Warsaw, Ind. – I had to spend my Friday off replacing corroded freeze plugs in a Jeep Cherokee. There were times during this replacement that I wanted to punch the designer of the engine in the mouth. Anyway, it kept me from posting a few stories so I am making up for it now. Starting with 15-year-old Cody Lundy and 12-year-old Paul Gingerich. You may have heard of this already, but the two boys found out Friday morning that they will be going to adult court for the murder of Lundy’s step-father, 49-year-old Phillip Danner. A third boy, 12-year-old Chase Williams, will not be facing the same fate as he did not pull a trigger, but rather served as a lookout. A fourth boy has not been charged, but that may change. Prosecutors allege the three boys planned the murder of Danner for weeks, with Lundy and Gingerich each firing a shot into him at his home. A probation officer testified in court on Friday that the boys would be better re-habilitated if charged as adults because if they were to be placed into a juvenile facility, state law demands they be released at the age of 18. The judge did not like that so now they are now to be moved from the juvenile facility they have been staying, and will enter the world of adult incarceration. Lundy and Gingerich are facing up to 65-years in jail or prison. Watch some video after the break.

    As horrific as the crime is, I can't even fathom putting a 12 year old child in prison, especially for the rest of their life.

    Rotten little squirts. Nice to see a judge who isn't willing to let the 'they're just children' excuse stand in the way of delivering justice. These boys were more than old enough to know better, and the child excuse I see used too many times downplays the severity of their transgression.

    And really? Jeep electronics make me want to mash my fuckin' head through a wall. Try doing ANY work on a dashboard in those beasts. Makes my '69 Triumph Spitfire with its mangled Lucas Electrical wire harness look like a masterpiece of electrical engineering. :)

    Tough shit ! They probably like to think they're “thugs” & thought it would be cool to kill someone. I believe the onus of the charges should be with the 15 year old, since he should have more fucking sense than the other 2. It's a hard way to learn a life lesson in an adult prison, but again, TOUGH SHIT!

    I couldn't agree with you more on that. In fact there was a case that happen in 93' that still bothers me that they let these kids not go into jail and lock away the key. The death of James Bulger if anyone remembers that one. Just a two year old with his mommy who was taken away and tormented.

    I understand where you are coming from but at 10-12 years old they should know right from wrong and that killing someone is wrong. Sure they may sit in juvenile until they are 18 then sent to adult prison and even if they were released they may not ever commit another crime again but why take the risk? They killed someone, they should have to pay for it for the rest of their lives like adults do when they commit similar crimes.

    Yeah. I don't really like the idea of putting anyone in prison for the rest of their life, but, then again, some people just have to be separated from the herd. But perhaps they had a good reason for killing him…

    I could never condone putting a child less than 18 to death, maybe 20-30 years in prison till they become and adult depending on the circumstances but not putting them to death… If anyone ever read the Innocence Project, I know from reading the comments here most people are fair, there are lots of people condemened to death and later they find out they were innocent, one that really buggs me is Cameron Todd Willingham, he was accused of burning his toddlers to death in Texas, convicted and executed, later they found out he didnt do it, can you imagine the pain this guy went through? he was screaming my babies, my babies and trying to go back into the burning house… Google him, and then also go to the innocence project dot org and see how many have been aqcuited on DNA evidence, I am not making excuses here, if someone is guilty they deserve all of this… but if they are not, this is too cruel… I love this website though, just have to log in everytime I try to make a comment…

Metric, Standard Metric Standard, Why can't they make up their friggin minds?

    About step children watch your back! I had one that scratched my face and went to school and told on little old me????!!!! All I did was put my had across her mouth cause she was cussin and she said I was chocking her and she couldn't breath. Man she was a rough one to raise but she loves me now and is pregnant with her second baby. I wish her the best but she threatened to kill on more than one occasion while I was asleep.

    We not only have the death penalty here in Indiana, but we apparently import folks to kill from other states. We executed Timothy McVeigh here. We're like the Texas of the North. Well, not really, since they've executed 454 folks since 1976 to our 20, but it sounded good in my head.

    Interesting question to ponder: is death penalty a possibility for these teenagers? I actually don't support the death penalty for anyone, no matter the age or how heinous the crime. But if one does support the death penalty, I think it could seem hypocritical to say it's fine for adults but not for teenagers. A crime is a crime, and if that's all it comes down to, then that's all it comes down to. Anyway, I'm really wondering at this point why they shot him.

    Yeah, I remember the Willingham case. Seriously messed up miscarriage of justice to be sure. But, I also remember the case of James Bulger, and the two 'kids' that killed him have been in some fairly serious scrapes after their prison stints. Some kids are broken and need to be removed from society forever. Any one that could aim a gun at another person and take their life needs to be locked up for the rest of their lives. These boys are no exception in my book. Why take the chance?

    I went to that link and that story that happened in England is just horrible, probably worse than anything I have read on the dreamin deamin, and thats saying something. I know it is off the topic of what is being talked about here, which is bad enough. 10 year old boys took that baby and mercilessly killed him from a shopping center. Anyways if anyone reads the link they should be happy to know Jon Venables one of the murderers who was living under an assumed identity after released from prison, has been returned to prison and his cover is blown. This just recently happened. It is probably a matter of time before he gets killed in there. Read the link UniqueMommy 1984 posted, it will break your heart. Sorry to get off the subject. If you read it it is a good example of kids that should have been sent to prison for life, something I don't necessarily agree with.

    The Supreme court has ruled that the DP is unconstitutional punishment for those who committed their offenses as minors; the most serious penalty a minor who is being tried as an adult for crimes in the US can receive is LWOP.

    I believe it is a fitting justice. They killed the provider of their home. A person who worked to give them food and the basic essentials everyday. They should rot in prison til their old and gray.

    If these two boys planned this for weeks they didnt just flare up in anger over a situation ,best wait and see what the father has done to deserve being shot and yes I truly know they didnt have to have a reason but this doesnt add up. It sounds, to me mind you,like they were fed up with something possibly sexual abuse to go to the trouble of planning for weeks. We will hear both sides eventually
