It's Day 14 & today we expect to see lead Det. Stoddard back up on the stand for his 2nd day of questioning by defense atty. Maddox Kilgore.

Yesterday saw frequent head-butting between the 2 & a lot of nit picking of the investigation as the defense attempted to show that investigators had decided Harris's guilt from the start & therefore only collected evidence to support their biased opinion- but Stoddard held strong & a couple of points were gained for both sides (imo).

Also interesting, yesterday after the jury was dismissed for the day, there was discussion about a 'field trip' that the defense is planning to take the jury on. There was concern from Prosecutor Boring about keeping the jury out of the media's view during the outing. Judge Staley decided that 1 courtroom camera would be allowed to accompany the group, so it sounds like we may be able to follow along on the field trip too!

They had Cooper's car seat in the courtroom today (before the jury was seated) to discuss taking the jury at some point to view the actual car seat placed into the actual car.

Idk if it's my pregnancy hormones or what but seeing that car seat got me all teared up. I guess it's like a tangible connection to this baby that I've ended up kind of attached to while following the case.

Day 14 Trial Highlights:

After finishing up with lead Det. Stoddard, the prosecution next called Det. Rassi to the stand. He was the det. who took the video of Harris arguing with detectives about his charges, stating 'I didn't do it with malicious intent' (apparently 'malicious intent' is a term specifically found in the GA statute for felony murder) & Rassi found this wordage 'suspicious'. Here's that video clip:


Then there was a ton of discussion about new 3D scans of the inside of Harris's car. The prosecutors had the scans re-done last week after the defense pointed out a discrepancy in the original scans- the foot extension on Cooper's car seat was in the down position when the original scans were taken, but crime scene photos show that the foot extension was actually up.

Although it was the defense who pointed out this discrepancy, which lead to the prosecution re-perfoming the scans with the car seat properly adjusted, they don't want the new scans to be allowed (let's face it, they just want to be able to point out the mistake as 'sloppy investigating' for the jury!) They claim that since the new scans were admitted during the trial, they violate the rules of discovery.

Det. Carey Grimstead, who performed the new scans, took the stand outside of the jury's presence to discuss the new scans that he took with the car seat properly adjusted- a less than 1" discrepancy. The judge finally ruled the new scans were admissible.

(Prosecutors plan to use these scans to create an animation to show how visible Cooper would have been to Harris when he had returned to his car that day at lunchtime to 'drop off a bag of lightbulbs.')

The jury was then returned & heard much of the same testimony about the scans & car seat extension from det. Grimstead.

Day 15 Trial Highlights

Before court cameras began rolling, the jury was taken outside to view Harris's SUV with Cooper's car seat inside. They were only allowed to circle the vehicle twice, couldn't touch anything, couldn't open any doors or get into the vehicle, couldn't ask any questions & weren't even allowed to speak.

Returning to the courtroom, the defense immediately requested a mistrial, calling the viewing 'a disaster' & complaining that factors (from the position of the sun to the height of the jurors!) made Cooper's car seat more visible to them then it would have been to Harris.

Judge Staley wasn't having it, dismissed their request & pointed out that the jury is allowed to examine all evidence in the case & that the viewing was done in a very limited way & normally jurors are allowed more time to examine, handle & discuss pieces of evidence back in the jury room.

First to testify was another of Harris's online girlfriends who admitted they sexted daily (on an app called 'Scout'), followed by a brief return to the stand by det. Grimstead who spoke about the process of installing Cooper's car seat into the SUV.

Next up to the stand was Jim Persinger, a digital forensic examiner who analyzed the data retrieved off of Harris's iphone & computers. He testified Harris manually deleted his search history on his devices 2 weeks before Cooper's death. (His theory on why Harris would tell det's that he had watched that 'how hot does a car get' video was bc he knew he forgot to delete it!)

Persinger described Harris as 'crafty' in attempting to hide his online activity & said it was 'suspicious' the way he deleted some search caches but left others.
The defense had him admit that he was not able to find any searches for 'murder statutes' or 'malicious intent', but on follow up questioning Persinger says those searches may have been done & deleted by Harris.

Last up to the stand was David Dustin, who created the 3D animation of Harris's car (which prosecutors plan to show to the jury to demonstrate Harris's drive to work that day & his return to his car at lunchtime) Dustin demonstrated how 3D scanning is done & explained the equipment used.

Once the jury was dismissed for the day, defense atty. Kilgore added to his complaint from the morning regarding the jury's viewing of the SUV, adding that the car seat was placed into the SUV in the presence of the jury, (changing what? it wasn't clear.)

Coming up for Day 16: The jury will see a demonstration of 3D scanning & possibly finally view the 3D animation (which we already got a sneak peek of & I've included below!)

I'm watching this mornings testimony on YouTube & for some reason today the audio is super soft, so I've been listening through headphones- I've got the volume all the way up & still can barely hear some parts- but every 5 mins, asst. Among other oddities, Stoddard said Cooper’s mother, Leanna, never asked to see his body.

It was the evening of June 18, 2014, Stoddard testified. The 22-month-old Cooper had just been found dead, and Justin was in a police interrogation room when his then-wife, Leanna, came to visit him.

But she displayed little emotion, Stoddard testified. Indeed, he said, she didn’t ask to see her son’s body, which he thought was “strange.”

Highlights from trial day 16

The prosecution rested its case on Friday after a morning of more testimony from 3D scan expert David Dustin. Jurors were shown 3D animations of Harris's car & the various locations he drove & parked on the day of Cooper's death. The prosecution hopes the scans will demonstrate to jurors that Cooper & his car seat should have been visible to Harris.

The defense argued 2 points on the scans & animations: That the sightline shown in the animations was set of a person who is 6'2" (Harris is actually 6'3") and that incorrect placement of the carseat in the original scans made Cooper's feet appear visible- which was not the case in the new animation based off of new scans.

As soon as the prosecution rested, the defense asked for a 'directed verdict', saying the prosecution failed to prove their case- which the judge promptly denied!

Their first witness was a realtor who testified he was working with the Harris's on looking for a house & that they spoke about moving to an area with 'good schools for Cooper',

Next up was Det. Shawn Murphey, who was the 2nd in charge on this case. Defense atty Bryan Lumpkin question him about his role in the investigation & some mistakes that may have been made.

Outside the presence of the jury, the defense informed the judge he planned to use Det. Murphey's testimony to impeach the testimony of the other officers who have testified. The prosecution argued the basis for the impeachment was mainly hearsay, the judge agreed & stood by an earlier ruling not to allow the questioning.

The defense ended their first day by asking the judge for a mistrial, stating the prosecutions case was based on lies & mistakes- Judge Staley denied the motion.

~ @Momzilla ~ Thanks for the heads up. Watching the very calm and collected mother of Cooper Harris give soft and gently guided testimony now as witness for the Defense.

Will the Prosecution take the gloves off and rattle Leanne out of her comfortable flat line status on an emotional scale??? I've said it before but her actions and reactions immediately after she learned of her baby's torturous and cruel death and going forward from that time left me drop jawed and perplexed.

I believe that Cooper's death was intentional and that the evidence presented bears that out. I believe Leanne Harris had a role in that death albeit Justin Harris drove and parked the murder weapon on that day.

Day 17 Trial Highlights

In the first full day of the defenses case, their star witness took the stand.
Leanna (Harris) Taylor testified in her ex-husbands defense, giving compelling testimony in a matter-of-fact but also appropriately emotional manner, gaining the first real points for the defense in this trial Imo.

Leanna testified about what a loving & involved father Harris was, how he spent every moment with Cooper that he could. She claims that while they were trying to conceive Cooper, Harris was diagnosed testified with "Low Testosterone & Erectile Dysfunction".

She admitted that they had problems in their marriage, that Harris had confessed to her about his 'porn addiction' & sexting with women. At one point in 2013 she had even asked Harris if he wanted a divorce to which he responded 'that is the last thing I would want'.

Leanna also testified about going to pick Cooper up at the daycare that day & realizing that Harris had never dropped him off, then learning from the security guard that the news was showing Harris's car & said a child was dead. She says that she was so in shock that she felt 'detached from her own body' & didn't break down into tears until later that night.

According to Leanna, the reason she asked Harris "did you say too much" was bc she was confused as to why he was being charged, She claims Harris always talked a lot, even if he had nothing to say, so she wondered what he might have said to police to make them suspicious. Her response to Harris's chatting up detectives that day-- "that's just Ross"

She talked about Cooper often falling asleep quickly in the car & that she had moved the front-facing carseat out of Harris car to use it in her own car a week before Cooper's death.

Also interesting, we saw photos taken by police during their search of the couples bathroom which showed a vanity fixture with 6 lightbulbs- 3 of which were burnt out & the same type as the bulbs purchased by Harris that day.

The defense showed several pictures & videos of Harris & Cooper through the years, bringing Leanna (& apparently Harris too) to tears.

The prosecution began their cross examination of Leanna by asking about Harris's infidelity. Leanna says had she known the extent of Harris cheating, she would have divorced him straight away. Prosecutors asked why she waited so long to file for divorce, to which Leanna responded 'because I didn't know what to believe."

The defense called a number of what I'd call 'character witnesses'. To make it a little easier I'm just going to list the witnesses in order & give a brief summary of who they are & what they were there to say.

Harris appeared to break down as his brother testified


1. Leanna (Harris) Taylor: Harris's ex-wife, Cooper's mom
- prosecutors got her to admit that she was unaware of her then husbands 'double life'. She is living with a new boyfriend now & hasn't spoken to Harris since the divorce.

2. Joey Nesbit: next door neighbor- said she was friendly with the Harris's & babysat Cooper occasionally, claims they were a 'perfect family'

3. Jason Abdo: Harris's co-worker @ Home Depot- said Harris loved his son & often bragged about him. He admits he had no idea about Harris's cheating 'sinister side'

4. Aundrae Brown: another co-worker @ Home Depot- said Harris was often forgetful at work, was spending 'a lot of time on his phone' in the months leading up to Cooper's death, was missing project deadlines. Brown had actually sent an email to Harris voicing his concerns on the day Cooper died.

5. Jelani Etienne: another Home Depot co-worker- said Harris would show pics of Cooper at work but had stopped in the months leading up to Cooper's death. Said Harris often used 'cop lingo' at work.

6. Angie Bond: friend of Leanna's- ( she was the friend who gave the Good Morning America interview right after Cooper's death) Claims the couple loved Cooper, that Harris was very involved. She was with Leanna in the days after the incident & said Leanna would often 'break down' once they were alone. She now hates Harris bc of his cheating.

7. Michael Baygents: Harris's brother- this is Harris's cop brother who he was supposedly planning on going on a cruise with. Claims Harris loved Cooper 'more than life itself', that Harris often used 'cop lingo' & would talk to 'anyone & everyone'. He admitted he's ashamed of his brother's actions as far as the cheating.

8. Amy Baygents: Harris's sister-in-law- said Harris was a great dad, she knew of problems in the marriage, but not between Harris & Cooper.

9. Debra Taylor: Leanna's mother- testified about the relationship between Harris & his son, said she drove with Cooper in his carseat & that he often fell asleep.

Coming up for day 19- more character witnesses for the defense.

ETA: I had noticed that Harris's brother has a different last name, Baygents, maybe a half-brother?

I felt the same way about Caylee Anthony (and I wasn't pregnant at the time). In that one very famous photo of her sitting in the car seat holding the doll she's the spitting image of my daughter around the same age.

Harris's accountability partner Billy Kirkpatrick says he 'dropped the ball'

This was a very short day in court because of a scheduling issue. We heard briefly from another of Harris's co-workers Ryan Henry who said Harris told him he was planning a big party for Cooper's birthday (which would have been in August).

We then heard from Nathaniel Coyle, a friend of Harris's from church. He said Harris confided in their mens bible study group that he was struggling with a porn addiction.

Next up was Nathaniel's wife Heather Coyle- she is the travel agent that Harris emailed the day of Cooper's death, requesting info on a cruise he was planning to take with his brother's family. She was later called back to the stand by the defense to confirm that she had never been contacted or questioned by police.

We next heard from a long-time pal of Harris's named Michael Simmons who says he met Cooper when visiting Harris & that he appeared to be 'very proud of his son'. He also stated he had no idea of Harris extramarital affairs & wishes he had so he could have helped him with those issues.

Last to testify was Harris's 'best friend' Billy Kirkpatrick, the person Harris chose to be his 'accountability partner' when their pastor set Harris up with the Covenant Eyes program (the program monitors a person's computer activity & flags any questionable websites, sending a report to an accountability partner)

Kirkpatrick says the Covenant Eyes program did not deter Harris & that he often received reports that Harris was visiting porn sites as well as sites like 'Adult Sex Finder' & 'Ashley Madison'. He admits that he did not confront Harris about his activity bc he knew Harris would 'be humiliated'.

The prosecutor pointed out that although Kirkpatrick considered Harris's feelings when choosing not to address the porn/adultery sites, he did not consider the feelings of Leanna or Cooper. Kirkpatrick says he has guilt about that & feels that he 'dropped the ball' as Harris's friend & accountability partner.

It's really shocking how much about JRH's double life has come to light in the wake of this tragedy! Every family member and close friend who takes the stand starts out by saying that they know him so well and that he's a great guy who would never hurt his son, but in the end they all have to admit they had no idea what kind of person he really was.

He appeared loving towards his wife while secretly cheating on her [with every man, woman & child he met literally!]

Its not a far leap to think he could act loving towards Cooper while secretly planning his demise?

And really thanks again for the updates @Momzilla I think your daily summaries are more interesting and informative then reading the news articles.:)

Defense expert Dr. Gene Brewer testifies about memory

Only 1 witness took the stand yesterday, the defense called Dr. Gene Brewer who is an expert in human memory and attention.

Brewer talked about how memory works & what can effect a persons memory- like distractions, stress & fatigue. He talked about slipping into 'auto pilot' when a routine is very familiar (he gave the example of zoning out while driving a daily route)

He talked about certain cues that would help a person remember- intentional & indirect cues. If Harris had a 'memory failure' & truly believed he had dropped his son off at daycare, that text from Leanna about Cooper would be an 'indirect cue' and not as likely to make him remember as an 'intentional cue' would-(an example would be if the daycare had called & told him Cooper was not there)

Brewer testified that 'memory failure' can occur, even when a task is important (he gave the example of an airplane pilot forgetting to put the landing gear down) And that bc driving to his work was more familiar to Harris then driving to the daycare, in his opinion it is possible that a distracted Harris could have forgotten his son in a matter of seconds.

Upon cross examination by the prosecutor, Brewer admitted that it would be less likely to forget something as vitally important as your own child in the car & that there were several 'cues' that day that could have reminded Harris that he had left his son in the car.

Brewer had to concede that according to Harris's own statements to police that day, he was not stressed, not distracted while driving that day & had actually slept in that morning. He also agreed it is possible that Harris was simply lying when he says he forgot that he left his son in the car.

Court adjourned early with no additional defense witnesses available for the day.

Coming up for day 21- We should see 1 more witness for the defense & 1 rebuttal witness for the prosecution.
Closing arguments are expected to begin Monday!

Highlights Trial day 22: Closing Arguments!

"I love my son, but we all need escapes":
The prosecution began their closing arguments today by quoting that text Harris sent just minutes before leaving his son in the car to die. Prosecutor Boring said that Harris's own words prove his guilt, that the womanizing, cheating 'other Ross Harris' decided to get rid of the son that was holding him back from the life he fantasized about. That Harris believed he would get away with it & even become an advocate. Harris's reaction after killing his son was to selfishly complain about going to jail.

Prosecutor Boring then went count by count explaining Harris's guilt:

Counts 8 & 7: dissemination of harmful material-
Harris sent pics of his genitals to a 16yo girl & 'coached her how to perform oral sex'.

Count 6: sexual exploitation of a minor- Harris asked a 16yo girl to send her a picture of her vagina.

Counts 5 & 3: felony murder & cruelty to a child in 2nd degree
- Harris's own statements prove these charges, that his negligence caused his son's death (intent & malice are not required for this charge)

Counts 4 & 2: felony murder and cruelty to a child in the 1st degree- these charges require the jury to find that there was malice (but not necessarily intent) in the death of Cooper.

Count 1: Malice murder- that Harris killed Cooper without justification or excuse and with malice. Boring said that Harris did not hate his son, he just loved himself more- that his 'double life' had been slowly taking over until Harris made the decision to leave his son "to burn up in that car".

Boring told the jury to use their own common sense to find that the defense's case does not point to an accident & that there is enough evidence (both direct & circumstantial) to find Harris guilty of all charges. The prosecutor left off with a picture of the interior of Harris's car with Cooper's carseat clearly visible, saying "It all comes down to this, if that is the way Cooper's carseat looked on that day, Harris is guilty of all charges".

The defense started their closing by saying that the detectives on this case decided Harris was guilty before an investigation was done
. Atty Kilgore said that this case is the result of an accident & not a crime. That in Harris's own words, he is guilty of nothing more than forgetting to drop his son at daycare- not a crime.

He then went through a few of the counts:
Counts 5 & 3- Harris is not guilty bc he did not realize his actions were causing his son's death.

Counts 4 & 2- not guilty bc Harris did not intend to harm his son.

Kilgore then pointed to Leanna's testimony (as I predicted he would) to say 'he ruined that woman's life, do you really think she's going to come in here & lie for him?"

He asks the jury not to judge Harris bc of his 'different reaction' to the tragedy, that everyone grieves in their own way- even Leanna's reaction was not emotional. But that Harris loved his son.

Kilgore stresses that investigators had a 1 track mind & only collected evidence that fit their theory & that the prosectution did not prove that this wasn't an accident.

The defense lastly talks about the carseat being visable to the jurors when they were allowed to view Harris's car, saying they may have been able to see the carseat bc they were looking for it, Harris would not have been.

They showed a video of Cooper & then said that Harris had 'nothing to gain by Cooper's death'. They ended by saying to the jury 'we trust you'.

Boring stated Harris lived a double life & that everyone who testified that he was a loving father also admitted they had no idea about his double life.

Boring then goes slide-by-slide over the defense's closing & dismantles each one!
Via slides, he went back over the states case & witness's testimony.

Boring ended with the Latin saying "Let justice be done, though the skies may fall" and saying "Justice for Cooper in this case is holding the defendant responsible"

A few of the hot car baby deaths are accidents, I truly believe that, even if I don't want to admit it. I also firmly believe that more of them than have been prosecuted are murder, you just can't prove it. In this case, I think they got it right and I really hope the jury gets it right too.
 
Jury deliberations Day 1- Tues, Nov 8th

Yesterday jury began deciding the fate of Justin Ross Harris.
The jury was given approx 1150 pieces of evidence
to view during their deliberations which began at 9:30am. They would only deliberate until noon, being dismissed early so they could go vote.

Almost immediately they started asking questions of Judge Staley;
  • Could she define “wanton*?” (This was used in the law the judge read to jurors involving malice.) The judge answered that this was not a legal term, so they were on their own.
    • What does this question mean? Well that is unclear, but it is clear it means they were working quickly going down the list of charges.
    • *(wanton: of a cruel or violent action; deliberate and unprovoked.)
  • Could she provide a transcript of Harris’ interview with det. Stoddard? The answer was no to the transcript, but they could watch the video (which they plan to tomorrow)
    • What does this mean? There are a whole lot of issues involving this interview. Harris appears distraught at times, mostly calm throughout the interview, and combative when told he would face criminal charges.
    • Harris also paused, then failed to mention that he came back to his SUV during lunch (when Cooper was still strapped inside).
  • Could they see the doll made to represent Cooper in his car seat? (prosecutors had the doll made to use in pictures and the 3D animation that illustrated how visible Cooper would have been to Harris) The answer was no. Because the doll was never used in court, it was not entered as evidence.
    • What does this mean? The jurors might have wanted to see if you could miss Cooper in the back seat while driving.

Jury deliberations Day 2- Wed, Nov 9


The jury will resume a full day of deliberations starting at 8:30am today.
They are expected to start the day by watching the video of Harris's interview with det. Stoddard that they requested (but were denied) the transcript of yesterday.

Updates:
9:00am- the jury is in court watching the interrogation video

2:30pm- Jury is in the courtroom once again, this time they have requested to watch the video of Harris w/ Leanna in the interrogation room (the 'did you say too much' video)

6:00pm- Jury has not reached a verdict after 9 hrs of deliberations. Deliberations will resume at 8:30am tomorrow.

Jury Deliberations Day 3- Thurs, Nov. 10

Buzz around the courthouse saying that we might have a verdict today!

Court will be recessed tomorrow for Veteran's day, so might the jury try to wrap up their deliberations in time for a 3 day weekend? As they say, the jury's still out on that!:shame:

Fingers crossed we'll see a resolution to this case today with a verdict of Guilty on all counts- I'll keep you updated!

Updates:

9:00am- Jury begins 3rd day of deliberations

11:30am- reporter tweets that a juror was seen crying outside during a smoke break- could mean nothing but interesting

2:30pm- Jury asks to watch the surveilence video of Harris's return to his car at lunchtime (which has always been the nail in his guilty coffin IMO!)

4:30pm- No Verdict today! Jury dismissed for long weekend

I don't really know, but I think if they felt it was a slam dunk guilty verdict they'd be done already, or maybe they are just trying to get it right, crossing all the T's and dotting all the I's. I hope they get it right, that man is guilty, guilty, guilty.
 
~ @WeepingAngel ~ After the Casey Anthony verdicts I stopped trying to fathom a guess as to which way a jury was leaning based on all the evidence of guilt they had at hand.

I believe in the Harris trial that Prosecutors presented evidence that pointed to Justin Ross Harris as being guilty of the charges. I'm of course hoping that the jury is able to interpret all the evidence and give Cooper the much and long awaited justice he so deserves. I'll reiterate Cubby in saying the man is guilty, guilty, guilty.
 
Jury Deliberations Day 4- Mon, Nov 14

@WeepingAngel My opinion is that this jury is just being really careful & thorough.

They have a lot of charges to go through & a ton of evidence to review. With such a high profile case, I think the jury members know that their decisions will be under heavy scrutiny & I think they are just making sure they get everything right.

So fingers crossed, after a nice long weekend, the jury will be ready to come back with a verdict today! (and I'm with you @cubby @Victoria let that verdict be GUILTY on all charges!)

Sentencing is set for Dec. 5th
It will be a separate jury that decides the penalty but Harris is looking at the possibility of Life + 40 yrs for all 8 counts.

Phew, I'm really so relieved that this case turned out the way it should.
As Prosecutor Boring said at the end of his closing statements"Let justice be done, though the skies may fall"
And I truly believe in my heart that justice was done in this case.

Here's the video of the verdict being read, the audio isn't great but its subtitled.
Harris stayed pretty stone-faced which surprised me- usually the tears flow when it's about himself!

They took their time to get it right! Hallelujah! No one can say they didn't do their due dilligence, they worked very hard to come to the decision they could all live with and it was GUILTY!
