Man Free After Confessing To Repeatedly Molesting 2 Year Old Daughter Seattle, WA – Yesterday I reported on a South Carolina man who was found guilty of impregnating his 13-year-old daughter and will only serve one year behind bars. Now we have a story out of Washington in which a man confessed to repeatedly molesting his 2-year-old daughter and a judge let him walk free.

Jason Sherwood was indicted on child molestation charges in 2011 after he confessed to molesting his 2-year-old daughter on multiple occasions. The tapes were made years after the abuse when Jason and his wife, Susan, decided to start taping their conversations as they went through a divorce. ”We would talk and I was very confused, and I think he was dealing with a lot of denial so we started using the tape recorder. We started taping our conversations,” Susan said.

In these taped conversations, you can hear Jason admit to his wife that he molested their daughter. Susan asks, “How many times did you take her out of the bath and masturbate while she was sitting naked on your lap?” Jason answers, “Oh you know Sue, I don’t remember, but it was probably between five to 10 times.”

Jason goes into more detail later in the tape. “So when she was in the bath tub, giving her a bath, I’d touch her and, you know, kneeling down there next to the bath I’d masturbate,” Jason say. Susan asks, ”Were you stimulating her?” Jason then can be heard admitting that he was.

Because of these tapes, King County prosecutors felt they had enough evidence to convict Jason on charges of first degree child molestation. But Superior Court Judge Beth Andrus decided that the confession wasn’t enough and after a short bench trial this year, Jason walked out of the courtroom a free man. “It does seem odd that when a man confesses to molesting his child, a court might not find him guilty of such a heinous crime,” Judge Andrus said about her decision to throw out the case. She goes on to say that she had no choice, as without more proof that a crime actually occurred, her hands were tied.

“We thought we had sufficient evidence to corroborate what Mr. Sherwood said,” said Rich Anderson, Senior Deputy Prosecuting Attorney for King County.  “In this case, the judge didn’t agree.” Susan feels prosecutors mishandled the case.

In court she testified about her daughter’s doctor visit at the time of the abuse. The doctor made note of a rash, wrote a prescription to treat an infection, and even asked if the girl was being sexually abused. Susan says prosecutors should have introduced that doctor’s report as independent evidence of the abuse, something prosecutors did not do. Prosecutors defended their decision not to pull the report, saying that doing so would have been “overkill,” especially since no one was contesting the Susan’s testimony regarding the doctor visit or the doctor’s observations.

While he feels they did nothng wrong, Anderson did admit that this case highlights the need for thorough investigations.

“It does highlight the need for investigations in general involving nonverbal children to really leave no stone unturned and go for every possible corroborating circumstance that might help support the defendant’s confession,” Anderson said. “There’s a natural instinct when someone confesses to a crime to say, that’s what we need, he says he did it. But in order to overcome the hurdle of the corpus delicti rule (body of evidence) you have to have that independent evidence. I would just consider it a reminder to investigators that they really have to go the extra mile when the child can’t say what happened.”

The victim in this story, Bella, is now 12-years-old and has asked that the media use her name because she has done nothing wrong and is not ashamed of what happened to her. She says that her father has apologized for what he did, but that she wants nothing more to do with him. If you read the comments attached to the article I linked to, you’ll see allegations that Bella was not Jason’s only victim.

    Oh, but it’s not just in America. Yesterday I was reading a story about a guy in Russia who had to learn to walk/ speak/ live again and lost a third of his brain, after he stepped in to help some guy that was being beaten in the street by three thugs. Only one of those was sentenced, to a light regime prison and only for a year, the other two were found not guilty because a) they were Russian citizens, b) they were registered at an address and c) they lived at their registered addresses. I will leave you to figure how that works out.

    That judge was actually right. Without independent evidence, any conviction in that case would have not only looked terrible on her record, but would have also gotten overturned in the blink of an eye.

    Blame the prosecutors who thought filing a doctor’s report – true independent evidence – was “overkill”. Imbeciles. Not a strong enough word for how angry it makes me. Prosecutors are often overzealous bastards and none of them are strangers to “overkill”. Why stop here?

    Makes me nervous every time a story like this is posted and everyone scream to lynch the judge or the suspect. I admit I’d want to kill someone who fucked with my kids and from the sound of it the dude needs to be locked up but the people that need to have a fire under their asses right now are the prosecutors.

    Where the fuck did they go to law school that they wouldn’t see the need to add in a DOCTORS REPORT DOCUMENTING SIGNS OF POSSIBLE PHYSICAL ABUSE?! A judge would be irresponsible to allow it to go on on nothing but the word of his ex-wife even with his confession, people do confess to things they didn’t do, people have a guilty conscious for thoughts they had, blah blah psychological shit.

    I have no doubt in my own mind that the sick fuck did what he said he did but you can’t convict on feelings and there was no excuse on their part to leave out pretty goddamn important evidence.

    Why do people think “taking justice into their own hands” is the answer to everything when it comes to cases like this? Now don’t get me wrong, I’m just as disgusted by this “man” and what he did, but more violence won’t change the past. It’s really an immature thought process, in my opinion. I understand the emotions running high and *wanting* to hurt someone because of it, but that would make you guilty of a crime, just like this douchebag.

    Of course, I can already see the replies that will say “this piece of scum doesn’t deserve to live” but you’d be wrong. Remember when our parents or grandparents or whoever would say “two wrongs don’t make a right”? It’s still true…

I think it’s awful that the prosecutors screwed up and he got off with no punishment. It’s a terrible situation. But please don’t tell me how I feel or what I would do.     I don’t know if I’m supposed to be impressed about what you say your grandfather supposedly would have done, but I’m not. I stand by my statement that violence is not the answer. In no way am I defending this piece of shit, but the article says this happened 10 years ago. I think it would have been mentioned if he was suspected of hurting another child. Isn’t it possible he realized what he did was beyond awful, and got help for his problem? As far as we know, he has not repeated his actions, yet there was no violence involved.     Wackos confess to publicized crimes (usually murder) for notoriety; not in a private taped convo with his wife regarding a crime no one knew about. I wouldn’t have taken chances by not including the doctor report, but incidents like this make me completely fed up with the justice system.

    It’s a recording made by the wife in private, not the police with visual evidence and witnesses. There’s no way to be certain it wasn’t somehow tampered with, or that the confession wasn’t made under duress, or any way to tell with 100% certainty that it is the father’s voice. The judge is using common sense…she could have convicted (it sounds like she wanted to), and then I guarantee you it would have been overturned in a heartbeat by his lawyers bringing up some of the very points I just mentioned. The judge was in the right…the prosecutors were stupid to just say, “well, we’ve got enough, let’s ignore the rest of the evidence”.

    People lie about shit for all kinds of reasons. A divorce lawyer once told me about a man he represented whose wife started recording him prior to filing for divorce. This man would have a few drinks and speak terribly to her, telling her, among other things, that he was sleeping with her teenage daughter because she (his wife) was fat. It was a lie just to hurt her. My point is, the prosecutors have a burden of proof. If the defendant said, “Yeah, I just wanted to hurt the bitch,” it’s the prosecution’s job to prove otherwise. That jilted ex’s word alone isn’t good enough. That doctor’s report could have sealed the deal.

All that would have been accomplished by her acting like a mother bear would be her losing her position, probably a lawsuit for not following proper procedure and another judge over turning her decision letting him go free anyway.

    I am willing to bet that if you were close to family (little girl or mother) you would feel differently. For most of my life I have been against the death penalty. That is until Sheri, Gavin, and Garret Coleman’s murder. I knew Sheri and she was as beautiful on the inside as she was on the outside. Knowing what Chris did to her and even more horrifying what he did to her sweet boys makes me want him to fry, and I would gladly flip the switch. Its easy to stand on principal when you have no dog in the fight. If I did not have a wonderful husband I adore, and two great kids I would have taken him out myself. Knowing full and well when on a journey of revenge…dig two graves. As for this mans daughter I pray she gets help and lots of it. I KNOW exactly what she has endured I was just older (5-12) and remember it all clearly. I thought I was over it when I was young. It was not until I was married and in a place of love and safety for the first time in my life that it hit me like a ton of bricks. To be totally honest I sometimes wish someone had taken him out. He never paid for what he did and that makes it harder as the survivor. It really does a number on you when the courts make you a victim yet again.

    Supporting vigilante justice, even in situations where it would truly be just, opens the door for other innocent people to be killed in the name of vigilante justice, just to satisfy your taste for revenge (which won’t fix anything, anyway).

    I understand and actually agree with you. However as I said when its someone you care about all logic goes out the window. I found myself who has been against the death penalty angry that they got rid of it in Illinois right around the time Chris was convicted. I know how hippocritical that is but It’s hard to not want him to fry when you think about the fact that he went into his kids room while they slept and strangled them. When I think about how confused and afraid those poor babies were that their own father was doing this to them. It’s hard to not wish for a painful death upon him. You would not know it from what I stated but I am not a violent person. I have never even been in a fight my whole life. I am just stating that when it comes to those you love, the high ground tends to be forgotten and even if not acted upon revenge can be mighty tempting. At least in Chris Coleman’s case he was convicted. This girl is going to have a very hard time when she grows up if she don’t get help now and stick with it. I pray her family is supportive (mine actually tried to blame me or just thought I lied) The courts have let her down, her parents have let her down. Her life will never be the same and she will feel like she is the only one paying for his sins. Again it is hard not to think that at the very least the man deserves a beating for all she will have to survive. The closer to home it is the harder it is to be objective and logical.

    Yeah I have seen it. I have also remained logical in the face of said tragedies (proof is both my parents have never been harmed by me) I have gotten my revenge though. My revenge is living a great life in spite of everything they did to try to destroy me. My revenge is breaking the cycle of abuse. With the love of a wonderful man who has patiently helped me to realize that I am worthy of unconditional love and and the gift of my children I have beaten the odds. That is my revenge a good life filled with love and laughter in spite of them. (Every once in a while though when I have a flash back, I fantasize about just a couple swings with a bat). ;)

    Lost amidst all the vigilante justice and cries for the judge’s and prosecutor’s heads in these comments is one brave 12 year old girl who has voluntarily opted to have her name made public so the crime committed against her will be remembered. Also for realizing she should no be embarrassed or feel shame for something that wasn’t her fault. Forgiving her father but wanting nothing to do with him as well.

    How many adults could act as mature as she is? I’m amazed. It sounds like mom has taught her well. I hope she goes on to great things as an adult.

    Yes, I wholeheartedly agree. I am surprised that your comment was the first I read about her. She is amazing. I was molested at a young age, and I can remember it well, 30 years later. When I was young, I was so deeply ashamed. My mom had everything to do with how I felt. She didn’t believe us, for starters, and then it was never discussed. When I tried to speak of it as an adult, I got nothing but histrionics from her.

Essentially the persons responsible for this miscarriage of justice is the prosecution. If in fact there was a doctor’s report and they dropped the ball then they should be kicked in the nads. I feel horrible for the baby because no one knows really what the truth is. In one instance the child is being raised by a pathological liar (if the woman did lie) or the child is being diddled by daddy and no one will come to her rescue. It’s a sad situation all around. I sincerely hope that the truth comes out and this child is saved from any bullshit.
