Muslim Judge Calls Victim “Dufus”, Dismisses Charges Against Muslim AttackerMechanicsburg, PA – How I missed this story when it first broke is entirely beyond me.  It’s got everything:  Offensive Atheists, a zombie Muhammad, zombie Pope, a hyper-aggressive Muslim family man and a judge who doesn’t appear to understand the First Amendment.

It began at the Oct. 11 Halloween parade in Mechanicsburg, PA, where the Parading Atheists of Central Pennsylvania were doing their thing.  Mr. Ernest Perce, PA State Director of American Atheists, Inc., dressed up as zombie Muhammad among other inflammatory characters that included a zombie Pope (equal opportunity haters, us atheists).

Before he knew it, Mr. Perce was being attacked by a man obviously offended by the spirited costume.  The man choked him from behind as he attempted to rip his “Muhammad of Islam” sign from him, the audio of which was at least partially caught on video.  The attack was brief and Perce continued to walk until he bumped into Police Sgt. Brian Curtis, who took the report.

Open and closed, right?  No, see… Here’s where things go from bizarre to ridiculous.  The prosecutor settled on a harassment charge and the case found its way to Cumberland County Magisterial District Judge Mark Martin.  As luck would have it, dude’s also a Muslim.  But, that shouldn’t matter, right?

The video was ruled inadmissible (an issue I’m not going to expound upon at this time) and the judge decided it was one man’s word against another’s, as the Sergeant’s didn’t witness the assault himself.  The attacker, Talaag Elbayomy, admitted that his 9-year-old son was present, so he took the opportunity to show him how to whoop up in defense of his prophet.  Elbayomy, an immigrant, also stated that he was not aware that his behavior was illegal.

While ruling in the defendant’s favor, Judge Martin decided to go all Sharia on the victim’s ass.  “Before you start mocking someone else’s religion you may want to find out a little bit more about it; it makes you look like a dufus,” the Judge stated before pointing out that the victim’s costume would have earned him a death sentence in some Middle Eastern countries, as if that’s supposed to matter.

If this weren’t bad enough, Judge Martin illustrates his non-existent grasp on the First Amendment when he says, “…What you have done is you have completely trashed their essence, their being. They find it very very, very offensive. I’m a Muslim, I find it offensive. But you have that right, but you’re way outside your boundaries or First Amendment rights.” Huh?  Never mind.  Just check out the video.

On a side note, Mr. Elbayomy is the luckiest damn Muslim in America, am I right?

Edit: I should point out that, as more clear information comes out, Mr. Elbayomy claimed that the skirmish was merely a verbal altercation and he did not place his hands on the plaintiff, Mr. Perce. That could be why he didn’t understand that his behavior was illegal.

    Hmm … I will not go into legalities here as Athena already has that some what covered, but I will say this : I do not feel any sympathy for Ernest who was actually a victim of his own ignorance.In actuality Ernest is lucky that it was Elbayomy who chocked his stupid ass,and not one of the more extreme Muslims we already have living in this country – who may have bypassed on the choke in favor of a bullet,or a knife to the spine.We have guaranteed  First Amendment rights in this country,this is true – however people should be born with at least a miniscule amount of common sense … common sense seems to be lacking with Ernest – along with the human organ referred to as a brain.

    The prosecution can’t appeal an acquittal due to Double Jeopardy, which protects us from being tried for the same or a similar offense more than once.  In order to get an exception, gross negligence or misconduct on the judge’s part would have to be proven, and while he clearly appears to be mildly retarded, there isn’t necessarily any misconduct.

    True enough,however it is also true that this country was built on among other things – “Brute force”.It is also true that we do not live in a fair world,and that simply having the legal,and or constitutional right to an action does not in fact relieve each and everyone of us of our burden of common sense in applying those legal freedoms.

    Bottom line the jerk-off victim in this case went out looking for trouble – to say otherwise indicates a person of very limited intelligence – so I for one will not rush to his defense screaming and hollering “FOUL,FOUL,FOUL !!!” ,however I do acknowledge that the so called victim did in fact have a legal right to the bad taste,and stupid actions he chose to display.

    I will never stand up for ignorance,especially extreme ignorance,but I will always stand up for truth.

    I think what you are getting at JGo555 would most likely be best served by a misconduct complaint on the judge, which would be directed to the state or federal board that oversees judges’ conduct.However – Judicial conduct organizations are set up only to ensure that judges are competent and fair, not to overturn decisions.

    I get that.  I really do.  Don’t start none and there won’t be none.  But, the bottom line is that we have the right to be inflammatory without fear of physical retaliation.  Besides, zombie religious figures are fairly common Halloween costumes.  I’ve seen zombie nuns, zombie Jesus, zombie monks, etc.  None of these images should provoke physical violence in response and, typically, they don’t.  If a religious person cannot find in themselves a sense of humor, they should at least find a sense of moral superiority, which means not attacking those who offend you.

    No, you’re right, he did.

    However, the 1st Amendment allows it.  We are a country of “free speech”.  It’s within the scope of the 1st Amendment what the “Zombie Muhammad” had done, he had done it legally.  It doesn’t matter if he goes out of his way to offend someone. 

    The Pope and other religious leaders go out of their way to “Offend” non-religious people all the time!  Not counting ACTUALLY effect peoples lives that don’t believe in what the religious community does!  One Example; Birth Control.

    Saying “I’m the Muslim Prophet Muhammad” physically affects NO ONE.

    I do not think that The Pope goes out of his way to offend anyone.As for the birth control issue you mentioned – I don’t understand what you are getting at.If you choose to use birth control then you can legally use it – the fact that the Catholic church does not approve is not going to bother a non – Catholic one freakin bit,or affect their lives.

    lol Figure since Mechanicsburg is sorta near my neck of the woods I figured that I would add some shit here that is being spoken.

    1. The video was not allowed to be used in court due to it being doctored. 
    2. Other people who were at the parade have actually said that events did not happen as the vic said they did.
    3. The Judge did not say that he was Muslim. It is said that he stated “I’m not a Muslim and I am offended.

    Now a question for admins/mods. Since some newspapers from here are not placed online(or don’t print all their articles online) if I were able to get a scan of one could I post it?  I do know that at least one paper from that area that is reporting this story and had the above facts is not online.

    What I find funny is that this all happened in Dec and it only made the news now because of a blog.

    I’d love to see what you’ve got.  Major news outlets are reporting that Judge Martin is a “recent convert to Islam”, that the video was inadmissible because it was ruled inconclusive (no word of it being doctored) and there has been no mention of conflicting witness statements.

    It’s also being reported that the judge threatened Mr. Perce with contempt if he released the courtroom recordings.  Perhaps he waited to do so in order to confirm whether or not he could, in fact, be held in contempt.

    Yes he may have been threatened with contempt. I may be wrong..but I believe that here is PA you must have the permission of the judge to record courtroom proceedings. Even the high profile case like the cop killer from Pittsburgh a few years back didn’t have camera’s in the court (at least as far as I recall)

    Gonna add I have about as much respect for Atheists like Perce (He’s a fucking prick who does some pretty fucked up shit) as I do for Evangelical Christians and any person of any religion who believes that their personal religious beliefs are the only correct one and therefore feel a need force their own beliefs upon others. Honestly who the fuck cares what others believe or what if any deity/deities that they worship.

    Agreed. There will always be someone looking to make fun, provoke, irritate those who are believers in a higher power. If everyone choked up someone who pissed them off for going against their belief system then we would all be in trouble for something regularly.

    As I understand it, the judge did give him permission to record the proceedings, but told him that if the recordings were made public, he could be held in contempt.  Which doesn’t really make sense to me, but neither did a lot of what the judge said.

    In the months after 9/11, I was at the mall one rare day when I witnessed a large black woman (wearing a cross) rip the hijab (or head scarf) off the head of a Muslim woman while yelling at her that she was in America now and didn’t have to wear that shit anymore.  Everything about it was odd.  If she were doing that for the Muslim woman’s benefit, why would she yell?  Either way, my nosy ass rushed over, picking the scarf off the ground and handing it to the terrified woman.  Then I explained in my best “I’m not angry, just very disappointed” voice to the aggressor that what she just did was no different than me ripping the cross from her neck.  I don’t think she got it, but I tried, damn it.  At least, I humiliated her in front of some passers-by.

    At many abortion clinics across America there are religious people outside trying to stop people from going on or having photos or aborted fetuses and handing them out. That is forcing ones beliefs on another person.

    Are you implying you would be okay if a Christian told you what you can say, think, draw, or wear? In my opinion, this story is more about a person with a certain belief (judge) agreeing with another person of the same belief (attacker) and disregarding the US law. The fact that they were Muslim is really of no consequence other than when people say “Muslim,” it incites rage in our culture because it is a minority group.  I bristle when our political leaders try to impose their religious values on everyone because it has no place in our courts or government.  

    The judge really should be disbarred, not because he is Muslim, but because of his blatant disregard of the US constitution.

    I know the rape ideals of the rapist marrying the rapee weren’t originally intended as we see them today.  “Omg! He traumatized her, and they make her marry him?! that’s fucked up!!”

    From my understanding of the laws/rules regulating that way back when, women were (and still are in some circumstances) seen as property that is owned by her parents until she is married off.  A non-virgin has negligible value, and isn’t like a son who can hold down all the jobs/and own property, a virgin has value.  So a rapist literally “steals” the value of the daughter away, and unless he pay’s the family a fee and marries the daughter, the daughter becomes a burden on her family, she’s unmarry-able by anyone else…because who wants a woman that’s slept around?

    The original laws were intended more for protection of the assets the family had lost with the deflowering of their daughter.  It was intended as a law protecting the family of the rape victim, along WITH the rape victim, to ensure she could be married and have someone to take care of her, and a punishment on the rapist by fining him and forcing him to marry the “goods” he damaged.  The logic sounds messed up, and I’m sure I don’t explain it accurately…some website somewhere can explain it better.

    The key word in the above sentence is the word “right” … if that person has a legal “right” to “not” sell – then that is their “right” like it,or not.

    The major difference here is that although the woman in the short skirt may have selected her outfit because she did in fact desire attention,and felt the outfit in question looked good on her – if she is in fact a “rape” victim she never sought out sex with the individual,or group involved in the rape.

    It can be intelligently argued that Mr. Ernest Perce did in fact select his outfit,not because he felt that it looked good on him,but in quest of anger and attention from select individuals,or a particular group.Which is exactly what happened.

    I can’t argue against the “father’s permission”, or even add insight, I never looked that deep into it.  Curiosity just got the best of me when I first heard about some woman being forced to marry her rapist.

    You angle it at 16 for girls, and left the boys off.  Just ensuring you know up until the age of 18, without emancipation, a boy “belongs” to his parents, as well.  The laws may not be followed to a “T”, but sex with someone under the age of 18 for either gender can still be prosecuted as statutory as long as the elder one is passed a certain age gap difference.

    The judge isn’t a Muslim, he’s a Lutheran.  He didn’t dismiss the case because he believes it’s okay to assault someone who offends your religious beliefs, but because there was insufficient evidence.  He lectured Mr. Perce because, having served tours in Iraq and Afghanistan, he had first-hand experience of how offensive many Muslims would find a “zombie Mohammed”.

    However if he’s trying to stand behind the “Religious Defamation” resolution passed by the U.N. a few years back, it’s in clear violation of the US Bill of Rights and the Constitution, so it doesn’t even matter.  Again, the judge is out of place.

    I was in the Marine Corps for 5 years, I did my time in Iraq.  I figured since I was protecting the Constitution of the United States of America against all enemies foreign and domestic, I may need to know what it says.

    As for the judges opinion, it’s biased and shows nothing more than his coercive abilities to make someone be subjected to his religious ramblings, under fear of Contempt of Court.

    Proves Mr. Perces actions were in clear violation of the “Religious Defamation” resolution.  However, going back to the original quote from the 1st Amendment of the Constitution of the United States of America, we see: “Congress shall make no law respecting an establishment of religion, or
    prohibiting the free exercise thereof; or abridging the freedom of
    speech,”
     

    Therefore, again, the judges opinion isn’t just out of
    context, it’s out of line, and a forced lecture, against Mr. Perce’s will.   One mans
    religion doesn’t trump anothers free speech.
