Man Shot And Killed By Neighbor In Dog Poop DisputePhiladelphia, PA – Franklin Manuel Santana was shot and killed by a neighbor this week in what police are calling a long-standing dispute over dog crap.

Based on what police and neighbors are saying, the alleged gunman, 27-year-old Tyrirk Harris, has been allowing his two dogs to roam the neighborhood unleashed for months, leaving neighbors to clean up the foul packages the Chihuahua and German Shepherd left behind.

Apparently fed up, Santana confronted Harris just after 4:00 Tuesday evening. The two had words, and at some point, Harris pulled a 9mm out of a holster on his hip.

After a brief struggle over the gun, 47-year-old Santana lay dead on the sidewalk. Police say Harris fired multiple shots, striking Santana in the face and chest, and twice in the neck.

Harris, 27, was arrested on scene. He’s been booked on charges of murder, firearms violations and possession of an instrument of crime. According to investigators, Harris, a former school police officer, was, at one time, licensed to carry a gun but the license may have been revoked.

Santana leaves behind a wife and newborn daughter.

    I dunno… The victim started the confrontation, and there was a struggle for the gun? There’s a chance the shooter really was defending himself. Letting his dog crap everywhere doesn’t say much in his favor, but I’m reserving judgement until there’s more details about where this went down (on the shooter’s property would lend credibility to self-defense) and just what happened. If someone brandished a weapon while I was confronting them about this, I would suddenly realize that dog crap isn’t really a big deal and back away. A struggle may mean the victim advanced on the shooter.

    A friend a couple of streets over from me was just telling me a story about a guy whose miniature pinscher would get out of their yard on a daily basis, and crap in another neighbor’s yard. The crapee confronted the owner about it numerous times, only to be told “It couldn’t possibly be my dog, he’s always in my backyard.”

    Eventually the crapee got fed up and shot the dog. When the owner confronted him about it, he told him it couldn’t possibly be his dog, his dog was always in the backyard.

    I completely agree, I think I was under the impression that the shooter is the one who said the victim was reaching for the gun, which I would assume was a lie to get out of shooting someone dead for no good fucking reason. If a witness said that, then that’s different. I think it also makes a difference as far as who reached for the weapon first, but in any case, thank you for encouraging me to be objective. :-) I will also wait for more information on this one. I guess I’m just so used to people being assholes I’ve forgotten how things go sometimes.

    Got curious, read a couple more articles. Some don’t say anything about a struggle, but one quoted a neighbor:

    “‘I (saw) them arguing, then from there a little scuffle,’ neighbour Miguel Rivera told the Philadelphia Daily News. ‘Then I heard the shots.’”

    Also, the shooting occurred on the shooter’s porch, and it was the victim who initiated the confrontation.

    We had a neighbor in our old neighborhood who had 3 chihuahuas that they’d just turn loose, unattended, out the front door every afternoon and evening, even though they had a wonderful big back yard just like the rest of us. Those dogs would run up and down the street, barking at people in their own yards or garages like they were going to chew our ankles off and they would poop anywhere but their own yard. Many of us tried to talk to the owners about the situation, but in my case there was a language barrier with the two adults in the household, so I could only talk through their three children under the age of 7. Eventually, I would just watch for the little suckers (the dogs, not the kids) and chase them around with my broom and land a few gentle swats on their behinds because, dammit, I was not going to be bullied by them in my own yard! I also would go and pick up their piles from everywhere and the next morning on my way to work I would stop at the end of the street and dump the poop on the owners front porch. After a few weeks of this, the dogs weren’t let out front anymore and the only time we saw them would be when they accidentally escaped through the front door. It wouldn’t take long and the kids would be out hunting the little varmints and apologizing for them bothering us. I never thought of shooting the dogs. The owners, yes. The dogs, no.

    I let my dog go wherever she wants, generally because we have a lot of trails and woods.

    Once I was taking out a family members dog (she’s huge) she went and took this massive dump right at the bottom of someones porch steps. I felt bad for a moment, and then I thought about how I had always wanted to light one of those flaming bags of shit on fire, but society is all “Wahh, don’t do that..Not good for the enviroment, possibly set someone and their house on fire”..Blah blah blah, so I went with the next best thing. It helps that they’re assholes.

    (Yes, I am laughing right now, at least if they ever caught me and shot me, I would die laughing.)

    He had it on his hip in his own home. Of course, if he hadn’t been armed, he would never have been in a position to have felt he was in mortal danger (if he hadn’t brought a gun into the situation, the other guy couldn’t have grabbed for it), and he would never have shot someone.

    This is why I don’t think most people should have guns. They escalate far more situations than they resolve, and accidentally kill far more innocents than they defend. A taser can fill the same need for defense, without bringing a lethal instrument into things. The only drawback is that tasers don’t make men feel all macho likes things that blow holes in people do.

    No Lena, I hadn’t heard that one but it would be my luck that would happen to me.  My ex and I went to the beach a couple years ago with some friends and we brought the dogs.  I don’t know how many lbs these Great Danes were but they shit a turd the size of my arm.  Hell you might even need extra large shit bags for those dogs.  I wonder if it is their size that contributes to a young life expectancy.  Isn’t it around 8 years for a Great Dane?  If so I bet my Min Pin lives to be 20.  LOL

    Something like this happened to my dad, but he loves animals. He’d never shoot a dog. I think over a period of a week give or take a few days he started scooping the poop (we had a Pooper Scooper from our dog that died) and just walking the shit down a few houses and depositing it into the responsible neighbor’s yard. Luckily no one started waving guns around. That neighbor moved ASAP. Rental house. I rented apartments for 15 years so I don’t want to say anything but all the people renting that place have been total trash.

    If you pull a gun on a Jehovah’s witness, #1, none of us would blame you, and #2, if they try to take it away from you and you panic and start pulling the trigger, they hold some responsibility for that. But this wasn’t someone proselytizing, it was a pissed off man whose rage had been building for quite a while and who started shit.

    The shooter holds some responsibility, because he had the gun. But he was on his own porch, a perfectly legitimate place to have a gun. He didn’t take it over to the other guy’s house. When he first pulled it out, he was probably just being a macho jerk, but once the other guy tried to take it from him, he can make a good claim that he felt he needed to defend himself.

    It’s involuntary manslaughter, perhaps, but not murder.

    I’m the exact opposite. My dog has a spot for that in my yard, and that’s where she goes. We don’t go for walks until after she’s gone, and she’s generally not allowed to even pee on other people’s property. I know pee’s not considered as offensive as poo, but either way, I feel it’s rude to let my dog do her business on someone else’s lawn.

    Some people tell me I’m too strict with my dog, but within a few minutes of saying that, they are always commenting on how well-behaved she is. I would rather people think I am uptight and my dog is well-trained than have them think I am cool and my dog is a heathen.

    I figure if the shooter pulled it on him, and then there was a struggle, then that’s one thing. But if the guy was attacking the shooter or reaching for his gun, without the guy actually pulling it out, that’s quite another. I can’t even form a clear opinion right now with the info that’s out at the moment. Who knows what the hell really happened. There’s only two people who really know, and one of them is dead.

    I gotta agree with that as well, once the threat is eliminated, it’s time to stop shooting. Cases like this can be confusing as far as forming an opinion goes, even the ones where people shoot home intruders. Those can be more clear cut but people get charged sometimes even when they were the victim. People need to know who they’re fucking with.

    He fired six shots at very close range, only four connected. I’m guessing he pulled the gun to be a badass (maybe he felt genuinely intimidated by an enraged neighbor, but the kind of guy who carries a gun is usually the kind who will use it to bolster his machismo, and I’m not inclined to give him the benefit of the doubt), the other guy doubted his badassery and grabbed for the gun, shooter panicked and started pulling the trigger. Someone who grabs for or otherwise attacks someone who is holding a gun is not acting rationally, so I could see being scared at that point.

    Nothing wrong with asking a neighbor to stop their dogs from pooping in your yard. The victim had already done so several times before. Which makes me think that by this point he was done with politely ‘asking’ that it stop- he was pissed, and started an angry confrontation. Not saying he deserved to get shot over it, but if you start screaming at someone and they pull a gun on you, you should probably walk away, not try to take it away from them.

Doing anything else, especially since kids run around the neighborhood, is just rude. I’ve taken people to task in a slightly rude snarky way when I see them.      The victim, an older gentleman, was probably believing he was doing a younger person a favor, by not involving the authorities and then is wasted for his troubles! I’m sure there is a huge demographic of young, disconected, gun toting wanna be cops who won’t sustain their own animals that could see this as a misunderstanding. This same demographic would argue, ‘but it’s only murder’ or some other nonsense. The bottom line is this guy doesn’t care about his dogs and there was no way he cared for his neighbors.     There’s a huge difference between a neighbor politely asking you to stop something annoying, and an enraged man on your doorstep yelling at you. He didn’t ask nicely, he went over there and started an argument. Not that I blame him one bit for being pissed, but when he saw the other guy had a gun, he should have LEFT. And someone who was in a rational state of mind WOULD have left. The fact that he didn’t tells me he was not rational, he was PISSED.

    If you show up enraged and irrational on someone’s doorstep, don’t be surprised if they pull a gun on you. If you try to take that gun away from them, don’t be surprised if you get shot. If the shooter later says “This irrational, pissed off guy tried to take my gun away and I panicked and started shooting,” don’t be surprised if he gets off easy for it.

    I’m thinking this guy, Harris, being a gun-totin’ ex-cop, was probably a neighborhood bully.  He probably didn’t have a second thought about shooting a new neighbor that had just moved in the area.  If you ask other neighbors, they’ve probably had problems with him too, but he might have intimidated them or something.

    I hope that Mr. Santana wasn’t shot simply b/c of being Hispanic.  That poor family has lost a husband and father b/c some asshole can’t clean up his dog turds.  It would be nice if they could put him on some shitty prison detail, but if he’s still a bully in prison, he will either be killed by some other inmate or he’ll be at the top of the food chain.  I hate bullies.

    I wasn’t referencing that part of the news report to garner sympathy for the victim, however now that you mention it, it would probably be a normal reaction.

    I mentioned it because you stated this was probably the result of a “rage that had been building for quite awhile”. A couple of months wouldn’t qualify as a long simmering rage. Even if we suppose it was sufficient, and the shooter had reason to fear the unarmed man, why hadn’t he contacted the police prior to this encounter, although I guess why would you if most days of the week you were walking around carrying a gun you weren’t licensed to carry anyway.

     I can’t find any video of the victim racing over to the shooters residence enraged and ready to tear him limb from limb either, so I’m not sure how you’re so confident that this is what transpired. By all means if you have video like that, please link to it.

    Strangely enough, I do feel sorry for the victim, and no, I guess that doesn’t mean you have to as well.

    I disagree.  Ever since I’ve first become accustomed to any kind of firearms I’ve learned the 4 basic safety rules;
    1) Treat EVERY weapon as if it were loaded,
    2) Never point a weapon at anything you do not intend to shoot,
    3) Keep your finger straight and off the trigger until you are ready to fire,
    4) Keep your weapon on safe, until you intend to fire.

    Harris, being an ex-peace officer (of sorts) that was licensed to carry, would’ve had many, MANY hours into the training of his weapons, and would know the laws and rules regulating their brandishing.

    With that being said, and always having been aware of the 4 weapons safety rules, I would attempt to remove the gun from Mr. Harris’ possession as well if he had pointed it at me.  I can’t see myself putting myself in a situation as such, but when a firearm of any sort is pointed at you, the feeling you get maybe fear, and it also may be impulsive self-preservation.  My own personal training has taught me to remove the pistol from the equation if it’s within arms reach.  I believe he pulled the gun as an attempt to intimidate.  (my thoughts come from this written point in the article.)

    When a spring loaded pistol is use in CQB, a big handicap with the weapon is the slide.  If the slide is impeded at all, (the part of the gun that Santana WOULD be grabbing before, during and after the firing had started) the brass won’t eject and the pistol won’t seat another round properly, or even at all.  If the late Mr. Santana reached for a spring loaded pistol and actually grabbed it at any point before the first round went off, or second, or third, 4th, 5th, 6th…, Harris would’ve had to re-sling the slide to seat another round.  One round, is almost always sufficient to stop forward progression of an assailant when the round hits the head/neck area, or even in the center of the chest.  Since 1 round entered his face, 2 in his neck, and one in his chest.  I’m feeling Harris tried to do a “box-drill” on him.  (2 to the chest, one to the face).

    I don’t believe this was self defense.  I believe it was an attempt at intimidation and bullying, and he murdered a guy that stood up to him.

    Yes, the life expectancy of dogs decline the bigger they are. I was just discussing this with the hubs after visiting a pet stores. Ironically parrots, the bigger they get the longer they live & the bigger animals in the wild are, the longer they live too.

    Great Danes lasts around 8-10yrs.  The suffer from hearing problems, eye sight (they go blind & deaf),  they can get twisted stomachs & have joint problems & hip displasia (these last 3 things go for big dog breeds).

    I could understand the shooting if the sniff doggie poo poo owner was the one who were shot. However, I think, a better resolution could be satisfied by the invention of a gun that shot doggie dirt. One could make millions! Specifications would be a bit tricky… a gun that shoots both soft and hard poopie, shoot over houses and maintain the the original shape as to hit the target, and one that can be equipped with a silencer (NO FART PUN INTENDED.) I speak from the bottom of my shoes after many unpleasant walks to my curb side mail box.

    Honestly Jgo, I think I do have a bit of dislexia.If there is a type that comes and goes then I have that one.  I also got a new key board  and iam typing more letters then I intend. :)

    I don’t much like cats – they lick you and their tongue is like a fucking SOS pad,they walk between your legs when you are walking – an obvious attempt to trip you up,they at times make a noise which sounds remarkably like a human baby – and let’s not forget all the old stories about them sucking the breath from babies – cats are pure fucking evil.

     Have you seen the video of the LA cops shooting a guy that comes out of Hardee’s?   He swung a shovel at them and got shot 10 times.  6 by one guy 4 by another – cops in uniforms with backup and tasers.

    The shots took a total of 2-3 seconds got get off – all 10 of them.  After seeing that video I will *never* *ever* think ‘oh that must have been overkill’ – when you are in fear – even a cop can shoot too many times – and with a gun that can empty a clips as fast as you can pull the trigger ‘stopping the threat’ can mean an empty clip.

    Now I DO understand the whole keyboard shit. WE got a new laptop & I keep scrolling with the pad when I don’t want to & get extra letter or letters undesired when typing.

    I’ve never seen that specific video.
    There’s something called “Escalation of Force”.  With the Escalation of Force it’s not cut and dry. There are many variables which may not be knowable, or obtainable by someone witnessing the incident from a random starting point on a tape.  It involves perception, words, wording in a report, threat, mitigating factors…etc.  “Guy with shovel shot 10 times, that’s black and white, no such thing as overkill” doesn’t work IRL.

    My argument wasn’t that Santana ran after him with a shovel, and Harris was fearing for his life.
    My argument was that they had words, Harris whipped it out probably along with curse words threatening Santana, who, through impulsive self-preservation lunged at him, so Harris itched his itchy trigger finger from more than a foot or two away.

    Harris “license to carry may have been revoked”, saying he most likely has brandished it and threatened use of it before. (It’s an assumption).  If Harris had obeyed the laws and there was no assumption of danger on Harris’ part towards the General Population, most times his license wouldn’t have been revoked.

    Sorry for the long response.  But you cannot compare the two.

     Hrmmm – I wasn’t saying he was right – only commenting on the general (and public because this always comes up in home invasion type situations) opinion that seems to think someone can pull a trigger once and stop.

    I don’t think it’s that easy – once you make that decision that pulling the trigger has to happen – to stop.  I point to the situation with the cops only because they train to overcome that reflex.  If an officer can get carried away then I don’t look at ’6 shots’ or ‘empty clip’ as evidence that he went for the kill.  *I* would look at the other factors (was the guy running and shot in the back – or close range headshot or ‘double tap’) that indicate it was more than just reflex.

    The video isn’t that clear.  (I had to go to youtube to find it).

    However, he was apparently shot 5 times, according to your link, and he was wielding what appears to be a conduit pipe bender, (what electricians and plumbers would use to bend less than 1 inch conduit, picture inserted…the article thought a sledge hammer?). Conduit benders are pretty solidly made, they would do a LOT more damage than a shovel.

    You can also see him rear back and blade his body in an aggressive stance, which says he is poised to attack.  The first set of rounds that were shot, stop when he falls, the second set comes from a different shooter and may have been excessive.  I wasn’t there so those are just my assumptions.

    I didn’t intend for my statement to appear that “1 shot and you should always stop” if you feel you must continue firing to neutralize the threat, you’re only free and clear until the threat is gone, after that it may become seen as excessive.  I was postulating that Mr. Harris wasn’t in any immediate danger of bodily harm, UNTIL he brought his gun out, so even 1 shot WAS excessive.

    Yeah that used to piss me off too, and I put a new top on the convertible so I was constantly worried that el fatto cat across the street was going to tear it at some point.  I’ve since sold the car but let me catch that fucker on top of my new Lexus and it’s ON!  Don’t like them either.

    one witnesses testimony says that santana went over to talk with harris.  Politely he asked, “Please don’t let your dog poop in my yard.  Please come clean up after your dog.”  Harris proceeded to say, Are you getting cocky with me?” pulled out his gun and popped him in the face, after which santana went down, harris then popped of five more rounds into the man.  Terrible shot if he fires 6 rounds point blank and only hits 4 times.  The eye witness said nothing about a struggle.  Must be harris trying to make up for the fact that he is a terrible shot, who would admit they have a 66% hit rate at point blank range
