Police: Woman Jumped To Her Death Fleeing From Angry HusbandDOUGLAS, MA – Police say a woman jumped to her death from a second-floor window while trying to get away from her raging husband and now he’s been charged with manslaughter.

Last Thursday night, 44-year-old Lisa Stilkey and her husband, 40-year-old Alan Stilkey, got into a heated argument. During part of this argument, Lisa was on the phone her son who said he heard Alan yelling, “When you get off the phone, I’m going to kill you.”

A short time after this phone call, Lisa threw a pillow out a second-story window and then followed behind it. It was not a smooth landing. She suffered severe injuries from the fall and was pronounced dead at the hospital the next day.

Alan, an arm wrestling champion, has been charged with manslaughter, assault and battery and threat to commit a crime. He has pleaded not guilty.

I don’t see anything in the article to substantiate the manslaughter charge, maybe they have it – if so I would like to know exactly what this asshole did.

  • reapre

I don’t think it was based of direct consequences, more off indirect…IE, she was terrified enough that in her attempt to flee his continuing pursuit led to her (untimely) death. Not that any of his direct actions led to her death.

Just my guess.  I’m sure they’ve a reason for the charge.

  • Lena60

Threatening  another with death, them trying to escape and ending up dead anyways, fall onto the shoulders of the person who threatened in the first place. As an example, If I threating you with a gun, then in your haste and panic to get the hell away from me ran into oncomming traffic and got killed, that would be on me.But of course Ced I like you so would never threatening you with anything. :)

  • Josh

What would substantiate it? Doesn’t sound like they were in debate class to me.

  • Lena60

Iam sure big burly boy here has threatened and abused her before. She probably thought she would come out of this with a broken leg. :(

  • CT

What?  She didn’t want to celebrate Valentine’s Day either?

On a serious note – wow, to jump out a window?  She really needed to get away and fast to do something along those lines.

  • Andy P

I wonder if the corroboration they need is the testimony from her son regarding what he heard, I.E., “When you get off the phone I am going to kill you.”  Even though his direct actions didn’t cause her death, his threats and indirect actions did, likely making him culpable.  Damn all kinds of big words coming out of my mouth today.  LOL

  • Josh

Just dying to get out of there…

  • http://tothechest.com Pete Puma

If you jump out of a second story window and die from it, Darwin needs you dead.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

I get you but seems to me that legally – if this were all they had – then they would have a much better chance of pinning a suicide on this jerk as a manslaughter charge.

  • Evan Oswald

i wonder what she did to piss him off.  i wouldn’t ever piss that guy off.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

Thank you – I like you a lot too Lena, but I still say that there is no legal probable cause in this short article to substantiate that charge, and it’s not that Morbid left it out either – this is really all the press has on the story at this time.

  • http://www.facebook.com/people/Shannon-Bennett/1803988499 Shannon Bennett

She must have landed in the most retarded way possible to die from the fall … I couldn’t imagine how it would feel to be so scared that I would jump out a window and I hope I never do.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

You need a direct action Josh – all I see is indirect.Let’s look at a simple definition for manslaughter – “Homicide without malice aforethought”. I don’t get this from the article.

  • JohnQknowitall

    Admittely from Wikipedia, but:

Constructive manslaughter (http://en.wikipedia.org/wiki/Manslaughter)Constructive manslaughter is also referred to as ‘unlawful act’ manslaughter. It is based on the doctrine of constructive malice, whereby the malicious intent inherent in the commission of a crime is considered to apply to the consequences of that crime. It occurs when someone kills, without intent, in the course of committing an unlawful act. The malice involved in the crime is transferred to the killing, resulting in a charge of manslaughter. For example, a person who runs a red light in their vehicle and hits someone crossing the street could be found to intend or be reckless as to assault or criminal damage (see DPP v Newbury). There is no intent to kill, and a resulting death would not be considered murder, but would be considered involuntary manslaughter. The accused’s responsibility for causing death is constructed from the fault in committing what might have been a minor criminal act.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

“threats and indirect actions ” – do not meet the probable cause for that offense.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

Or maybe she thought her ass would land comfy -like on that soft pillow. From past conversations on here I know that a lot of people think it is almost impossible to die from a second story jump;they bring up “controlled jump”,and things like that;maybe she did just think – “broken leg”,unfortunately for her the odds are that she landed on her head/neck.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

I know it’s not important for “us” to know, but I really wish I knew exactly what she did to set Mr.Champion Arm Wrestler on boil over.

    LOL

  • warbonds

This POS needs to get his wrestling arm snapped off at the elbow, and crammed up his ASS.

  • Josh

The chronic douchebag syndrome she was living with finally did her in.

  • warbonds

Was he still competeing ?, could it have been “ROID RAGE” ????

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

John I almost – but not quite – know that paragraph by heart;it is all correct, but you do not have a direct action listed in the article like the running a red light example used here – the running a red light example does in fact establish a clear probable cause for a manslaughter charge – due to the fact that it can be proven in court that a person who intentionally runs a red light does so knowing full well that their action could possibly kill or injury another person, and they knowing that still made a choice to proceed with the action.

  • Josh

What about involuntary manslaughter? MA law defines it as unintentional killing from battery.

  • JohnQknowitall

Son heard raged husband tell wife he was going to kill her.

Short time later woman leaves through 2nd floor window and not the front door.

    Woman dies.

I am not a lawyer, but these three facts sound pretty compelling. We shall see.

  • JohnQknowitall

I think she thought the consequences of jumping would be nothing compared with staying in the apartment with her “burly boy” raged husband.

  • http://pulse.yahoo.com/_YNI5RQEBPVZAO34MRQJZPGUGKI Vicki

I’m thinking she was in another room and enclosed herself in or possibly locked the door.  She felt trapped and when he started to beat the door down she felt she had to get out or be killed.  I think if that’s the case then he should be held liable.   She was going to die by his hands or die trying to escape.   I guess she must have felt fleeing was the best chance she had at survival.    I guess we need to wait for more details.

  • warbonds

Damn Ced, your a para legal/lawyer ? Drop that knowledge bomb !!

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

That would possibly be a better charge – depending on what exactly happened with Lisa and Alan.Basically involuntary manslaughter is an unintentional killing that typically results from recklessness.

  • Andy P

Nah, I think Ced used to be a cop though, so he may know more about what’s required than we do…

  • Andy P

Yeah but sometimes things that don’t meet the “clinical” definition still squeak through.  It will be interesting to see how this plays out.

  • EveryVillainIsLemons

He sounds like the type of guy who gets angry at the drop of a hat.  I doubt that she did anything to piss him off, but I’m sure that whatever she said didn’t help to ease his temper fit.

  • PlaysWithBalls

So bad, and I laughed. Damn it!

  • EveryVillainIsLemons

Why are you blaming her for his temper fit?  It’s entirely possible that he was pissed off about something else and opted to take it out on her instead of dealing with it like a sane, rational human being.  Whatever she said obviously didn’t pacify him, but that doesn’t necessarily mean that his initial anger was her fault.

  • kimbev69

A woman that backended a guy on a bridge in detroit was pulled out of the car and threatened by the man with a tire iron until she saw no other way out but to get on the other side of the railing when she either fell or jumped to her death he went to jail and there were alot of people watching this

My thoughts on this is can they prove she jumped or that all the injuries were frOm the fall

  • http://www.facebook.com/people/Shannon-Bennett/1803988499 Shannon Bennett

With all the other cases out there I sure hope it’s not contagious!

  • kimbev69

I think she may have been assisted out the window

  • Josh

Seems to be by injection only… =)

  • http://twitter.com/AngelsMom0806 Angels Mom

If we’re talking about the same story on Belle Isle he actually was beating her (Deletha Word) and ripped of some of her clothes and she jumped to escape him. He was a hug man, like 300 lbs.

That was such a sad event.

  • reapre

“My thoughts on this is can they prove she jumped or that all the injuries were frOm the fall”

You’d be surprised what those coroners find, and what injuries they can prove happened before major trauma, like “he died on the first shot, but was shot 2 more times after death..” like, how the eff do you prove that? besides the blood loss/pool, but if the wounds are face down to the ground, wouldn’t it all seep together in one large pool making them all appear to be bloody, anyway?

but to answer you…I would think sometimes they can, sometimes they can’t.

  • http://www.facebook.com/people/Shannon-Bennett/1803988499 Shannon Bennett

     Ha!

  • Babydoll0630

She shoulda had a stun gun or some pepper spray.  womenonguard.com carries A LOT of supplies to protect ourselves.  So, I’d try stun gun and some mace before jumping..ya, jumpin would be last.

  • kimbev69

Yes same story, my sons dad grew up in detroit and i recall this on the news, what a frightening thing to happen

  • kimbev69

    So sad for the woman

  • kimbev69

I agree even though we used to jump off garage roofs all the time as kids

  • LeaveMeBe

You are so bad for making me laugh at this. Now I feel terrible!

But you know, that’s why they put fences around cemetaries too. People are just dying to get in.

  • Andy P

Here’s what I want to know – according to the video (at the end) it says he took out a life insurance policy on her (like two weeks prior).  (1) – is that enough time for him to collect anything on her death, and (2) if he is found at all liable for her death could he still collect it?

  • Rydo Larsson

Lets see if he can arm wrestle his way out of that one !

  • http://twitter.com/KillerPrompts Killer Prompts

The pillow will save him, I think, because it’s proof that she planned to voluntarily jump out the window. Arguments don’t make people jump out of windows, but stupidity does. You have to be really stupid to think a little pillow will save your life.

  • http://profiles.google.com/coldlogic HAL 9000

I gotta wonder. Who waits for somebody to get done with their phone call before they kill them? Really? Sounds like irrational semantics more than anything else.

If I had tape recorder for half the lovelies my lovely shares my way when I’m less than lovely (like Drunken Boyz Night, or Drunken Football TV Gamez, etc.) I could put her away for many moons by this standard. Which eyeball gets the screwdriver type-shit – my girl’s hot both ways so I’m thankful and fearful in equal measure. So I say to little boys, play with fire! Its fun! But don’t take it literally.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

That would be fucked up … would explain somethings though.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

I REALLY LIKE THIS A LOT.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

You read too much into my comment – I never said that I blamed her for anything.I said that I would like to know what she did to set him off – meaning why was he upset at her ? Say what you want, but it’s pretty clear to me that he was upset at her for some reason.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

I saw that video – what was sad was all those people out there watching, and no one attempted to help that lady;they all just watched.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

That lady jumped – she let go … if I remember right she had a little girl at home who was maybe 3 years old.The thing is watching the video she let go because she was terrified of that big stupid guy who attacked her. That whole deal pissed me off.

  • hershey

Yes, but the son heard him say that he was going to kill her when she got off the phone. Therefore, his actions contributed to her death.

  • hershey

I’m not sure about the length of time to collect, but if he is found liable, no he won’t collect a penny.

  • hershey

Wasn’t it about a year ago that 3 college students jumped out of a 1 story window and two died? It’s all in how you land and what you hit on your way down.

  • hershey

Probably not since a pillow preceded her, but who knows?

  • hershey

He threatened to kill her. Sounds malicious to me. Even if no one heard that, what if objects in the house were strewn about or the door she was behind was broken or hand holes punched through it, would that be considered in contributing to her death and, therefore, manslaughter?

  • kimbev69

I was thinking about the pillow, if u were fleein out a windown that fast would u throw the pillow first then jump seems weird

  • kimbev69

Wow thats extremely sad and weren’t there people cheering it on? Or am i thinking of a law and order episode

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

You make some of the best comments sometimes HAL.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

Possibly  involuntary  manslaughter … but if it’s like kimbev69 thinks and he “assisted her out the window”,manslaughter. It just seems overly clear to me that from the little that’s been released so far by the police – they know a lot more than we do at this point.I’m sure if they actually go with manslaughter they will have what it takes to make it stick. My prediction – this jerks going to the penitentiary.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

How many times have you ever heard of someone throwing a “pillow” out of a window they intended to jump from ? This lady was very original with that one – the closest  I can recall something like that was in cartoons, and it didn’t work out well there either.

PS – If any of you women on here are ever faced with a similar issue please try to remember that removing the bed sheets and tying them together works much better than snatching a pillow and hurling it to the ground.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

I was referring to that article when  I mentioned people who think it’s rare to die from a second floor jump. What you say is true, but also factor in that the human body is not equally balanced – we are top heavy (some more so than others),in a fall if the body has time it will naturally end up head end down unless the person somehow is able to alter this before hitting the ground.

  • http://pulse.yahoo.com/_XKMAEMPVJ5T2Y35HKYTNG7I6SY Cedric

No,there were some people cheering it on – like it was a damn concert or something … then the lady ended up dead.

  • http://twitter.com/AngelsMom0806 Angels Mom

Angels Mom, thanks so much for posting that. “Dozens of people, after all, were at the scene—surely someone else would intervene. Behind Tiffany, other cars stopped around the station wagon and the Monte Carlo. Bystanders formed concentric circles of shock and horror.”  We’ve talked about Genovese syndrome before, and here is another example of it. I can’t believe I’ve never read this book before. It’s time for a trip to the bookstore.

This would be the same type of situation if she ran into the street trying to get away from him and was hit by a car. Although the car killed the woman, she wouldn’t have run into the street if he hadn’t chased there.

The window may not have been open before she threw the pillow — but it sure as Hell was after. That has me wondering whether she threw the pillow through the window to clear the glass before she herself jumped, thinking that breaking the glass with her body would slash her to ribbons.

As he mentioned he would kill her and there is a witness I can understand why he is charged with manslaughter.  Very sad.  I knew a girl in college that we saw injuries from her abusive boyfriend beat her and even witnessed one time (as she lived on the other side of the dorm) where she pulled out the screen and tried to jump out the window to get away from him but he pulled her back in to beat her more.  If we had not got there in time, she would have jumped and dies from the 7th floor window,  I would have testified against him and pressed for the maximum. Thankfully, she was done with that bastard after that

  • onlyme356

She obviously knew what he was capable of.  Poor lady, he must’ve hurt her so many times.

  • Songdancer

why didnt the other people help her, he was huge but there had to be a few men in that crowd, very sad, he went to jail but does anyone how long? Situations like this want me to learn how tiny policewomen can take down a man hundred lbs larger than them, so if some asshole attacks me, I can defend myself. cant believe no one got a tire iron out or ran over him with their car to help her. Cowardly bastards, but then I dont live in Detroit either so there may be something Im missing.

  • Songdancer

Is the video still out? and if so how could I go aBout finding it?
