An Orange County father has now been charged with murder for forcing his 5-year-old son to do push-ups and squats as punishment until he collapsed and later died.

Darell Avant Sr. was originally arrested Wednesday on child abuse charges. The Orange County Sheriff's Office announced Friday that it was upgrading the charges against Avant to first-degree murder.

Upon conducting an autopsy, Orange County Medical Examiner Dr. Jan Garavaglia said there were bruises and contusions on the boy's chest, stomach, arms and back. She ruled the death a homicide, saying Avant Jr. died from internal injuries due to multiple blunt force trauma.

I wanted to hear the autopsy report too because I know tons of military persons who use this type of punishment, though not in the extreme, and I wanted to make sure he didn't have any physical defects that would have caused his death regardless of the punishment. What is it with hitting a kid so hard that you bruise them? I mean, you have to hit pretty damn hard to cause a bruise, kids act up at school and he needed to be bruised for that? Maybe your kid was acting up because you are a piece of shit father who has shown him nothing but DV?
 
Avant called 911 about 7:05 p.m. Wednesday to report that Darell Avant Jr. was unconscious in an apartment at Kensington Cottages on Burroughs Court in Pine Hills, an arrest report states. When he was pronounced dead about 25 minutes later, the child's body was covered with bruises, investigators said.

Avant said he picked up Darell Jr. from Pershing Elementary School about 11 a.m. Wednesday because he was acting up. The boy had been suspended recently for kicking a teacher.

Avant told investigators he sent his son to his room, "popped" him on the buttocks and forced him to do push-ups and squats for about 20 minutes, according to the report.

The boy stopped, but Avant yelled at him to continue, and then the boy said he was hot and his feet hurt, the report states. Afterward, the boy took a shower, got dizzy and collapsed, the report shows.

Avant said he slapped, rocked and shook his son to try to wake him, the report states.

A woman described in the report as the owner of the apartment told deputies Avant routinely spanked his son, who would have turned 6 on Feb. 1, and used a belt to discipline him, according to the report. The woman's 1-year-old son was at the apartment with Avant when Darell died, but she was at work, the report states.

The court ordered that the Avant's younger son be placed with the child's mother. The 1-year-old witnessed the incident in the Pine Hills home, authorities said.

"He needs to pay for what he did to my son," said Avant Jr.'s mother, Jessica Phillips.

Avant tried to keep his head down in court Friday.

The 26-year-old went before a judge who stripped custody of his 1-year-old son, just two days after investigators said he beat his 5-year-old boy to death.

"It's our understanding that the father was caring for the 5-year-old and the 1-year-old at the time the incident occurred," said Department of Children and Families spokesperson Kristi Gray.

The Department of Children and families is looking into whether his other child suffered abuse as well.

"The court felt it was necessary to take a closer look at that child," said Gray.

It's all too much to take for the young victim's mother.

"You're wrong for what you did to him. He did not have to go through this," Phillips said.

According to the arrest report, Avant told deputies his son began to complain that he was hot and his feet hurt. Avant said he sent his son to take a shower.

The report said that when his son came out of the shower, the boy became dizzy and fell to the floor.

Avant told deputies the child was breathing and that he slapped his face to try and wake him. He said he then picked his son up and rocked him in an attempt to wake him.

According to the report, Avant then used a Google search for information on "rolling eyes in back of head." He then called a friend who arrived and began performing CPR. Avant then called 911.

In the arrest report, a deputy said he saw injuries on the boy's body "which were multiple bruises and contusions on the upper torso, abdomen, arms, and back."

i think it looks like hes doing peace with his hand. . . Not a gang sign. . . But could be wrong i suppose since i dont know all the gang signs. Peace i think would be appropriate.

A Florida father who was found guilty last week of beating his five-year-old son to death has escaped the death penalty.

Instead, Darell Avant Sr. will spend the rest of his life in prison, without the possibility of parole.

According to local outlets who were in court for the hearing, Avant did not show emotion as he learned his fate.

Avant has been in jail ever since his son, Darell Avant Jr., died the night of December 18, 2013.

The child was sent home from kindergarten that day because he was acting out. Later that evening, Avant called a neighbor to come over because the boy was unresponsive.

Avant later told police that he had made the boy do push-ups and squats as punishment, and that the boy complained of being overheated. So he let him take a shower and he passed out as he was getting dressed again.

But an autopsy revealed that the boy suffered 208 bruises and 12 rib fractures. The cause of death was determined as internal bleeding as a result of blunt force trauma. Avant had no explanation for the boy's injuries.

Phone records later showed that Avant made some disturbing Google searches about 30 minutes before his neighbor came over to check on the kid. Avant allegedly looked up 'eyes roll in back of head' and 'how to tell if an infant is dead'.

Throughout the trial, Avant's legal team argued that Avant suffered from head injuries that made it difficult for him to make decision.
