A witness overheard the child apologising for losing his shoe as he was killed in Mountsfield Park, Hither Green, southeast London, jurors heard.

Iheanacho then allegedly carried his limp body into the park and rang the boy’s mother, Lilya Breha, to say he had fallen asleep.

Alex lay dying on the park bench in front of pedestrians with Lewisham University Hospital just five minutes walk away.

When the lifeless boy was brought home in a taxi, Iheanacho attacked his partner, Ms Breha to stop her calling an ambulance.

Alex was not taken to hospital until 8.30pm and died of severe head injuries two days later following an unsuccessful surgery.

A post-mortem showed Alex he was covered in bruises from head to toe with cause of death given as bleeding on the brain.

The pathologist identified at least 22 bruises as well as internal bruising of his abdomen.

She said: “The deceased victim was a little boy named Alex Malcom.

“He was just five years-old when he died.

“Iheanacho, a man who was looking after him, acting as his step father, but who on early evening of 20th November last year, lost his temper and violently assaulted the boy, causing him fatal head and stomach injures.

“The defendant is a man who has, ever since done his best to avoid being held accountable for those injuries.

“Alex suffered injuries that were to end his life, whilst in the defendant’s care.

“There is no one who saw exactly what happened – there are no eye witnesses or CCTV of the actual attack – of the defendant landing blows on Alex, there is, however, clear evidence as to the defendant’s anger before Alex sustained his injuries.”

Witness Sarah Strugnell said she saw the park gate rattling as if someone was being punched against it, hearing around eight punches in quick succession.

Miss Laws said: “She heard some one walking through the gates from the park and went to have a look.

“The defendant appeared to bend down to the child and ask where the child’s shoes were.

“The child appeared to indicate that the shoes were in the park.

“The man was very angry indeed and Sarah Strugnell describes how he was raging at the child who was keeping very quiet.

“Soon after this, she describes hearing repeated booming noises, and the gate was vigorously moving as if it were being punched by someone using both fists in quick succession, about eight punches in total.

“It is the prosecution case that this banging could well have been in fact banging from repeated assaults upon Alex.

“At some point, whether during this confrontation or between this confrontation and the next sighting of the defendant by dog-walkers, soon after, back in the park, the boy had received extreme injuries.”

Her partner, Gavin Richardson said he heard the boy saying sorry as he was beaten against the gate by a screaming Iheanacho.

Another couple walking their dog saw Iheanacho talking on his phone a few minutes later and saw Alex lying unconscious on a bench.

They overheard Iheanacho on the phone saying they were looking for something and “he has fallen asleep and is heavy”.

Miss Laws said Iheanacho gave Alex a bath when they returned, and choked Lilya after she told him he was “dangerous”.

She added “Lilya wanted to call the ambulance but the defendant tried to stop her. He got angry and she thought he would hit her.

“The defendant suggested they put him in the bath which he did. Alex had wet himself.

Whilst in the bath, Alex’s eyes remained closed.

“The defendant took him out and they wrapped Alex in a towel.

“Lilya was now screaming. The defendant told her to stop. She called him a danger to her family whereupon he assaulted her.

“He kneed her hard in the chest, then jumped on her back and started to choke her so she couldn’t breathe any more. He stopped suddenly and then laid Alex down on his own bed.

“Lilya’s mother noticed that Alex was getting cold. His face had turned blue and he stopped breathing. Lilya grabbed the phone and called for an ambulance.

“The defendant was not able to stop her. The call connected at 20:34 and an ambulance was dispatched.

Despite initially telling police she was with Alex at the time, Lilya broke down during her police interview and accused Iheanacho.​

May your murderer suffer unimaginable pain at the hands of someone much bigger than he, for some minor infraction like losing a shoe or forgetting to wash his hands. JFC I wish those hands of his were cut off!

I totally agree. What the he'll? All those people heard or saw something, and nobody could even call the cops. They all have blood on their hands. This wasn't something they describe as discipline that went too far. This was a violent sustained assault against a child. They did nothing.

I hope that's with them forever, too. It would've been so simple for them to make that call, and he wouldn't have been the wiser. I don't think I could not have called.

Iheanacho then carried the unconscious boy home to mum Lilya Breha - who was also viciously attacked after she desperately tried to call an ambulance.

Despite the efforts of medics and hospital staff Alex would later die from his injuries.

Prosecutor Eleanor Laws QC said: ''The prosecution say that [Alex] died at the hands of the defendant, Marvyn Iheanacho, a man who was looking after him, acting as his stepfather, but who on the early evening of November 20 last year, lost his temper and violently assaulted the boy, causing him fatal head and stomach injures.

''The defendant is a man who has, ever since done his best to avoid being held accountable for those injuries.''

The court heard that Iheanacho had taken Alex with him on a trip to Catford to pick up some DVDs and visit a friend.

On the way the pair stopped at a park and it is here, the Crown says, that Iheanacho became enraged when Alex had told him he had lost a shoe.

Relaying the witness testimony of Sarah Strugnell to the jury Miss Laws said: "The defendant lost his temper with the boy, most likely because Alex had lost his trainer

Miss Laws referred to CCTV evidence which showed the pair entering the park at 5.11pm and an hour and a half later Iheanacho can be seen leaving with Alex in a fireman's lift.
The defendant took Alex, who was unconscious, into Lewisham Cars Cab Office and asked for a cab to take him to Elmers End Road.

Miss Laws said: ''He was carrying Alex as if he were a baby. It is of note that he did not take Alex to hospital, which was just 0.2 miles away from the cab office, just a five minute walk further on.''

Upon arriving home mum Lilya began to scream and panic and desperately wanted to phone the emergency services.

Miss Laws said: ''Lilya was screaming. The defendant told her to stop. She called him a danger to her family whereupon he assaulted her.

''He kneed her hard in the chest, then jumped on her back and started to choke her so she couldn't breathe any more. [too bad she kne hat she as getting into baby didn't]

Eventually at 8.30pm Lylia managed to call the emergency services.

When asked my medics what had happened to Alex, Iheanacho claimed that he had fallen off a climbing frame.

Doctors at Lewisham Hospital attempted to resuscitate Alex. He was placed on a ventilator and a CT scan later revealed that he was suffering from severe brain swelling.

A decision was taken to transfer him to Kings College Hospital in order for specialist neurosurgeons to operate in order to relieve pressure on his brain.

But the operation was sadly not successful and on November 22 last year Alex was pronounced dead.

When interviewed by police under caution about the events Iheanacho made no comment.

Iheanacho has pleaded not guilty to the charge of murder.

The trial continues.

Marvyn Iheanacho found guilty of murder in the battering death of girlfriends son, 5 year old Alex. The verdict was unanimous.

A stepfather is facing a life sentence after battering a five-year-old boy to death in a park for losing a trainer.

Marvyn Iheanacho, 39, flew into a rage and subjected his girlfriend’s son Alex Malcolm to a brutal attack in Mountsfield Park in Catford, south-east London.

Witnesses heard a child’s fearful voice saying “sorry”, loud banging and a man screaming about the loss of a shoe.

Alex suffered fatal head and stomach injuries and died in hospital two days later. One of his trainers was later found in the play area by police.

Iheanacho, who was in a relationship with Alex’s mother Lilya Breha, was convicted of murder at Woolwich crown court. The jury of seven men and five women returned a unanimous guilty verdict on Friday.

Breha nodded as the verdict was announced and quietly wept in court.

Iheanacho, from Hounslow, west London, has a string of previous convictions for violent offences, including attacks on former partners and robbery.

Judge Mark Dennis QC deferred sentencing until Tuesday.

It's the saddest thing to know that this little mans last words were saying he was sorry to the very man who was battering him to death.

Just because he was the mother's boyfriend doesn't make him the child's stepfather.
Is the definition of stepfather now a live in boyfriend? The terms are used interchangeably.
