Delaware —  Nicole Hoffman, 18, was driving in excess of 90 mph with a blood alcohol limit almost twice the legal limit while texting when she lost control of her car. Her vehicle left the road and flipped, ejecting 20-year-old Shawn Zimmerman who died from head injuries. On Friday, Judge Jan R. Jurden sentenced Hoffman to nine years in prison for her trifecta of driving idiocy, more than four times the minimum mandatory and three years more than what prosecutors were even asking. The judge went on to ban her from social media websites during her four years of probation and once she is released, to speak at every public high school in the state about the dangers of drinking and driving and texting while driving. The reason for the harsh sentence stems from the fact that Hoffman’s Myspace page was littered with pictures of her drinking underage, and the fact that on the weekend before she was going to plead guilty to manslaughter, she was arrested for underage drinking and disorderly conduct and a second time for assault. Her lawyer was disappointed with the outcome, stating her family was not prepared for such a harsh sentence. Personally, I feel the sentence was too light. I also feel she should have to talk to schools now, in full prison garb.

    Her parents weren’t prepared for such a harsh sentence….I am sure thats true. Maybe they should have been taking away her alcohol and car keys. I think she got off way to easy because she probably won’t even have to serve 3 years.

    I am pretty sure Mr. Zimmerman’s family was not prepared for the harsh reality of losing thier loved one either. I wonder which reality Ms. Hoffman’s family could live with easier? I think they got the better end of the deal myself.

    Could not POSSIBLY begin to manage to agree more with this statement. GOD I fucking HATE selfish morons like this!!!!!! Evil, truly. I hope she does some good with her speaking at schools; her mugshot doesn’t really show her looking too repentant, which bugs the FUCK outta me. And I feel terrible for the Zimmerman family, however the kid WAS dumb enough to get into the car with this stupid bitch…

    Not to sound inconsiderate, because the pain of losing someone so young is not lost on me, but Mr. Zimmerman should have known better than to get into the car with someone under those circumstances. I reject the idea that he should be absolved of responsibility simply because he’s dead. No lessons are learned that way. The fact is, this kid had his life in HIS OWN hands and he pissed it away getting into a car with a drunk broad. He wouldn’t be dead if he had done the right thing and talked this chick OUT of driving. He was no more concerned about that family of four she could have wiped out than she was.

    If it had been the other way around and Nicole had been the one ejected, he likely would have been charged with her death, even though he wasn’t even driving… BECAUSE THE PASSENGER IS STILL RESPONSIBLE. This should never be forgotten, even in light of such tragedy. Sucks that someone had to wind up dead, but they were both idiots.

    Now, on another note, this is partially why I’m more maddened by her behavior after the initial arrest than I am about the accident itself. Drunk driving is stupid, yeah, and it’s absolutely terrible when someone dies as a result. But when that someone was a willing participant, I feel a little less sympathy. But turning right around and actin’ a fool, THEN posting the pictures on a social networking site, illustrates blatant and brazen disrespect for personal responsibility, for the young man’s death, and it illustrates a likelihood to reoffend.

    That likelihood to reoffend is key. It is THE biggest justification for a harsh sentence. I hope she doesn’t regain freedom until after she’s turned 25 (at the earliest) and that she’s grown up a lot in the meantime. If I was her family, I would have been to embarrassed by her to make a statement about the sentence.

    This girl is a disgrace and deserves all she got and more. Driving 90 mph drunk and texting at the same time shows how stupid she is. She’s probably a self absorbed, big headed teenager thinking she knows everything already. How dare she take another person on her wild, irresponsible ride that they paid their life for. That little bitch needs to get tuned up in prison to let her know where she stands. I hope she has dreams every night of Shawn Zimmerman. I’d beat her ass if I could.

    I would not want to see impaired drivers any less accountable – especially one who’d caused injury or death to others.

    I hadn’t thought about it before, but after reading the prior posts, am entertaining the idea that willing passengers should bare some of the responsibility when the driver is impaired.

    Perhaps it should be illegal to both:
    a) be a passenger in a vehicle operated by an impaired driver, and
    b) to fail to report an impaired driver.

    True, they were both idiots, but the responsibility falls more on the driver in this case; the driver (drunk or not) takes on the responsibility of not only herself but the people in the car with her, whereas the passengers are not responsible for anything that happens in the car aside from making sure they don’t interfere with the driving/safety. In all likelihood, Mr. Zim was *also* drunk (but don’t quote me) and *his* decision-making capabilities also severely impaired. So there is probably underage drinking/stupidity all around…if he hadn’t been drunk himself, perhaps he would have had the sound mind to take her keys away from her/take over the driving duty instead.

    Personally I think it’s a light sentence….

    I agree with you. I think what made me mad was the statement by the family of the young lady. If we as parents do not draw the line and realize the magnitude of what has happened how can we expect our teens to do so. I think that is why 25 is an important number to you. (by the way I know 30, 40, 50, and 60 yr olds that still do this!) We both know that she will only internalize this and whine “why me?” well, It is a parents job to explain to her that she was the one responsible when she took that first drink, drug, and then decided to drive like a mad person. She took a life just as sure as if she pointed a gun at him. I hold him responsible too, but he has already paid, he is dead. I think that was a pretty stiff sentence, but it is the sentence that life dealt out.

    She is obviously a young lady with a very serious drinking problem. Even if she and her passenger would have arrived home safe that night, she most likely would have killed someone in the very near future.

    I agree Morbid, the sentence is way too light. Drinking and driving with a fatality(ies) needs to have a harsher sentence. Drunk driving needs harsher sentences period.

    Two years later it paid off in a way… $800,000 settlement. The girl only got something like 40 hours community service though, which is pretty fucked if you ask me.

    I’m not convinced this chick has a drinking problem. If anything, I think she’s got a narcissism problem. If I had to guess, she’s got parents (maybe wealthy) who’ve bailed her out of any trouble she’s ever been in and have inadvertantly taught her to blame everyone but herself. Her behavior after release strikes me less like someone who needs rehab and more like someone who has no respect for consequence.

    Anyone who texts and drives should have their cell phone shoved up their ass. A couple of months ago my car died on me and I had to call for a tow. I rode with the tow truck driver to the mechanic so I could call for a rental car. The freakin’ tow truck driver was texting while driving down the highway–no joke! I was in fear that I would soon be Grilled Cheesemeister as he flipped the damn tow truck and it burst into flames.
    This little girl got off easy, in my opinion.

She got 30 years, but only has to serve 7 and be on probation for the rest. My cousin is in prison right now too on an unrelated charge. Their kids are living with my grandma and totally fucking up their own lives. Those little bitches are driving my grandma into an early grave. When people make stupid, selfish decisions they need to realize it doesn’t just affect them.

    We will see a lot more of this type of fatality – it is bad enough that teenage girls go through some weird dis-associative fugue state throughout their teen years – but adding technology, alcohol and a motor vehicle to the mix is only going to prove that Darwin was right. Sadly, someone innocent was killed – 9 years for manslaughter? It does not speak well to the value of human life . . .
