Dustin Elwood and Jimmy Hutton

One man was convicted of sexually assaulting three brothers and his friend was convicted of molesting two of the siblings in Tustin in attacks dating back to 2008.

Dustin James Elwood, 24, was convicted on multiple counts of lewd or lascivious acts with a minor and a count of possession of child pornography, all felonies, in relation to three brothers.

(Jimmy Ernest Hutton), 27, was convicted of sexually assaulting two brothers, including one boy he licked chocolate syrup off of, according to Senior Deputy District Attorney Heather Brown. One of the brothers testified Hutton sexually assaulted him, but the defendant was not charged with those allegations, Brown said.

Elwood faces up to 214 years to life in prison and Hutton, who teared up as the verdicts were read, faces up to 63 years to life in prison, Brown said. Sentencing was scheduled for June 26.

The oldest of three brothers, who is now 18, testified that Elwood befriended him and would take him to baseball practices and games when his father was too busy with work.

Elwood, who was friends with the alleged victim’s oldest brother, first befriended the youngest sibling when he was 3 or 4, the victim testified.

“It was in junior high that he started to realize maybe this relationship was inappropriate,” Brown told jurors in her opening statement.

The allegations against Elwood and Hutton came to light when the mother of the boys found a flash drive containing child pornography images of the victims, Brown said.

Elwood and Hutton would “share photographs” of the boys taken during sex acts, Brown said.

In one instance, one of the boys engaged in a sex act with both men, Brown said.

214 years means that he would never get out or be eligible for parole. Unfortunately, the judge referred to them as "still being human beings" during sentencing on August 28, 2015

The sad thing is nobody monitors juvenile offenders because they have a right to privacy as a juvenile. There needs to be some sort of law in place that protects the community from juvenile molesters.
This case is a perfect example..Jimmy Hutton at the age of 14 years old sodomized his 3 and 5 year old half brothers. He got a slap on the wrist and probation. Only to go on offending. To make matters worse when he was arrested in Tn. he was living in the home where the 2 half brothers still lived. Yes, he was back living with 2 of his victims. This man is a straight sociopath. At sentencing his attorney asked for a lesser sentence because he wasn't convicted on as many counts as Dustin. I'm sorry, this is his 2 time getting caught he should never see the light of day. Had we known of his prior conviction so many children could have been saved from him. These 2 men were found with flash drives and the videos on their computers were horrifying. They get off on watching little kids being tortured and raped. I hope they live in the same fear that they subjected my 3 sons to.
The judge said on a scale of 1-10 10 being the worse this is a 10. He also said in the 40 years on the bench this is the worse case of abuse he has ever seen. But obviously not bad enough to give each of them the maximum sentence!

SANTA ANA – Two men who befriended and then sexually assaulted several Tustin brothers were sentenced to prison Friday by a veteran judge who described their crimes as among the worst he has ever seen.

Orange County Superior Court Judge John D. Conley sentenced Dustin James Elwood, who was convicted of sexually assaulting three boys, to 45 years to life in state prison. The judge sentenced Jimmy Ernest Hutton, who was convicted of sexually assaulting two of the boys, to 30 years to life.

A jury in April found Elwood, 24, and Hutton, 27, guilty of multiple felony counts of lewd or lascivious acts with a minor and possession of child pornography. Both men will be required to register as sex offenders for the rest of their lives.

The sexual assaults occurred back in 2008, when the boys’ were about 7 to 11-years-old. The two men were also accused of sharing photographs of the boys taken during sex acts. The abuse came to light after the boys’ mother found a flash drive that had child pornography and the pictures of her sons.

The young victims and their family members urged Conley to impose the maximum sentence, which would have been more than 200 years to life for Elwood and more than 60 years to life for Hutton. They told the judge how Elwood in particular had gained the trust and friendship of their family before victimizing the young boys and driving a wedge between the brothers.

“If they have the chance it will happen again. They don’t change,” said the boys’ mother, who the Register is not naming to avoid identifying the sexual assault victims.

“We trusted them with the most precious things in our lives; our kids. And we trusted (Elwood) like a son... little did we know there was manipulation behind it.”

In a letter to the judge read in court by Senior Deputy District Attorney Heather Brown, one of the boys described how the pain and anxiety that stemmed from the sexual abuse turned him into a social outcast at school.

“I lived in fear every day, knowing the abuse was happening and not knowing when it would happen next,” the boy wrote.

Brown told the judge that the impact of Elwood’s and Hutton’s actions, which she described as “inhuman,” will stay with the boys’ for the rest of their lives. The prosecutor noted that Hutton also had a history of sexual assault, dating back to when he was a young teenager.

“What these young men did to these kids is basically sentence them to a lifetime in hell,” Brown said. “When you look at the facts of the case, it doesn’t get any worse. It was repeated, daily sexual attacks on these children.”

Attorneys for Elwood and Hutton noted that it will be decades before their clients are eligible for parole, making even longer sentences unnecessary.

Conley initially seemed torn about whether to impose the maximum sentences, taking a 10-ten minute break to gather his thoughts between the attorney arguments and handing down the sentences.

He acknowledged that the case was among the worst he has seen during his more than 40-year career. However, the judge said he couldn’t justify imposing the maximum sentence.

“It’s despicable conduct. It took advantage of trust and comfort from the family. It occurred again and again. And we have heard the devastating effects on the three boys,” Conley said.

“But I can’t give the maximum sentence just to make the family feel better.”

"Your children are not worth the maximum", judge tells victims families. Yeah it's rough business being raped, but it's not THAT bad, i can't justify the max sentence.

what would it take to warrant that sentence? If that's the max sentence the law has made allowable, then how is it ever not justifiable? The lawmakers have said, "this particular crime can be punishable with this sentence", why is any further justification necessary?

I don't think there are probably any words that could adequately encompass the devastation these monsters have caused you, your sons, and your family. My heart goes out to you all. I can't begin to fathom what you've been through. I can only say that I wish nothing but peace and healing for you in time - and most especially for your boys. I think I speak for everyone here when I say that this sentence enrages us too.

Bottom line Dustin Elwood was convicted on 22 felony counts with enhancements due to the fact that these were repeated crimes on my children for a 3 year period. They were found guilty and the judge ran their sentencing concurrently not consecutive which to me is bullshit. The judge had an obligation to the community for its safety and I think he failed in that area. These 2 pedo's should have NO hope of ever getting out. But, they do, in 45 years they get to go before a parole board. I know most people think "oh they'll never last that long, they'll be over 70 years old" blah blah blah. But the way our judicial system is who knows what laws will come into play over the next 45 years. Look at how our drug laws have changed in just the last 5 years!
The judge also stated that the DA was asking for more time than a Murder 2 conviction, at least these children are still alive.."
"Yes, I am great full everyday that my son's are alive. But the innocent beautiful little boys were killed years ago. These 2 men stole their childhoods. When my kids look at pictures of happier times before the abuse they draw a blank, they don't remember those times. To be honest I can't believe that they are functioning young men. All 3 battle anxiety, depression and PTSD. My youngest has been sentenced to a lifetime of seizures. Since disclosure he started having seizures which is triggered by sleep deprivation, his brain doesn't get into the REM Sleep. Which has led him to not going to school for the past 4 years. We are constantly working with sleep Dr's etc to try and retrain his brain to sleep. My oldest as a 10th grader had 3 MLB teams watching him. With a 90mph fast ball and a wicked curve ball he had D1 Colleges wanting him to come play for them. He missed his Junior year due to health issues from stress. Needless to say he lost interest in baseball and turned to pot to make himself feel better. Thanks to Dustin who introduced the boys to weed to get them to relax. My middle son has felt like an outcast and all of them suffer with trust issues . They are just learning to trust each other again. But. I keep telling the boys "Success is the best for of revenge" and as the days go on I am more and more impressed with the strength and courage my boys have. There were other children victimized be these 2 mobsters but they didn't want to testify.

Thank you everyone for your thoughts and prayers. I have AMAZINGLY STRONG BOYS, they are no longer victims but survivors. We as a family wI'll never give up on one another, I WILL NOT let these 2 monsters take that from us. I try to find something positive to come of all of this, at the moment it is still to fresh. If anything we just need to communicate and educate the public and not to be silent. I intend to go back to school and get my degree in Criminal Justice or Child Advocacy the laws need to change they need to protect our children and the victims not the perpetrators

It's wonderful to hear that you are leading and encouraging them to be strong survivors. It sounds like you're setting a foundation for them to pull whatever good they can out of a horrific ordeal.
 
Their father and I are doing our best, this has placed a tremendous amount of strain on our marriage. After 21 years of marriage we refuse to give up on each other or the boys. I'll be dammed if I'm gonna let these two take anymore from this family. After all the best for of revenge is success!
 
UPDATE..
On Sept. 8, 2015 both Dustin Elwood and Jimmy Hutton were transferred from county jail to State Prison! Yes, enjoy your stay boys!
