TAMPA — A sex video involving Hulk Hogan is the subject of another federal court action as a celebrity gossip website is suing the FBI trying to obtain investigation documents related to the recording.
Hogan sued Gawker — initially in federal court, but later in state court — after the website posted a story and a portion of the video, which the pro wrestler said was made without his knowledge. The video depicted Hogan having sex with Heather Clem, then the wife of radio shock jock Bubba the Love Sponge Clem.
Gawker asserted Hogan was aware of the recording being made.
The website is now seeking FBI investigation records on the grounds they are essential for the defense of the pending $100 million lawsuit filed by Hogan, a Clearwater Beach resident whose real name is Terry Bollea.
Gawker says in its federal lawsuit against the FBI that it filed a Freedom of Information Act request for more than 1,100 pages of records and was initially denied on grounds the records would violate the parties’ privacy.
Gawker is arguing that there is no plausible pending or possible future investigation related to the video. Any claims that release of the records would interfere with such an investigation are “demonstrably incorrect,” the lawsuit states.
Gawker, which said it got a copy of the sex video from an anonymous source, has said Bubba Clem could be heard at the beginning of it egging on the two, telling them to “do (their) thing.”
The Clems have since divorced.
