Detroit – On August 1st, 2009, 24-year-old Trisha Babcock was sitting in a parked car when she was approached by a man with a gun who intended to rob her. A struggle insued and Babcock was shot in the chest, her purse stolen. She would later die in the hospital, but a fingerprint on the windo of the car would lead police to the shooter. 12-year-old DeMarco Harris. He was charged with felony murder, armed robbery, having a firearm during a felony and violating curfew. Under Michigan law, he could not be tried as an adult, but prosecutors filed the case with an adult designation – meaning the judge can impose an adult sentence if they want. Yesterday, Judge Sheila Gibson sentenced Harris to juvenile detention until he turns 21. At that time he will be re-evaluated by the court and a decision will be made on whether he goes free without serving any prison time for murdering a woman in cold blood or will serve the rest of his life in prison without the possibility of parole. Babcock’s father is not pleased. “I feel he should definitely spend the rest of his life in prison,” Steven Babcock told CNN. “For him to have a chance or opportunity to be set free when he is 21 is not justice for my daughter.”

My son is 5″10 and 150 lbs with a size 11 men's shoe in 5th grade but he says yes mam and no sir to everyone he meets. He's the most humble kid you'll ever meet. This kid must have been raised THUG LIfe or by the Crips or Bloods to do something so Brazen and Cowardly at such a young age.

    Lets not start getting all stabby yet. If there is any justice in this world at all…then this kid is looking at the rest of his life being spent behind bars where he belongs.

    I don't think anyone who murders in cold blood like that, even at 12, should ever get out. You took a life, she does't have the oppotunity for parole now does she?

    I'll be honest… I think this is actually a good decision. Although the reality of the situation is that this 12 year old is “probably” not going to straighten up and become a productive person, there is a chance. IF he gets therapy and proper guidance (no matter how unlikely it may seem) he could learn.

    At 12, a child's brain is not fully developed. It won't be for another 12 years or so. I agree 100% that unless he is retarded, he knew that what he did was wrong, but at that age, and without having learned self-control and morality, he is really not fully responsible for what he did.

    Just to put this in perspective, if this was a 12 year old who had been promiscuous and an adult had had sex with him/her, we would say that the child is incapable of making a good decision and thus cannot be held responsible. For the same reasons, it seems that it is necessary to defer this child's ultimate sentencing until he has grown up and can be evaluated then.

    Believe me, I fully understand that the victim will never have the chance to be re-evaluated and I don't think that this boy should count on ever getting out, but it seems wrong to sentence him for life when he has not even become an adult.

    OK, that's it for my bleeding heart, for now.

    SOMD was a woman on another post who was advocating that some other kid not get life or something. I can't remember which post she's on, it was fairly recent, but she was saying something about how the kid shouldn't go to prison for life and blah blah blah. Her name stands for “State of Maryland” I think and she's a cop or something. Everyone was giving her shit it was pretty awesome. Maybe Kev can remember which one it was on but I can't.

    SOMD chimed in a few right ups back when a kid beat up his teacher in front of the class talking about poor kidd going to jail should have just kissed him and told him to try and do better and that jail was no place for a youngster that it would only make him a monster.

    So I just have never forgotten about her criminal rights activity on the site.

    yeah I saw nothing wrong with that decision. In fact, it seems as though they did their best to circumvent the state laws in order to give him the maximum punishment possible. I wouldn't be surprised if he got another 60 years after he turned 21.
    Assuming the victims family are still around. If not, then yeah, it's very possible without some sort of context to show the jury he could go free. But, I dunno, I think they made the right decision.
    And not to defend him, or to say he just get a lesser punishment, but rather just as a curious thought,
    I try to imagine what it would be/feel like to make a mistake (on or not on purpose) that basically sets an incredibly narrow path for the rest of your life. It's like, when I fuck up, I think about the shit I gotta deal with to clean it up, but I can't really imagine thinking, “this is pretty much my life, no matter what.”

    I work for SOMD too and depending on circumstances it is messed up that these kids get to be free when they are 21. I think MD is working on laws to impose adult sentences for juveniles after they turn 21 if needed.

    Completely different crime and different circumstances, but Smith still committed a murder when he was 13 and will hopefully *never* get out of prison. He knows what he did, so it's not exactly a stretch for anyone to believe that this kid also know what he did was wrong.
