in the years after.

Ms Thomas then told him she helped tie her son to the bed slats before grabbing a towel to wipe up the blood in the bathroom.

On the Wednesday morning Ms Thomas went into the bedroom where Daniel was to get her school bag and books for a nursing course in Shepparton, but didn't check on him, the court heard.

"She never saw Daniel again.

"All I can say, Donna is adamant now, is Daniel was dead on the night of Monday the 13th of October, 2003."

Mr Bilney said Ms Thomas began revealing information to him in early 2004, and he had reported it to police in July 2007. "I'm just sick of carrying this burden around," he said in his statement.

Not many camera phones around in 2003. Most people still used regular film cameras. If the boy wasnt the first born there would be a lot less photos of him as he was growing.

My daughter was born in 98 I did not even own a camera. I had to get the disposable kind for her birth until she was about 4 and I have bins upon bins of photos of her in my my garage (I have them on disc now as well and it cost me a pretty penny. You drop them off and kinkos and they do their thing) I was born in 78 and I have probably a good 20 albums of me which is impressive since we had a house fire when I was 6 and that's all my dad could carry as he ran out.

No excuse.

Isn't it ironic that she was in nursing school and yet did nothing for her child... Well, not nothing, she helped tie I'm to his bed after he got his head bashed in.

Your parents must have had money and extra time for that. I was the first child born in 74. I have probably 20 to 30 pictures from newborn to 5 years old. My younger siblings maybe 5 to 10 pictures. After that school pictures only. My first child was born in 2005, she has tons of pics. Until I had a second and had to take care of two little ones, pictures not so important as making sure they stay alive and healthy.

Anything is possible with time and money.
