A Macomb County couple convicted in the 2013 death of their 11-month-old daughter after she ingested a prescription morphine pill have been sentenced to prison.

Harold and Kimberly Murphy were sentenced today in Macomb County Circuit Court after they were found guilty in December of second-degree child abuse in the Oct. 15, 2013 death of their daughter Trinity.

Harold Murphy, 42, who was at work when the child was found unresponsive at the family's Sterling Heights home, was sentenced to 30 months to 10 years in prison by Judge James Biernat Jr.

Biernat sentenced Kimberly Murphy, 38, to 3 years to 10 years in prison in her daughter's death.

Both received 76 days credit for time served in the Macomb County Jail, according to circuit court records. The records also stated that Biernat took under advisement a request from Kimberly Murphy's attorney for $6,375 for attorney and extraordinary fees.

The prosecution said the toddler's parents were reckless because she ingested the pill. The condition of the house where the Murphys and others lived was discussed during the trial, at which a police detective described it as "filthy." It also said the couple had a history with child protective services starting in 1999.

Attorneys said that Kimberly Murphy's mother had cancer and had been living with the Murphys before she died. Assistant Prosecutor Yasmine Poles said the grandmother had been prescribed morphine and other medications.

It seems a little extreme to me. They might not have been aware that a pill was ever dropped or misplaced. The grandmother could have done that. It sounds to me that there getting such a harsh sentence for keeping a messy house.

None of these people who's kids find their handguns and kill themselves ever get charged with anything more than a slap on te wrist.

I may be missing something, but I don't see that they were sentenced to life in prison as the title says. I read up to 10 years. One got 30 months to 10 years, and the other 3 to 10 years.
