Walter Richters pleaded guilty Wednesday to a manslaughter charge in the Aug. 22, 2014, death of 13-year-old Isaac Robitille at the Hardwick home they shared with Isaac's mother.

Richters, 38, is to be sentenced to at least three years in prison as part of a plea deal with prosecutors. A sentencing date hasn't been scheduled.

Richters also agreed to testify against the boy's mother, Melissa Robitille, who police say approved giving her son vodka through the intravenous tube because the child was "being fussy."

Prosecutors say Isaac was blind, had no ears, a cleft palate and developmental delays.

Melissa Robitille has been charged with second-degree murder. Her trial is scheduled for early next year.

Richters initially was also charged with second-degree murder and, under a proposed plea agreement, would have served 18 months in prison. But a judge last month rejected that proposal.

Richters, who has been in prison since his arrest last year, can argue for less prison time at his sentencing.

I really feel they are equally culpable. The mother is no more responsible for the son's death through her idiocy and negligence. I feel like they're laying heavier charges on her because she is the biological parent while he can lean on the "boyfriend" excuse.

I can't believe that she thought this was a good idea. As I said before.. was she drunk when she OK'd this? What exactly did she instruct him to do, or agree to allow him to do? Did she witness it, did she supervise it, had she done it before? Was there absolutely no alternative?!

Also, someone mentioned prenatal care / testing for viability while in utero. *IF* Mom was a pill-popper and lacked good judgement skills while pregnant, then it's likely she had inadequate prenatal care, if any. Moms who know they're fucking up their kids before the damn things even finish forming usually don't like to be reminded of this every two weeks by their OB-GYN.

Responsible moms get a responsible amount of prenatal care (where available, if possible). Moms who don't give a rat's ass ...

Not sure why you caught so much negativity for this. Perfectly understandable way of thinking. I bet most here would agree to abort a child if they knew it'd have problems this severe, yet here they are negging you and whatnot for voicing a similar level of disdain and disregard for such a creature post-birth. The difference between murder and manslaughter, and between voluntary manslaughter and involuntary manslaughter, lies in intent.

If the actor intends that the victim die, it's murder. If the actor intends to harm the victim, but not lethally so, it's voluntary manslaughter. And if the actor did not intend harm then it's involuntary manslaughter.

That's a very good -- no; an extremely good -- question, Rune. I don't have an equally good answer.

They did elicit the information at trial that they wanted to settle Isaac down. That is no doubt where the manslaughter charge came from. It is possible, though, that that is only a story spun to evade a charge of premeditated murder for one or both of them.

I would reckon she got four to 12 and he got three because he was held to be the less culpable of the two; after all, he did ask if it was okay and she did approve of it. That, though is nothing more than a WAG, a wild-ass guess.

It explains it in the article. He got 3 because he took a plea and didnt go to trial and she got a min of 4 because she showed remorse. His official cause of death is the abnormality, the alcohol is only a contributing factor.
 
Going by their FB post, it appears that Walter had finished his sentence and that prison agreed with him, he doesn't look as much a piece of shit as compared to his earlier mugshot. As far as Melissa, she's been busy writing paranormal, fantasy romance novels, quite a few actually.

'Although I.R.'s [Isaac Robitille's] doctors would not have expected one ounce of alcohol to kill him, he weighed forty-nine pounds at the time; he was extremely vulnerable to fluid imbalances due to his diabetes insipidus and other conditions; even a small amount of alcohol could be fatal,' the ruling read,

Isaac's brain condition was listed as the cause of death by the Vermont Medical Examiner, while alcohol was listed as a 'contributing' factor. His death was ruled a homicide.

An autopsy found his blood alcohol content was 0.146 percent, about twice the legal limit for driving.
The 13-year-old was blind, had no ears, a cleft palate, and developmental delays in terms of walking and talking, and needed at least 80 hours of care-taking every week.

Feeding tubes supplied him with a diet of a pediatric nutritional drink, baby formula, water and vitamins.

An autopsy found his blood alcohol content was 0.146 percent, about twice the legal limit for driving.

Robitille's boyfriend, Walter Richters, was also convicted in the manslaughter death and was sentenced to three years.
