The government responded to Jared Fogle's appeal of his prison sentence of almost 16 years by stressing text messages that the former Subway pitchman sent seeking sex with minors.

The texts, meant to illustrate the extremes to which Fogle went while committing his crimes, were included in a filing to the U.S. Court of Appeals for the Seventh Circuit. They were part of Fogle's sentencing hearing last November but had not been previously reported in detail.

"I'll pay you big for a 14- or 15-year-old," said one text to an adult escort.

Another text said, "Did you find me some young girls or boys?" Fogle wanted the child to be able to prove his or her age, adding, "If they can and you get me 16 or below, I'll give you 400 at least."
The government's filing said "repeated text messages and emails showed Fogle had a pattern: he found adult escorts through the Internet, developed relationships with them, and offered them finder's fees to provide him with access to minors for commercial sex."

It said he did this in "several" places, including Richmond, Va., Kansas City and Las Vegas.

The government quoted the judge as saying he deserved above-guidelines sentencing because of his obsessions with child pornography and having sex with minors.

The filing noted that the judge said that Fogle "went to great lengths to engage in commercial sex acts with underage minors. He bought and offered plane tickets. He reserved and paid for the hotel rooms, made arrangements for the commercial sex acts."

It also quoted Pratt as saying that despite Fogle's privileged upbringing, he engaged in "a web of deceptions and depravity."

Fuckin pisses me off. So because of jail overcrowding they decide to release a nasty predator over the prisoners in prison for marijuana. I want to see how many other prisoners were released. I bet none. I bet he paid them off or something. So now he is on house arrest and can sit at home behind a computer and get off whenever he feels like it. House arrest?! Fuck that

CHICAGO — The judge who sentenced former Subway pitchman Jared Fogle to more than 15 years in prison mistakenly believed he was involved in producing child pornography, and his sentence should therefore be reduced, Fogle's attorney said during a hearing Friday.

Fogle wants the 7th U.S. Circuit Court of Appeals to shorten his sentence, arguing that the district judge abused her authority by sentencing him to a longer prison term than prosecutors suggested in his plea deal. Prosecutors say the judge acted within her discretion.

It looks like it wasn't the judge herself who said it, but Fogle's lawyer wants to make it sound that way.

He pled guilty to sending/receiving and traveling to engage. That is what he was sentenced based on. Period.

He has absolutely no idea what her impression was. She had all of the same facts as the rest of the people involved in the case.

I would've been shocked if we didn't hear about every single appeal this disgusting prick filed while behind bars.

My only question is, usually with plea deals, appeals are taken off the table. Maybe that isn't the case with federal charges?

INDIANAPOLIS -- Jared Fogle's attorneys filed a motion Thursday claiming the parents of one of his victims share responsibility for the crime because they "failed to properly supervise" her.

In the complaint, Fogle asks for the two unnamed parents of "Jane Doe" – one of his victims who filed a federal lawsuit against him in March – to be added as third-party defendants in the suit, asserting they "may be liable for all or part of the Plaintiff's claims against him."

"Jane Doe's" lawsuit seeks $150,000 each from Fogle and former associate Russell Taylor for personal injuries, emotional distress, invasion of privacy, negligent supervision and negligence.

In her suit, "Jane Doe," who is from Connersville, Indiana, says she was a guest at the home of Russell and Angela Taylor between March 2011 and January 2015 and was secretly videotaped changing clothes, showering and bathing.

Fogle's lawyers argue "Jane Doe's" parents should be liable for some or all of any damages levied against Fogle because of their "outrageous and reckless conduct" which inflicted "personal injuries, emotional distress and psychological injury" on "Jane Doe."

In the third-party complaint, Fogle's lawyers claim "Jane Doe's" parents, "… maintained a hateful and abusive relationship toward each other, which included, but was not limited to, engaging in frequent fighting and arguing between themselves; abusing alcohol and getting drunk; and engaging in frequent fighting, physical abuse, and arguing with Jane Doe, which caused Jane Doe to suffer from emotional distress, anxiety and major depression before she learned of any allegations involving the Defendants or any acts of the Defendants."

Fogle's lawyers assert that "Jane Doe's ability to engage in harmful behaviors was the direct result of" her parents' failure to properly supervise her.

Fogle is currently serving more than 15 years behind bars at Colorado's Englewood Prison. Taylor was sentenced to 27 years in prison, which he is currently serving at the Marianna Federal Correctional Institution in Florida.

Instead the attorneys for this twisted POS Pedophile has left me feeling the need for another shower this morning although I just had one not two hours ago.

The ex-wife of former Subway spokesman Jared Fogle is suing the fast-food chain, alleging that the company has known about Fogle's sexual interest in children since 2004 but never did anything to address it.

The lawsuit, filed on behalf of Kathleen McLaughlin, says Subway was notified at least three times about Fogle's "sexual interest in and activity with children" but kept featuring him in ads and did not notify authorities.

"As early as 2004, Subway's then-senior vice president of marketing received a complaint that Jared had approached a young girl at a promotional event for a Las Vegas Subway franchise for a sex act," the suit alleges.

Subway sent its then senior public-relations manager to ask Jared and a franchisee owner, rather than the victim, about the incident, the suit alleges. "Subway did not thoroughly investigate the report and did not alert authorities as they were legally required to do," it reads.

Then in 2008, a Subway franchisee from Florida notified the company that Fogle had made disturbing comments about children, as Business Insider first reported. Again, the company sent its senior public-relations manager to ask Fogle about the complaint and nothing was done, the suit alleges.

“Finding out that your husband and the father of your children is a child predator, and knowing that his job involved him visiting schools on a regular basis is devastating," McLaughlin told reporters on Monday.

She said she filed the lawsuit to get answers from Subway regarding its knowledge of her husband's sexual attraction to children.

In response to the lawsuit, a Subway spokesman provided the following statement to Business Insider: "“As this is pending legal action, we cannot provide comment."

Fogle was convicted and sentenced last year to nearly 16 years in prison for having sex with minors and receiving and distributing child pornography. He's serving out his sentence at a federal penitentiary in Colorado.

The company began airing a commercial that depicted animated versions of Jared’s family, including his wife and children, the suit says.

McLaughlin is now suing Subway, alleging that it depicted her in the ad without her consent. She is also accusing the company of negligence and intentional infliction of emotional distress, alleging that the company's "ambition for sales and growth came at the expense" of her and her kids.

A judge has rejected the latest request from Jared Fogle, the imprisoned former pitchman for fast-food chain Subway, to reconsider his case two years after he pleaded guilty to child pornography and sex with minors charges.

Fogle, acting on his own behalf without an attorney, submitted court papers last week from the federal prison in Colorado where he is serving a sentence of more than 15 years.

A federal judge in Indiana who presided over Fogle’s criminal case rejected his legal motion, which challenged the legal jurisdiction of the court over his actions and asked for a new hearing.

“Regardless of his theory, Fogle’s challenge of this court’s jurisdiction is rejected” and his motion is denied, U.S. District Judge Tanya Pratt wrote in a two-page ruling on Nov. 8.

Ron Elberger, who represented Fogle in court in 2015 and during an appeal last year, could not be reached for comment.
