A grand jury Monday indicted a Bedford man on charges of child abuse in connection with the death of his 2-year-old son.

Michael Anthony Smith faces two counts of felony child abuse or neglect and one count of conspiracy to manufacture methamphetamine. Shana Marie Witt, the child's mother, is charged with first-degree murder.

In late February, emergency crews arrived at a home on Peaksview Lane in Bedford and found the boy dead. Search warrant affidavits filed in Bedford County Circuit Court indicated Witt confessed to smothering Jordan.

Several hours may have passed between the child’s death and the 911 call, authorities have said. They believe the parents waited to call for help because they needed time to hide drugs.

The two felony counts of child abuse were issued because prosecutors believe Smith did not properly protect, care for or supervise two children in his home, Bedford Commonwealth’s At-torney Randy Krantz has said.

One of those children was Jordan. The other was Witt’s child from another relationship, Krantz has said.

Witt is set for a preliminary hearing in Bedford County Juvenile and Domestic Relations Court later this month. A judge ordered a mental evaluation to be conducted on Witt at her attorney's request.

Bedford County mother is charged with murder in the strangulation death of her 2-year-old son, and the boy’s father faces charges of child abuse and drug manufacturing.

Shana Marie Witt, 24, was arrested on one count of first-degree murder after her son, Jordan Smith, died Thursday afternoon, authorities said.

Michael Anthony Smith — Witt's husband and the boy's father — was arrested and charged with two counts of felony child abuse and neglect and one count of manufacturing methamphetamines.

“It just rips your heart out,” Bedford County Sheriff Mike Brown said. “That's probably one of the most difficult scenes you're going to go to.”

[...]

Emergency crews responded to 1066 Peaksview Lane in Bedford after receiving a call from that house at 1:35 p.m. Thursday. They found Jordan Smith unresponsive and not breathing.

The boy was taken to the hospital, where he was pronounced dead.

Brown said Friday afternoon there was no history of calls to the Peaksview Lane home. When responders arrived, Brown said, the couple did not offer an explanation as to why Jordan’s breathing stopped.

Witt and Michael Smith lived at the Peaksview Lane home with Jordan Smith and another child, age 5. The 5-year-old was not home when the incident occurred, the Sheriff's Office said.

Krantz, the prosecutor, said Jordan Smith died from "manual strangulation and suffocation.

“There is probable cause to believe this was a willful, premeditated and deliberate murder. There is no evidence at this point to suggest that it was anything but that,” he said.

[...]

When dispatchers received the report, the Sheriff’s Office sent a violent-crime response team. Krantz said detectives and forensic specialists were sent to investigate, allowing them to issue charges 24 hours after Jordan’s death.

[...]

The two counts of child abuse and neglect Michael Smith faces stem from investigators’ belief that he cooked methamphetamines while his children were home, Brown said. A standard toxicology screen was performed on Jordan, though deputies have not yet received the results.

Investigators believe the child died one to four hours before emergency responders were called.

“There was an intentional delay in contacting the proper authorities,” Krantz said.

[...]

Brown said Jordan's 5-year-old sibling is receiving help from Social Services and is staying with relatives.

The sheriff added all homicide cases are tinged with despair, particularly when the victim is a child. Investigating deputies will undergo mandatory psychological counseling, he said.

Witt and Smith are held without bond. Both had arraignment hearings Friday morning by video conference in Bedford Juvenile and Domestic Relations Court and are set for a preliminary hearing April

Poor baby boy was probably in their way, needing attention or nurturing whilst they were busy trying to get high or make some junk.
Just too sad for words.

It's bad enough you strangle your little one but then to let him rot while you hide drugs is ridiculous. Two more fucking losers. Throw the book at them.

If your drug life is more important get fixed. You can always have your children adopted too if you don't want to be a parent.

This is not that important when the FINAL result was a sweet lil baby was murdered.

But I'm curious on the fact that the cops repeatedly state that the pos"s waited to call 911 until they cleaned up there drug evidence ...if this is true...than how are they getting charged with manufacturing ?? There is not so many ingredients that they would forgot something and it's usually all together in 1 Lil spot...

Again this is such a small unimportant detail when a child's life has been taken.. But after being here on DD for so long its made THE NEED TO KNOW part of my brain go into over drive..
RIP BABY BOY BLUE..

Krystal's second link states that the father admitted he had seen the mom cooking it in the home. Also, meth labs have a smell that you can't get out on short notice.

Why do people who kill their absolutely adorable children always call 911?
They either think they are a good enough liar or they act in a manner not intending to kill the child and get scared when they think they may have, or maybe not knowing who else to call? This methamphetamines takes emotional empathy from users, I'm not surprised she could kill her baby. Those beautiful blue eyes, RIP angel.

I once read that a judge responded, "I'm so sorry", after asking a defendant what drugs she used and the defendant responded that she used meth. The judge went on to explain that meth left such an imprint on the body and the brain that she would do battle with the drug for the rest of her life. No shit judge! It's called addiction and everybody has a drug of choice that they do battle with. How high do you have to be to take perhaps your child's favorite stuffed animal that they played with and loved on, wrap it around their neck and strangle them with it until the light goes out of their eyes?

I read an article from a former meth addict who said that his ability to feel joy was gone, even after his use stopped, I'm thinking that meth steals your soul long after you've beat the addiction.

When you mess with neurotransmitters, you are setting yourself up for a painful adjustment as your brain tries to balance itself back out.

I've heard addicts say that there is no use in getting clean because they've "already fucked my brain." The good news is that even hard-core meth users may have more hope than once thought:

What meth does is pump up your dopamine and serotonin to about 1200 times the normal limit. When you quit using and are dealing with normal levels of your brain's feel good juice it doesn't feel like a whole lot. People getting clean off dope experience anhedonia, or the inability to feel joy, however it is TEMPORARY! Once you readjust you're good to go. I took a little Paxil and some B vitamins for 3 months and viola!

This had NOTHING to do with high. It has to do with a black heart and soul. I never physically harmed a soul when I was a user, other than myself with the poison I was pouring into my body. Neither did my old man at the time nor did the vast majority of my friends and associates.

@badfish76 Thank you for elaborating! That is so good to know that it cannot take your joy forever and there is help! I think that was one of the saddest things I ever read. More importantly, good for you, I'm so happy for you! Its fighting a battle with evil itself, much respect and continued health and happiness!

A Bedford woman described by a prosecutor as an “enigma” in how she treated her children was sentenced to 52 years in prison Friday for smothering her nearly 2-year-old son with a stuffed animal.

Shana Marie Witt, 26, pleaded no contest in Bedford County Circuit Court on Friday to one count of first-degree murder in the death of Jordan Smith.

The boy was a few months shy of his second birthday when he was killed Feb. 27, 2014 in his bedroom at 1066 Peaksview Lane in Bedford.

Bedford Commonwealth’s Attorney Randy Krantz said he was prepared to move forward with a capital murder charge against Witt if she did not agree to enter a guilty or no contest plea to first-degree murder by Friday. Given the severity of the “cruel and deliberate” crime, Krantz said the commonwealth would not settle on a lesser charge than first-degree murder.

“I believe the punishment fits the crime,” Krantz said of the 52-year sentence. “The last thing Jordan saw was his mother placing a [stuffed animal] over his face.”Emergency responders were called to the home Witt shared with Michael Anthony Smith, her husband and Jordan’s father, shortly after 1:30 p.m. the day of his death. Krantz said the 911 call was “staged” as an autopsy found Jordan, who was pronounced dead at Bedford Memorial Hospital, had been suffocated and the manner of a death a homicide.

Judge James Updike accepted the no contest plea and the negotiated sentence of 52 years, which Krantz said ensures Witt will spend the majority of her life in prison.

Speaking to her mental issues, Krantz said symptoms included “acting impulsively” and “childlike” behavior and said her low intellectual functioning was a factor in weighing the capital murder charge.

Not wanting to risk a jury convicting her of a lesser charge, Krantz said the negotiated sentence was preferred to the uncertainties in a trial. There was substantial disagreement between the commonwealth and defense as to whether Witt could form premeditation in her mental state and a jury would have to wrestle with that question, he said.

Smith, who has pleaded guilty to drug and child neglect charges, is set for sentencing next month, court records show.

A man who was home when his wife smothered his child in 2014 was sentenced Tuesday to four years in prison on drug and child-abuse charges.

Michael Anthony Smith, 27, appeared in front of Bedford Circuit Judge James Updike Jr., shackled and wearing a prison-issued orange jumpsuit. He stood straight, with his hands folded, when Updike pronounced the sentence.

Smith received two years of credit for time served and a four-year probation term after his release.

Smith pleaded guilty July 28, 2014, to two counts of felony child abuse and neglect and one count of felony conspiracy to manufacture methamphetamine.

The child’s mother, Shana Marie Witt, 26, pleaded no contest Aug. 21 to first-degree murder in connection with the death of Jordan Smith, who was a few months shy of his second birthday when he was killed.

She was sentenced to 52 years in prison.

Smith faced no charges relating to the death of his son.

According to Bedford County Commonwealth’s Attorney Randy Krantz, on Feb. 27, 2014, Witt left their bedroom while Smith remained in bed.

Witt, who said she could not keep the child from crying, placed a teddy bear over the child's face and smothered him to death.

She then returned to the bedroom, woke Smith up and informed him that something bad had happened with Jordan.

He didn't get up, Smith testified Tuesday, saying he thought Witt was lying to him.

The couple then had sex, Smith testified.

After Smith got out of bed, he discovered the child had been smothered and was dead.

Before they called police, Smith testified Tuesday, he cooked lunch and Witt got rid of their meth-making supplies.
