Brittany AlstonGranbury, TX – These two were sentenced earlier this month, but I totally missed the story and figured I’d post an article that ends on a good note for change. Justin and Brittany Alston, both 21-years-old, were sentenced to 60 years in prison after teens notified an adult that the couple were starving their 9-month-old baby.

Last December, several teenagers were at a party at the Alstons’ mobile home when they heard Riley crying. When Justin refused to check on his son, a 17-year-old at the party went into the boy’s room and found him emaciated and lying in urine, feces and vomit. His skin was flaking off his body, his bones were showing through his skin,  and one of his socks had fused to his foot.

“I was furious and I was shaking and I was breathing hard and I was trying to be as gentle as I could with this baby because I felt like if I just moved a certain way this baby would break. He was so fragile and little,” Magon Rutledge said. “He had these big blue eyes and they were so bright but the rest of him was just like he was gone.”

Rutledge had her cousin call his dad, a paramedic, and Riley was rushed to the hospital in critical condition. Doctor’s weren’t sure Riley would survive as his body was rejecting food. It’s believed he hadn’t been properly fed in almost two months. Riley was placed on an IV and everyone hoped for the best.

When police questioned the couple, they admitted they were more interested in drinking and smoking pot with their friends than taking care of Riley. When asked why they didn’t take Riley to the hospital when it was obvious he was in medical distress, Brittany said she had more important things to do.

“Brittany told investigators when she was asked why she didn’t feed this baby she said that she had other things to do, like getting the oil changed in the car,” Hood County District Attorney Robert Christian said.

The couple were arrested and charged with injury to a child and abandoning or endangering a child. Brittany’s 18-month-old daughter was placed in foster care, and her 4-year-old daughter was placed in the care of her maternal grandmother.

Like most babies who are fed, Riley was quite resilient and rebounded quickly. He and his older sister were placed in a foster home where he has fattened up quite nicely. You can see for yourself in the following before-and-after pictures.

“The foster mother is not a nurse. All she did was feed this baby,” Christian said. “The only difference between the pictures is a few months and food.”

The couple eventually went to trial, which turned out to be a big mistake on their part. The jury convicted them both on the charges and had a wide range of sentencing options, ranging from probation to life in prison. It only took the jury 40 minutes to sentence the couple to 60 years in prison.

    you think pot did this? I smoke pot every 1-3 hours, and i have since i have been ~15. I received a phd last year, have some kids and work in the research field for about 60 hours each week. What I am saying is these asshats were just worthless – and they also smoked pot. pot didn’t make them worthless!!!

    Sixty years is an outrageous sentence, but it’s good to hear that the baby is doing all right. At nine months, prolonged periods of low glucose, dehydration, and vitamin & electrolyte deficiencies could easily lead to brain damage.

    My husband is the same way. He smokes daily and has for years. He has always been gainfully employed and is an excellent father and husband. He also feels like doing work and gets a LOT of house and yardwork done, in addition to working a swing shift job with 12 hour shifts! I on the other hand have a drink now and again, but due to the stringent drug testing at my job, I never touch anything illegal. Somehow, we always fed the kids! (and the cats…let’s not forget the cats.)

    I’ve been told by the head Psychiatrist at OHSU here in Portland that you can’t become addicted to pot physically…. there can be an emotional addiction, but not a physical one. I’m not sure how that works, but they were trying to explain my brother’s dependence on/allergy to marijuana… I smoke everyday, but not until I’m off work and the house work is done. :-)

    People say this all the time, and I believe you too, Not judging, only from my own experience, but I think if you need, have, like, to do something to alter your mind, and you justify it by saying, “nothing bad has happened” is it really good? What could have been accomplished without it? Can’t get arrested for “sober” driving, never go to jail for possessing nothing. I’m not a prude, but I sure don’t believe all the “wonderful pot!” stories either.

    Yeah – my boyfriend can be a real turd when he has to take the “big” stuff, but thankfully that’s not too often as he is allergic to them like I am. At least with pot, he doesn’t CARE that he hurts… that’s what it does for me too, I know my back is numb and tingly still, I just don’t care for long enough to fall asleep is all! Glad your hubby found help with it! ;-)

    I like to smoke pot and party with my friends but never once have I chose that over taking care of my kid. I’m glad they chose like dummies to go to trial. Just exactly what was their defense strategy? Baby had brittle bones? Medical condition made him not eat? They were overwhelmed? Or it wasn’t my responsibility to feed my fucking kid!

    Not if their family sues Texas for wrongful death… If not outright more expensive than housing/feeding them for 60 years (or however long they ultimately serve) it would certainly massively offset any savings in costs.

    I doubt Zippy the Pinhead and her mate put any effort into serving meals for any of the kids.
    If open food was somewhere the 4y.o. could reach (and you’ll never convince me these two childproofed a damned thing), she could feed herself and share with the toddler.

    Folks (responding to Teleute to address every response), there are different ways to look at sentencing. I’m not familiar enough with Teleute to presume their inspiration for such an opinion, but…

    In this country, 60 years is a pretty exceptional sentence for aggravated rape or even murder. From that perspective, 60 years for this is outrageous, as the case lacks physical violence.

    While this crime is deplorable, these offenders could most likely get successfully rehabilitated, given their age and the nature of the crime. That makes 60 years rather excessive from a public service standpoint.

    Every state has slightly different sentencing guidelines, but for first degree murder, you’re generally looking at about 20 years to life without parole. For rape, you could be getting up to 20 (or even 30) years. But 60 years for neglecting a baby is just mind boggling. As awful as infant and child neglect can be, is it really a worse crime than first degree murder? The parents of infants who DIE because of mishandling or neglect will typically receive a fraction of this sentence. Child murderers may receive half this sentence, and child molesters even less!

    Don’t get me wrong; what happened to that baby was just terrible, and I sincerely hope these assholes never regain custody of the other children. But they didn’t kill the baby, they weren’t actively trying to kill the baby, and there is no evidence of either of them ever having been violent towards the baby nor anyone else. They’re not a danger to the public — probably to future children, but that’s for CPS to handle, not the court system.

    As heartless as this may sound, moral outrage interferes with justice. And crimes against infants never fail to evoke a power emotional response (both in the media and on juries) which threatens to overshadow all evidence and objectivity.

    These “parents” were young. Twenty-one years old. Yeah, it’s no excuse, and I’d be lying if I said I didn’t hope for someone to rough them up a bit behind bars. But to put them away for the next sixty years of their lives — three times the number of years they have even been alive — is far too excessive a punishment. How does this benefit the victim? How does this benefit society, which assumes the burden of keeping these people alive? What “lesson” could these two possibly learn in sixty years that they could not learn in twenty? Instead of incarcerating them for the rest of their natural lives, would it not be cheaper, more efficient, and arguably more humane to simply execute them?

    This isn’t justice; it’s vengeance. And it’s a ridiculous sort of revenge, because as soon as these two kids fade out of the headlines, they’re going to be forgotten, while the infant (hopefully) goes on to thrive within a stable, loving family.

    The only exceptional thing in the whole story is…..3 kids were not found dead in a beer can, and pot filled mobile home. No one died because they threw a party and one of the guests happened to give a shit. The two nimrods had already decided to coldly commit murder on this poor kid by starvation. In my book, that’s the same as shooting them in cold blood. Damn Athena, a dog being starved gets you 10 years, rape (dog or person)15 years, so attempted murder by torture….60 is about right. They chose to do this in every way. they screwed, had a child, kept the child, smoked and drank, forgot to feed kids, changed car oil….they lost their rights to be free. it was their decision.

    The ladies at the group home I work at would never, EVER forget a baby for so much as a second, and if you tried to, would follow you around yelling at you until you tended to the kid. I actually think this little guy would have been a lot safer with them, and they have the functional level of a 5 y/o.

    What these kid’s (yes kid’s) did is terrible, but 60 years is worse. This isn’t just cruel and unusual, but horrifying give that the same effectual sentence would have been given had they murdered both children… Texas probably would have probably been less cruel to simply murder these criminals, but then again it is Texas. To those who would argue these two people were cruel, we live in a nation where at least in the past cruelty was not answered with cruelty… that was left behind in Europoe.

    Semantics. I’m 31 and still refer to myself as a girl more than a woman. But, in my defense, Jaded’s 18-year-old daughter thought I was in my mid-20s. That’s the second party in a row that I’ve had people substantially younger than me estimate me to be about 25. Maybe, if I repeat it often enough, it’ll become true.

    I have heard that statement soooo many times, but the percentage of people who break the law while under the influence of legal pot (or illegal pot other that the purchase and sale)
    is teeny tiny. I don’t drink or do pot, and I cannot imagine in the world of crime that either has a real and/or scientifically predictable impact.

    This sentence is going to be appealed and will probably be overturned at the taxpayer’s expense. What kind of judge goes so far as to be more cruel than the convicted? A judge who abuses power or one forced to such a sentence by a legislature which is cruel and feels these laws would hold in federal appellate courts.

    I’m 29, and up until a couple years ago people used to assume that I was in high school. On the one hand, it was kind of flattering. On the other hand, this was usually accompanied by some sanctimonious lecture on how I was too young to be a mother.

    I think the difference between the older kids and the baby was that the older ones were mobile and could eat solid food, whereas Riley would still be drinking milk and not able to get to food. I also doubt the older kids had ever seen the baby being fed and therefore didn’t know that Riley needed a bottle or a boob (not that it was their responsibility to look after their baby brother).

    Four-year-olds climb. Four-year-olds open refrigerators. Four-year-olds are capable of operating a water faucet, and most of them can open a juice box. A four-year-old would be able to subsist on stoner food for however long it was available, and I can’t imagine they would have any objections to sharing with a younger sibling.

    I’m kind of wondering if the four-year-old might not have been placed in charge of feeding the baby. There was a story on the forums a couple days ago about a nine-month-old drowning in a pool after (or possibly while) being babysat by his three and one-year-old siblings.

My only guess is that the grandmother had a prior relationship with the four-year-old, but that she may not have known the other two. She also might not have felt as if she could handle more than one by herself — assuming she lives alone.

    I apologize. I was harsh. Casey Anthony was acquitted because the state with almost endless resources had not proved its case. The prosecutors were certainly chosen because of both their track record and their knowledge of the law so incompetence was hardly the issue. She was judged by a jury of her peers to be innocent. I am not sure what evidence you or I or anyone who doubts her innocence has that would have changed the outcome of this trial except a “gut feeling” which is fortunately meaningless in a court system unless you are trying witches. Casey Anthony is innocent. There was no punishment because she is legally innocent.

Casey’s mother reported the child missing after not seeing the child for 31 days and noticing that Casey’s car smelled like a decomposing body. Several different test results showed high levels of human decomposition in the trunk of Casey Anthony’s car, as well as high levels of chloroform. Casey Anthony showed no interest in helping search teams find the child’s body. Casey Anthony’s computer showed she had searched Google for “neck breaking” and “chloroform” before the disappearance. She never gave police a straight story and actually had 4 different charges against her for lying to police during this case. PLEASE tell me what innocent person feels the need to constantly lie to police and also has a trunk filled with the stench of chloroform and rotting flesh because I still can’t see how that screams “innocent” to anyone. Admittedly, I’m a little obsessed with studying criminal cases like these and know that people slip through the cracks all the time. Just because a jury found her innocent, doesn’t actually mean she is. The prosecutors just happened to be lacking more crucial evidence like the time & cause of death, and the only reason they didn’t have that is because all that was left of the little girl’s body was bones by the time it WAS finally found. Also, had she been charged with say, negligent homicide instead of murder, she’d probably be in prison right now.

    Sorry I didn’t get back to you, I don’t log on here often, but I looked at why the jury acquitted her and they’re saying the same thing I said. The only reason they couldn’t put Casey Anthony away is because Caylee’s body had decomposed so much that a cause of death could not be determined. That’s what the article said and that’s also what I had said above. The juror who was interviewed for tv even said, “Not guilty does not mean innocent. It does not mean innocent.” “Do I think she’s completely innocent? I don’t have the evidence to say one way or another.” That’s my stance too. So it is a bit unsettling to see people like you claiming that because she wasn’t charged, she didn’t do it. I do not 100% believe she is innocent. The jury does not 100% believe she is innocent. However, just like them I can’t say I know EXACTLY what happened either, but I can say (and already did) that she should have been taken to court for negligent homicide instead because that could have been proven and she could have been charged with that.     Well the juror was wrong. In this country we are innocent until proven guilty. Casey Anthony was not proven guilty. In the eyes of the law she is innocent regardless of a juror’s statement after a trial where the juror, if strongly enough felt, could have caused a mistrial. The juror didn’t and it really doesn’t matter at this point. My guess is that to say otherwise publicly could be the first step to a slander trial.
