Ross' lawyer, Chris Bruce SC, told the NSW Court of Appeal on Tuesday that his client had been beaten on four separate occasions since he was jailed and fears he may be the victim of 'ongoing intimidation and violence' if he is to serve his full sentence.

Mr. Bruce said Ross' had a 'price on his head' in jail and argued the sentencing judge did not consider the 'onerous' conditions faced by inmates who have harmed young children once they are locked up, the Daily Telegraph reported.

'There will be 40 years of ongoing intimidation and violence,' Mr. Bruce said on Tuesday.

'The reality is this will be ongoing this won't cease and infact if he does stay in jail he will ne 68 when this might cease,' he added.

But Justice Peter Michael Hall said the 'high level of brutality' and 'extreme nature of offending' could warrant the sentence, despite Ross' punishment being harsher than comparable case.

Crown prosecuter Sally Dowling SC reminded the court of the terrifying conditions Tanilla endured before her murder, arguing that torture was the only way to describe Ross' offending, the Daily Telegraph reported.

Tanilla's stepmother Brooke Bowen rejected Ross' claims that his life was at risk in jail and argued the toddler was forced to live in fear for much of her short life.

'So what? What about Tanilla? She was fearing for her life for weeks while he was bashing her what help did she get? She won't live to see 68, she is gone, she couldn't even live to see three.'

The three-judge appeal panel is yet to make its decision on Ross' sentence, while a coronial review into Tanilla's death is set of August 30.

He got 40 years and can't apply for parole for 30 years. It's really not much different than you'd see in the US or anywhere else.

In Sweden no one can be incarcerated any longer than fifteen years. Much of Western Europe is the same in regard to even serious crimes.

Judge: Yes...and? If it were possible, this court would have sentenced him ongoing years of intimidation and violence for the rest of his natural life.

Over toilet training. Something that takes time and patience. Something some kids don't get the hang of for months or years. Lazy stupid mean son of a fuck wad probably just didn't want to.change diapers or run a washer or wipe up a little pee.

Child killer Warren Ross has lost a court appeal over his minimum 30-year sentence for murdering two-year-old Tanilla Warrick-Deaves.

His appeal was dismissed in the NSW Supreme Court on Wednesday, meaning he will remain behind bars until at least 2041.

Ross was found guilty in 2013 of murdering his girlfriend's daughter, Tanilla Warrick-Deaves, after weeks of abuse.

He was sentenced in May 2014 to a maximum jail term of 40 years with a non-parole period of 30 years.

He sought to have his sentence reduced on the basis that he faces "onerous jail conditions".

His barrister Chris Bruce, SC, told the NSW Court of Criminal Appeal last month that his client should have received a discount in his sentence due to the "ongoing fear of violence and intimidation" he would experience in prison as a result of his status as a child killer.

Ross abused the child for weeks before her death in her home in Watanobbi on the NSW Central Coast in August 2011, forcing her to run laps, whipping her with various implements and beating her.

The abuse culminated in Ross striking the child repeatedly, banging her head on a glass shower screen, holding her over the toilet and causing her to bash her head on a cupboard door.

She lay unconscious in a pram for two days until she stopped breathing.

Justice Clifton Hoeben told the appeal court that Ross' taunting of Tanilla with a belt to "show he could make her scream without even touching her" was one of the "most horrible" incidents he had read during his career.

Sally Dowling, SC, for the Crown said the length of the sentence was a "reflection of the extreme objective seriousness" of the offence, which had fallen just short of warranting a life sentence.

Ms Dowling said Tanilla was tortured, and urged the three appeal judges to look at the autopsy photographs of her body.
"After inflicting those blows that ultimately caused her death, he left her sitting in the pram to die. At some point in time, he could have saved her and he didn't," she said.

Tanilla's mother Donna Deaves, who gave evidence against Ross during his trial, has been jailed for at least nine years for manslaughter.
