James Whalen Autistic Boy Set On Fire At SleepoverLAWRENCEBURG, Tenn. – James Whalen, 12, is suffering from third-degree burns on his face and neck area with less serious burns on other parts of his body, after a teen doused him with cologne while he was sleeping and set him on fire.

Trudy Smith said her son is autistic and that he’s been bullied in the past, including having a tooth broken and being urinated on. But she allowed him to attend a sleepover thinking that he and the 13-year-old boy who lived there would be the only kids there. Turns out there were 14 children there.

Whalen says that after he went to sleep that night, he woke up in pain.

“I went to sleep. (The) next thing I smelled something good then I felt something burning then I smelled something good again and then I felt fire,” he said.

Turns out someone thought it would be hilarious to douse Whalen with cologne and then light him up.

With his shirt on fire he ran to get help, falling down the stairs and setting the carpet on fire. Adults in the home doused the carpet with water, and according to Whalen, he was doused with Dr. Pepper.

According to Smith, police are charging a 13-year-old with aggravated assault and his mother with reckless endangerment. Smith says she was interviewed by DCS and was surprised to find she could be at fault.

“They’re looking into a lack of supervision charges against me, for allowing my child to spend the night at a friend’s house,” Smith said.

    at any sleep over i attended, it was 6-8 MAX. because a group of kids hopped up on soda, and snacks was a disaster in itself. and the parents gracious enough to watch us brats seemed to realize that, and only allowed a select few to stay the night. seems reckless on their behalf to me.

    Is the article reporting the order the parents handled the fire? It could be that one of the adults was holding a drink and quickly dumped it on James because it was the closest liquid. Once that was handled, someone could have dealt with the carpet a bit more leisurely.
    That makes a little more sense to me than someone running to the kitchen, opening a can of pop and dumping it on him after they’d taken care of the carpet.
    The article mentions the kid who invited James was 13 and so was the pyro bastard. I wonder if they’re hinting at who did it.

One even admitted that throughout jr. high he had gone to school every day with the intention of making me cry.

    When they apologized to me (some literally crying), they all said the same thing- they were miserable at home. Their parents were frequently abusive, but neglectful at best, they hated themselves, and they just wanted to make someone else hurt. But none of them were children of ‘time-out’ parents, they all practiced corporal punishment.

    If their parents had been loving, involved parents, I don’t think any of them would have been bullies (I wasn’t their only target, by a long shot), no matter what discipline style their parents used.

    But unless some particularly damning evidence against the parents shows up, I don’t think they can be held accountable for this. The kids were sleeping, presumably the parents were too. No reasonable adult would think “I’d better stay up all night watching them in case one of them decides to light someone else on fire.” This wasn’t lack of supervision, this was (at least) one kid who is seriously fucked in the head. Might not even be their kid! How’s that their fault?

    In California, you’re allowed to have a home day care with 12 kids if you have two supervising adults. The story mentions ‘adults’, plural, so at worst they were two kids past the limit allowed for professional child care here.

    No idea what the law is in TN, but especially if they’d had more adults over earlier in the evening (when the kids were awake), it doesn’t seem that out of line. Crazy, for sure, but negligent?

    If the result is an autistic child getting torched? Again, not criminally negligent, perhaps, but civilly so.

    I don’t know what California’s regulations are for child care workers goes, but I’d be surprised if there was no training required and no necessity for them to be in the same room (for at least most of the time). Something tells me that, if an adult were IN the room, this wouldn’t have happened.

    So, I don’t believe daycare laws serve as much of a defense in this case.

    But… that’s entirely beside the point, frankly. If I slip, fall on your stairs and break a bone, you’re liable, whether or not you were there to see it or assist me. If injury occurs in a household, the owner (or renter, depending) of that household is liable. I want to see someone other than the mother of the autistic child (what bullshit, unless prosecutors know something I don’t) held liable.

    I see where you’re coming from – it’s quite unfair if the owner of the house was not the parent of the offending child. But, that’s the way the cookie crumbles. And, I don’t care… 14 tweens/teens in one house at one time is asking for trouble. :P

    The thing I don’t get is usually if my daughter goes to anyones house, let alone a sleepover, I make sure I know whom all will be there, let alone if she was autistic. How did this mother not know there were more than one other child besides her own going to be there? I really hope something comes from this and the boy who did this learns his lesson.

    If I recall (and I could be wrong), the article didn’t state to what degree he assaulted the kids. For all we know he could’ve given them a well-deserved spanking. My point is that it didn’t seem like he beat the shit out of them, but these days you can be arrested for mere spanking discipline.

    You’re right…. they didn’t say to what extent he assaulted the kids. But, I can only assume it was more than a spanking, given the fact that he also assaulted his wife. That shows a certain degree of uncontrolled anger. But, who knows, maybe she had it coming to. Obviously that’s the way he saw it, anyway.

    I am not defending the kid or kids who did this, but I believe kids that age act and don’t think quite a lot. (I even remember a few instances of my own.) Seemed like impulse equaled action altogether too often. Thus, parents would get the infamous, “I don’t know,” answer from their kids when they asked why the kid did something so stupid, destructive, tragic . . .

    I hate to think that these kids lured the new kid, an autistic kid, to the party with the express intention of bullying him somehow. But that might even be on the table.

    It sounds like the kids were having a birthday sleep over. I typically allow my kids to have parties (not sleep overs) where the number of invitees equals the number of years being celebrated. I couldn’t stand that many kids for an entire night, though.

    We can only believe that all parents related to this case did not believe, reasonably so, that no one was going to set a kid on fire regardless of the number of kids. The inviting family was new in town and probably had no idea that at least one of the kids (who started the fire) was immature/troubled enough to do something so mean and stupid. We know the hosting mother was there and we can guess that the father was there and possibly grandma and anyone else we can dream of. I doubt any of these kids will play with fire again.

    Law suits are America’s favorite past time. What happened to communities that try to perpetuate harmony by not only helping the underdogs, but everyone else too?

    US supreme court has recently ruled that vaccine makers cannot be held accountable for harm their product caused, even if that harm was due to a known design defect. Autism is otherwise known as vaccine damage, in some circles. Circles which are expanding and growing ever larger in number.

    I used to think that there weren’t a lot of americans aware of the recent Bruesewitz vs Wyeth ruling, but then I heard that the economy is seeing an uptick, ahahahah.

    If you’re of the system that did this — if your living is intimately entangled with the system responsible — you’ll do anything to harrass and silence those who threaten you.

    Funny how Socrates would have said the same thing about “kids today” 3000 years ago. Yes, some kids really are spoiled brats, just like some kids back in the day, but they are not the majority. Ditto for low-life dirtbags, like the ones who set the kid on fire. Such wastes of oxygen are aberrations, not the norm, and juvenile crime is now lower than it was in most of the 1970s.

    For the data about all the debt that young adults (especially college students) are racking up, ever stop to think that is because the cost of college has dramatically outpaced inflation over the past few decades while real wages have stagnated or declined for those at the middle or bottom of the socioeconomic ladder?

    As for texting while driving, a recent study finds that adults today are actually WORSE than teenagers when it comes to engaging in this stupid and reckless activity. And overall traffic fatalities (alcohol and non-alcohol) among teens are now at a record low despite the fact that there are more teens alive today than ever before and that nearly all of them own cell phones.

    While that is true, take a look at the NAEP scores 30 years ago. Not exactly something to brag about either. Funny how we have some of the highest scoring 4th graders in the world, but by 12th grade, they trail the pack. Our educational system is a joke compared other countries despite actually spending more per student. But take a look at another country who HAS found a (rather counterintuitive) way to make their own school system work wonders–and interestingly it’s not one of the ones you think.

    Why are they charging the poor kid’s mother for lack of supervision? I mean the kid is 12, not 2. Millions of kids that age and younger are allowed to go to sleepovers at friends houses, at least that was the case when I was that age in the 1990s.

    Oh yeah, as for teen pregnancy, the links you posted were outdated, showing a brief and small increase in the teen pregnancy rate in 2006-2007 after plummeting dramatically from 1991 to 2005. Fortunately, the decline resumed, and the 2009 teen birth rate reached the lowest level on record since WWII. Sorry to burst your bubble.

    And yes, cannabis use among teens is modestly rising (though still lower than ten years ago and lower still than the all-time peak in 1979), but all other substances are now either fairly stable or still declining, and both alcohol and tobacco use are at a record low in 2009-2010. Overall, that’s good news. They’re using milder substances, and less overall drug use than a decade ago. despite facing a bleaker reality overall.

    No the mother that the state was trying to charge was me.(James mom) they never did anything to the child or the parents who did this. After 8 months we finally got a court date but the other ppl moved out of state and they will not bring him back because he is a minor. Kinda fucked up huh

    it has been over a year since this has happend to my son and I have found out that he was lured to the home. The child that was “his friend” was friends with a child that James was having trouble with at school. The other kid had choked my son in class and the teachers had to stop him. They made plans to get James away from the adults, being he could never get to my child without an adult around. So, the “new friend” came over to the house to ride bikes and hang out with James. He was very polite and attentive to James in my home. After a month I finally broke down and let him spend the night after meeting and speaking to the mother and older brother along with his wife( the adults mentiond in the article) three diffrent times. I was assured that the only ppl that would be in the house was the mother the brother and the wife along with her children. I never dreamed this would be a set up for the other child to get to my som

    It was the parents child that actully lit my son on fire. within a week of this happing they moved out of state. I later found out that the reason they moved here is because they left another state due to there child being charged with hurting another child not to the extent my son was hurt but still hurting them

It amazes me the lengths kids will go to in order to bully someone.  And for what?  A cruel laugh?  What has happened in regards these mean kids?  How is your son, James, holding up? And did the police charge you after all? Did it get to court, if so?
