A student at Red Mountain High School in Mesa is facing dozens of criminal charges for indecent exposure after a prank got published in the yearbook, according to the Mesa Police Department.

The student exposed himself in the varsity football team picture, Det. Steve Berry said. Approximately 3,400 students received a yearbook with the image before it was brought to the attention of school officials. The photo was also used in the football program, which was sold at numerous games to students and families, according to court paperwork.

Berry said police were made aware of the picture on Saturday. The student, 19-year-old Hunter Osborn, was contacted and interviewed about the picture.

Osborn, who was 18 when the picture was taken, told investigators he was dared to reveal his privates by a football teammate and said he was "disgusted" with himself, according to court paperwork.

The photo of the Red Mountain High School varsity football team was taken while players and coaches were on the football field bleachers.

There were 69 students, ranging in age from 15 to 19, and 10 faculty members present when the picture was taken. Police said Osborn knowingly exposed the top of his penis through the top of the waistband of his football uniform pants during the photo session.

Based on the photo and admission, Osborn was booked for 69 counts of indecent exposure -- a class 1 misdemeanor -- and one count of furnishing harmful items to minors -- a class 4 felony.

That number, however, could change.

"It is still an ongoing investigation," Berry said. "The number of charges may go up or down depending upon how the investigation continues."

If individuals in the photo are older than 18 and do not wish to press charges, the number of criminal counts could be reduced.

Osborn was released on his recognizance after being fitted with an electronic monitor.

What a fucking idiot.
Dude in this day and age this shit will stick with you forever.
Good luck fucker. I'd kill my kid. Resurrect him then murder him again.

This is a much different world than what we grew up in- he will likely now be a registered sex offender for the rest of his life. Kids these days just don't fucking think. I told my daughter who ended up with her topless selfie and phone number on Facebook for about two minutes - those are things mommy & daddy can NEVER fix - lets hope YOU don't get arrest and go to jail for child pornography! :shifty:

This made me chuckle. Kid was probably thinking that day, "Ha ha, it's gonna be my little secret!" and then, flash-forward to the mug shot.

Just makes me laugh.

But the one laughing most of all? The other kid who dared him to do it. HA HA HA

Damn, people. It's only a penis head. And probably a real little one.

I'd have just taken that page out, ffs. No doubt the school was humiliated after it was used in game programs and such but why not just give him a monetary penalty instead. I think that would be more appropriate than jail (although he'll get probation).

This is just unbelievable. Sure, what he did was stupid. The fact that it made it into a published yearbook AND a promotional flyer for the football team is just mind-boggling.

But charging him to this extent? It's just the tip of a goddamn penis, and he clearly didn't do it for sexual gratification...

I hope this doesn't ruin his life. And I really wish we'd pull the proverbial stick out of our ass regarding sexual organs.

Seriously - with all due respect - I bet money someone had to point it out and EXPLAIN what they were looking at! It's a fucking yearbook picture - not exactly zoomed in on individuals!?

But charging him to this extent? It's just the tip of a goddamn penis, and he clearly didn't do it for sexual gratification...

Is rape ever really about sex? Indecent exposure is what it is...indecent exposure. I would be concerned as all fuck if my sons did something like this...had his dick out anywhere except his girlfriends bed...his bed...a toilet or a change room...or his job required it because porn star. I would assume that if my kid thought this was funny then his thinking was skewed. If he did it because a friend egged him on I would think that my child was pretty weak ass, and I would think it because it would be TRUE. I would be begging the judge to punish him...and I would punish him at home.

Is rape ever really about sex?

SIGH. I hate the people - whoever they may be - who spray painted the entire laymen psyche with "Rape is about control!"

No. Rape is about sex. It is sometimes also about control. It is sometimes also about sadism. It is sometimes also about revenge. But it is always about sex. Sexual gratification is always a factor. Or rapists would pick an easier way to control or torture or get back at someone. To say rape is not about sex is like saying robbery is never about greed. Nope, it's always about greed. It's just sometimes motivated by some other stuff on top of that.

An excerpt from a very well-written essay on the subject:

...our culture is unable to address rape with the sobriety and clarity the topic deserves because we are still unable to address sex with the sobriety and clarity it deserves. The contention that rape should be regarded as an asexual act has done nothing to remedy this. Nor will it. As activist and writer Wendy McElroy points out, "there can be as many motives for rape as there are for murder and other violent crimes … Rape is every bit as complex." Insisting that no rape is ever "about" sex but is rather about an individual man acting on a patriarchal mandate to sow terror by exercising "power" does a disservice to us all.

Yes, indecent exposure is what it is, and it is only illegal because of the delicate sensibilities of individuals in the U.S. Many countries don't have indecent exposure laws. And, you know what? In those countries, little boys aren't sticking their pee pees out in pictures to give people something to giggle about... because people would just yawn.

If those are your values, you are free to punish your child as you see fit. But a harmless prank should not be getting dealt with by the criminal justice system.

We had to develope our nudes at walmart and look the person behind the counter in the eye. I specifically remember having the conversation with my then boyfriend "no penetration or erections or we'll get arrested." :nailbiting::angelic:
Yup, I remember that! And my "good" photos were always omitted. Dammit. Slightly embarrassing but, hey, we wanted those pics!

If those are your values, you are free to punish your child as you see fit. But a harmless prank should not be getting dealt with by the criminal justice system.

I think they kind of HAVE to, they've (maybe not this police department but certainly others) already set precedents charging minors with child porn for sharing their own pics, disseminating them to other minors, etc.

This guy's dick just got distributed to 3,400 students, most of whom are under 18.

Dumb prank it was, and if I were a parent OR a student who purchased a yearbook and got this, I wouldn't be scarred or out for blood, but a lot of people would be. There have to be some consequences.

What else could you even do? Suspend the guy who's already 18 and at the tailend of the school year already?

I think they kind of HAVE to...

I think you'd be surprised by the number of perfectly legitimate cases DAs turn down every year. They frequently just decide not to pursue a case. Not super frequently, mind you, because DAs like wins more than decency, but it happens fairly often. :p

No, they don't have to. I understand what you're getting at - there's a mob of parents who want blood.

And this is why indecent exposure laws should be taken off the books entirely. So that parents eventually realize this isn't something to want blood over. I mean, take a moment to consider how easily you said, "there have to be consequences."

Does there? Why? I'm not being a snot, I swear. I just think it's a beneficial exercise to examine the value of things programmed into you (I'm programmed just like everyone else, so I perform this exercise regularly).

Anyway...my kid would be in big fucking trouble...Like if the whole class as a society had their dicks out I might let it slide...but that's not what happened here. What happened here is in fact a crime. I'm pretty wide with my sexual perimeters, but as a parent this would be unacceptable to me. I would punish my child by helping them find the Toll...My kid: You're not taking my car away? Us: (laughing) Fuck no...how would you get to work? You owe us five grand for this stupid ass lawyer...say good bye to summer...leaves kid with his head in his hands to figure out what the cost of this stupid prank really was. Yes...pretty sure that would be us.

So I looked at the offending picture and I looked again and I embiggened the photo up to 250 %, I couldn't see anything. what I could see looked as if it was the numbers on the sleeve of the jersey in front of him. Maybe it was fuzzed out, but it didn't look all blurry. So I see why it kept being passed by and published so many times. It really wasn't big enough to even see and only the people who knew it was there could see it.

I cannot think of a way they can prosecute him. If they do, it's the legal system run amok. So every picture I've ever taken, or anyone else has ever taken with or without my knowledge with the possibility of my Dick being in it make me a criminal? This is fucked up beyond fucked up

Does there? Why?

I totally get where you're coming from, and I personally haven't had many instances where I've felt personally threatened, or unsafe.... and from what I've read of your posts I think you may be the same in that respect. You're a big, imposing female and you don't exactly scream "I present like a perfect victim" as you move through the world - lol.

But fuck, look at how many assholes ALREADY openly expose themselves, or masturbate in public, even to the point of hitting unsuspecting folks with their bodily fluids... And that's with indecent exposure laws on the books and enforced!

I don't know that our current society can be trusted to govern itself appropriately in this respect, if we just struck down those laws today.

Is that depressing? Fuck yes. But it's how I feel. I'd hate for kids (or anyone really) to have to live in a world where they're constantly subjected to some perv's nasty dick on the subway every night, just trying to get home.

He looks pretty darned proud of himself in the photo (although I couldn't make out any peen of any kind) and I'm sure the two guys in front of him were in on it - or else they'd not have parted the way for his peen shot!

I'd rather give the fucker a year's weekend worth of community service at a domestic violence shelter or something else unpleasant.
Seriously just fuck up his fun times for a bit for ruining everyone else's and I'm sure he'd get the picture.
I definitely do not feel as if he should be labelled a sex offender for a juvenile prank that would have garnered nothing more than smack upside the head 20yrs ago. Ok maybe more than a smack upside the head but still ya know...times have changed but not for the better.
I agree with everything the mom said except the criminal charges coz let's face it who wants their kid labelled a RSO the rest of their lives for a tremendously stupid decision made at an age where stupid decisions are the daily norm?

But fuck, look at how many assholes ALREADY openly expose themselves, or masturbate in public, even to the point of hitting unsuspecting folks with their bodily fluids... And that's with indecent exposure laws on the books and enforced!

Yeah, and I'd be good keeping laws on the books that deal with those motivated by sexual gratification or a desire to victimize.

But, if a law won't differentiate between a harmless prank and a sick behavior, it's useless. I'd rather have people dealing with having to see the occasional nasty dick on the subway than a graduating senior's entire future stunted because 1" of his penis was visible in a picture if you had a magnifying glass handy.

I definitely see the current version as the scarier of the two worlds.

Thank you. Thats more than just the tip. Its the shaft too.

A year book is something to cherish for ones life. Who wants to pay $150.00 and then find some ass hole sticking is dick out.

This kids an ass hole and deserves what ever punishment is handed out.

Not only is he an ass hole, He's a weak mindless shit head because he said he did it because a friend dared him.

I'm not seeing it either. And I know what a penis looks like. Of course, mine is pretty huge so it may look different than a normal peen. I mean, I have to walk around hooked up to a bottle of blood so I don't faint when it gets hard.

But really...how in the fuck did anybody ever notice this in the first place?

IMG_20160503_141307_zpsw1cgmqs3.jpg

I just wanted to show you guys what happened to my daughter and her yearbook.
A class mate asked to sign her book and she said don't write FUCK in it.

I snapped a picture and texted it to her principle.
The kid had to buy her a new year book. Unfortunately, she didn't get the new book until the last day of school.
He almost didn't get to walk with his graduating class. I called the principle and told him to let him walk, he was very ashamed at himself and likely learned a lot.

Hshaha a month later my daughter got a message from him on Facebook.
*I hear you're single now, I'm single now, we should go out some time*

My daughter answered nah, you have a lot of growing up to do. If I'm going to babysit, I want a paying gig.

69 counts hahahahaha hahahaha:D whole football team hahahaha:D Okay, Okay back to adult world.

His teammates were in on it. Look at the picture, all the other guys are arm to arm shoulder to shoulder. The guys in front of him are apart so he could show his dick. If he is convicted, they should be convicted as accessories. However, I don't think he should be convicted at all, it was a harmless prank.

I cannot think of a way they can prosecute him. If they do, it's the legal system run amok. So every picture I've ever taken, or anyone else has ever taken with or without my knowledge with the possibility of my Dick being in it make me a criminal? This is fucked up beyond fucked up
I went to take a picture of my very first turkey and at that moment my husband full frontals the camera.. the photo lab left it in.. we laughed our asses off... adults... I DON'T SEE A DICK

I still don't see it. You are having to tell people what happened and zoom in on a picture. JFC.. I am with @CbabyRKO give him 500 hours of community service in a woman's shelter!

I didn't either and I magnified it a lot, that bit of white standing there is part of the number off the jersey to the left front of him, pretty sure.

I went back and I looked again, magnified it 500% the bit of white is definitely part of the number, the same for the guy on the right front, and if you look at every guy that you can see his sleeve, he has almost the exact same little upright strip of white on his sleeves.

"Embiggened" sounds funny, is that right?
