Tucson, AZ- The life of this five year old has not been an easy one. After being removed from her bio units because of abuse, she was adopted by Samantha and Justin Osteraas. Samantha Osteraas, 28, is now facing two counts of child abuse against this poor girl.

From the onset this poor child had it rough. Her bio units fucked up royally and she was removed permanently from their custody. The abuse is reported as such:

  • In December 2012, two reports were received alleging neglect to the girl, who was a year old at that time. It is unclear if the allegations were made about her biological parents. That case, which was later found to be unsubstantiated by DCS, was still open when the next report was received.
  • On April 2, 2013, a report was received alleging neglect to the child by her biological parents. The girl was removed from the home and DCS filed a dependency petition, which would make her a ward of the state. The allegations were substantiated.
  • On Jan. 7, 2015, a report was received alleging neglect to the child by an unnamed caregiver. The investigation resulted in the removal of the child from that caregiver, and the allegations in that case were substantiated.
  • On May 15, 2015, a report was received alleging physical abuse to the child by a caregiver. An investigation followed and the child was determined to be safe in the home and the allegation was unsubstantiated.
  • On Nov. 23, 2015, a report was received alleging past sexual abuse to the child by her biological father and physical abuse by her biological mother. The allegations in that report were unsubstantiated.

In the summer of 2016 she was officially adopted by the Osteraas'. They already had three other children in the house. It is not specified if they were also adopted or if they were their spawn. All three have been removed from the home and are in the custody of Arizona Department of Child Safety.

On December 29th Samantha did what all normal parents would do, and had bath time for her children. Two of the kids had finished their baths when it was the five year old's turn. According to Samantha, she turned the water on and left bathroom leaving the girl to get into the tub all by herself. By her own admission, she didn't even bother to test out the temp. TV is much more important.

After about 15 minutes of TV time, she went back into the bathroom to turn the water off and said she saw the child was lethargic and hanging over the tub. She said the the girl looked up and said, "hi, mommy." Whether the the poor girl said this or not, that is just absolutely heartbreaking.

Samantha then stated she took the child out of the tub and into the master bedroom, where detectives said they spotted a large blood stain on the spot the child was laid onto the floor. Then she said she went to drain the tub. She said the water so hot in the tub she had to cool her hand off by running it under cold water. Might I add, she took the time to cool her own hand off, while the child lay bleeding on her bedroom floor. Then she stated she called her neighbors and husband, who was at work. Because that's always a better choice than 911..... She eventually called 911 around 8:00pm. She also stated she had drank two beers that night and had a Rx for Adderall.

Officials noted when they got to the scene that the five year old was burned from her upper chest down. They also saw bruises on the child's left arm and neck. There was also bleeding and trauma on her upper lip. Hours after the incident was reported the child was in organ and respiratory failure. She had third degree burns on 80% of her body.

Doctors also came to the conclusion that the burns happened up to six hours before Samantha bothered to call for help. According to her though she called immediately. While interviewing the other children, they said they were playing on an iPad while their sister was in the tub. Detectives have taken the iPad to determine the time table. As of the last update I could find, the girl was in critical condition.

Samantha is being held on a $25,000 bond. She was offered protective custody because of her charges and she declined. This woman is a fucking moron. Other inmates found out why she was in there and threatened her life. They were able to punch her several times and pull her hair. She has since requested protective custody and it has been granted. In the most intelligent move she could've made, she declined to press charges against the inmates that attacked her.

Damn poor baby! I cant imagine having to endure 6 damn hours of pain before even being cared for. Theres no way the kid climbed into scalding damn water and just lays back to take a bath! Nope! One toe in would be as far as the kid could go before screaming. That bitch held her in the water. Im sure thats how she burnt her hand. Screw her and her protective custody. I hope the other inmates heat up some cooking oil and cover her ass in it. Then just let her lay there and die!

See, this pisses me off. You listed the CPS history. When I was with CPS, that was the FIRST thing I did when I got a new case... review the history and read ALL of it. I would have seen and caught that and prevented it. Sounds like one of those shitty lazy-ass CPS investigators hired straight out of college, who dont give a shit and just want a paycheck. It's fucked up. The good ones are ignored while the shitty ones are showcased. That's why I left.

Before being submerged in scalding water, allegedly by the woman who recently adopted her, a Tucson 5-year-old lived with a foster father now imprisoned for sex crimes against children.

The girl, who is in critical condition, had been shuttled from one troubled home life to another before 911 responders found her severely burned on Dec. 29.

State authorities had removed her from her biological parents and placed her, as a toddler, in the Sierra Vista home of David Frodsham, where she lived with other foster children from 2013 until January 2015.

Frodsham was arrested in 2016 after federal authorities accused him of sexual misconduct with children and of providing at least one child to an alleged child pornographer, Randall Bischak, for sexual contact. The foster father eventually pleaded guilty to counts involving a child over age 15, in return for prosecutors dropping other charges. The names of child sex victims are not public record and would not be published by the Arizona Daily Star.

The biological mother of the Tucson child says she raised concerns with state workers that while living in Frodsham’s home, her toddler daughter had repeated urinary-tract infections, which can be a sign of sexual abuse in children, but says those concerns went unanswered.

From Frodsham’s home, the little girl had to commute nearly 90 minutes each way to see her biological parents in Tucson. She initially would “cry until she fell asleep” after she left her parents, said Beth Breen, a former taxi driver for children in state custody. Breen took the child back and forth for nearly a year, ending in March 2014.

The little girl would scream in fear around strange men, Breen said, making it nearly impossible for male drivers to take her, and so Breen said she became her regular driver. Breen would sing to her and the girl would watch movies on a DVD player Breen bought for the drive.

Breen has had trouble sleeping since she realized, about a week ago, that the little girl in the news was the toddler she’d transported.

Arizona Department of Child Safety records show that the girl’s biological mother, Michelle Tremor-Calderon, was nearly reunified with the child before her parental rights were terminated in 2015.

What Calderon desperately wants now — and she has asked Tucson attorney Lynne Cadigan to help her — is to see her hospitalized daughter and, if the little girl is not going to survive, to say goodbye.

Calderon learned a little more than a week ago that the hospitalized girl was the child she’d lost. Calderon has not seen her daughter since July 2015, but, like Breen, looked up the adoptive parents on social media and saw her daughter in their family photos.

The girl was taken from her in April 2013 following a domestic fight between Calderon and the child’s father, Jonathan Hileman. She remained in foster care while her parents, who struggled with cocaine addiction, worked toward reunification.

The girl’s father, who is a registered sex offender from a 1999 crime involving an adult victim, had failed to notify police about his new address, and that was another factor in their case, at least initially.

Throughout the dependency case, Hileman continued to relapse while Calderon began to sustain her sobriety, reports show.

As of May 2014, Calderon was moving toward reunification with her daughter when she violated a court order by letting the father, who was not allowed unsupervised visitation, to be at home with them.

The couple tried to remedy that significant error by later separating, records show. In February 2015, Hileman relinquished his parental rights. Calderon said he did this primarily to help her regain custody of their daughter.

A couple of months later, in April 2015, court records showed Calderon to be in full compliance with her case plan. But the behavior of their then-3-year-old child was deteriorating around this time, DCS records show. She had prolonged temper tantrums, urinated on herself and cried for prolonged periods after her visits.

The child’s caseworker and a DCS-appointed family therapist testified this was because the child was having difficulty relating to her mother, that the mother had “inappropriate conversations” in front of the child and “didn’t know how to meet her daughter’s emotional needs.”

In the end, a judge severed Calderon’s parental rights based on her violating the court’s orders related to Hileman, the length of time the child had been in out-of-home care without successful reunification — well beyond the nine months required by law — and the “serious negative behaviors” the child would exhibit around her mother but reportedly would not display when away from her.

Calderon tried to appeal the termination, but was not successful.

From that article above seems her mother was a better option that the state sponsored foster families. Even with the violation, the child was never physically hurt or abused.

I wish there was a better way to take care of children who can't live at home. I don't know what it could be, but it must change for the better.

I guess everybody knows that foster children are near and dear to my heart because of the baby my son and DIL are fostering. I want to help, but there's nothing I can do except to love her. And I do.

The taxi driver sounds like she cared more about the little girl than any of her parental units.

Third degree burns over 80% of her body, holy shit. People come out of house fires with less than that. Unimaginable pain.

According to court records, DCS was warned that Samantha abused drugs and had a tendency toward violence. Justin’s brother told Pima County detectives that he had warned the adoption agency that Samantha was dangerous and should not be licensed to adopt. (See source.)

From all my experiences, the court appointed attorney does pretty much jack shit. Theyre there cuz they have to be and they essentially just tow whatever line CASA endorses. Not sure how Arizona works, but where ive had the displeasure of dealing with family court, these are regular attorneys who have to participate in roles like this on occasion as a condition of maintainin their legal license. Youre not necessarily getting someone who is experienced with family court or with children or anything else youd think such a role should demand expertise in. Youre not getting someone who's sole focus and job is this child or family court at all.

I am quite interested in knowing where CASA was in all this. Again, in my experiences, they get to know the parties involved farrrrrr better than CPS case worker does. In fact it's special advocates that the case worker themselves, and most certainly a judge, will often consult with and base their decisions off of.

CPS has an agenda, and the child is most def not always at the top of it. Court appointed attorney is just there cuz they have to be. CASA is the one component in these cases that is 100%, no doubt about it, there SOLELY for the child. I dont give a shit what some court appointed attorney said or what the CPS worker assigned thought. Someone should track down the person who got to know this girl and who volunteered to look after her best interests and what she/he thought of her and the placements.

Had to wait 2 months for a home study once. Keep in mind, that's us asking for one for at least one full month, FINALLY getting a judge to order it done, and then another 2 for it to finally happen and for the results to get processed or whatever the fuck they do with em. We were fortunate enough to be able to afford a fairly high priced(at least for that area) attorney to represent us in family court and get our foot in the door too(aunt/uncle situation, no you have zero rights with such a relation and have to fight/pay to get a voice in the matter, same goes for grandparents in many states). No idea how difficult it would have been, or if it would have been do-able at all, had we not had legal representation.

I would bet money though that if she did have that home study and it was discovered that she maintained close contact with the bio father, she'd fail that thing in a fucking heartbeat. They look for ever and any reason to fail you when doing home studies. It is NOT a look into seeing if you have a safe home/environment, it is a look to see if there is ANYTHING they could POSSIBLY use to rule you out, no matter how arbitrary or minor or minute. It is a stringent process of elimination, not some process where someone merely seeks to find out if you're a good person or will offer a loving home.

Michelle Calderon, 40, admits her own troubled background and parenting problems.

A high-school dropout, she gave birth at 24 to a cocaine-exposed girl whom child-welfare workers took away directly from the hospital, according to court records. Calderon lost parental rights to that child in 2002.

She met Devani’s father, Jonathan Hileman, in early 2010, just after he had served 10 years for burglary, theft and sexual assault. Devani was born in April 2011.

(The Arizona Republic generally does not identify child sex-assault victims. This article does not use Devani's birth surname, which differed from those of her parents.)

An argument between the parents on April 2, 2013, brought in the police and DCS. Though domestic-violence charges against Calderon were dismissed two weeks later, on April 17, 2013, drug tests showed both parents positive for cocaine. Caseworker Jeannette Sheldon took Devani away. The little girl seemed healthy, Sheldon later reported to the court. But Sheldon cited concerns over drugs, the domestic-violence allegations and the couple’s “lack of stable housing and employment.”
At first, Calderon struggled with state services. But after court warnings in October that she risked permanently losing her daughter, Calderon faithfully went to every class and session, and tested clean at every drug test, according to DCS reports she showed to The Republic.

By May 2014, Calderon gained home visits with Devani. But a judge ordered Hileman to have no contact with the child. When the caseworker found him hiding in the apartment, the state ended Devani's home visits and turned toward severing Calderon's parental rights.

There would be another reason cited for cutting her off: her complaints about Devani's foster care.

During Devani’s first foster placement, in April 2013, Michelle Calderon repeatedly complained to case manager Jeannette Sheldon and to others at DCS that her daughter kept showing up for visits with scratches and bruises.

“I took pictures of her bruises. They said they’d look into it, but I couldn’t get any answers. So, I called the cops,” said Calderon, interviewed in Tucson before a judge put her under a gag order relating to this case.

Though the police didn’t bring charges, their visit led the family to opt out of fostering Devani, according to a DCS report. In early June, the department moved the girl to the Frodshams, who already were fostering other children.

“I took pictures of her bruises. They said they’d look into it, but I couldn’t get any answers. So, I called the cops.”

Soon Calderon began complaining again to Sheldon and others at DCS about apparent signs of abuse.

“Not even a month after she was placed there, she came to a visit with a UTI (urinary tract infection) and vaginal odor. That went on for eight months. Their excuse was it was caused by drinking juice,” said Calderon. “She started arriving to visits with scratches and bruises on her back. This continued over the entire stay. She came one time with a bite mark on her arm and a bruise on her face.”

But DCS reports to the Juvenile Court, shared by Calderon with The Republic, show that Sheldon was skeptical about any problems with the Frodshams.

In a May 2, 2014 report, Sheldon wrote that after overnight visits, Devani was “having a harder time to leave her mother,” and that after one visit “she walked into the front door of the foster home, wet all over the floor, and cried and cried.” Sheldon added that “once she has transitioned back into the foster home, she is peaceful and appears happy again."

Both Sheldon and a contract therapist, Alexis Kirkendall, dismissed Calderon’s complaints as baseless. Later, they used her insistent concerns against her. In July 2015, even though Juvenile Court Judge K.C. Stanford found that Calderon was “in substantial compliance with her case plan,” he stopped her visitations with Devani, after Kirkendall said that contact with Calderon was “psychologically damaging” to the girl.

Sheldon and Kirkendall cited what they called Calderon’s “false complaints” in later hearings, telling Stanford that she had tried to disrupt Devani’s placements in various foster homes. Kirkendall, raising worrisome behavior by Devani, such as crying, wetting herself, and showing fear of male drivers, told the judge that Calderon was making Devani afraid of men.

Stanford cited those arguments, among others, in terminating Calderon’s parental rights on Oct. 8, 2015.

Such a weird story. I've seen some total fucktard shitstains get their kids back. Abiding by CPS programs is about the easiest thing in the fucking world to do. Really nothing simpler than getting your kids back from ALL ive seen. These stories are always incredibly hard to believe as a result.

Allowing your sex offender partner back in the house after the State says "fuck off" and causing big problems by complaining and even calling the cops on fosters is not going to help your cause. Damn shame this womans court appointed attorney didnt bother to pass her such hints(or maybe he/she did and the woman acted a fool anyways). That's another element of this that makes little sense, every parent that gets their kids taken away gets representation for the family court proceedings. This woman wasnt totally alone in the world dealing with this shit, she too had legal counsel. Of course those fucks can be quite careless and just there cuz they have to be, but still, did she try to effect change thru that avenue before causing problems for the State??

Jane had to be placed in a medically induced coma, suffering from organ failure. She lost her toes to amputation “and will undergo lifelong operations to replace 80 percent of the skin on her body and will need incredible amounts of care for the duration of her life as a result of the abuse she suffered in the Osteraases’ home.​

I don't think that is fare. The DCF willfully ignored her complaints and used it has part of the grounds to terminate her rights. She was right she had evidence, The case worker chose to ignore. That is not the Mom's fault.
