Man Faces Prison Time Over ‘Accidental’ Child Porn

SACRAMENTO – Here is a nice warning for all you guys out there surfing porn. Be REAL careful where you get it. Now days, there are sooo many free places for decent porn that there is no excuse to be paying for it or using applications like Limeware. Just ask 22-year-old Matthew White. Two years ago he says he was downloading porn via Limeware when he found that some of the images contained child pornography. He immediately deleted the pics and continued looking at his porn. One year later, the FBI wanted to look at Matt’s computer, which him and his family allowed. The Feds didn’t find anything at first, but later found the images Matt had deleted. Now facing 20 years in prison for possessing child pornography, Matt decided to plead guilty hoping to get a three and a half year sentence. He will also serve 10 years probation and have to register as a sex offender for the rest of his life.

Now before any of you call bullshit on Matthew’s claims, let me just say it does happen. I’m completely desensitized because of all the porn I look at. In order to get aroused, I have to watch porn involving midgets, dung beetles and battery acid. My last girlfriend left me in frustration because the only way I would get sexual with her is if she pretended to be a dead Guatemalan maid. In other words, using some of those file sharing programs can be sketchy, especially when searching for sketchy material. You just never know what you are gonna get. What you were looking for, a virus, or a pic of a crying 3-year-old girl holding a man’s dick.

I’m not saying that Matt is telling the truth, I’m just saying the scenario he describes is a known one. I had always just assumed that simply deleting the illegal pics would keep the Feds at bay seeing as there are actual distributors of this crap they could be going after. But it is interesting that the FBI suddenly, a year after the images were deleted, decided to focus their attention on Matt. I’m curious if Matt’s decision to plead guilty has less to do with trying to get a lighter punishment, and more to do with him knowing there is enough evidence to show more than an accidental acquisition.

    so what happens when you click on porn and then pop up after popup ends up taking you to child porn. Then you frantically click out as fast as you can. But you didnt get the urls, sometimes it happens so fast am I now label as a sicko? I have reported websites when I can get the urls. I mean I like looking at porn to but these sickos ruin it with the cp and beastiality porns. I mean really sick!

    I absolutely tried to UNREAD that statement. Unfortunately, I couldn't. Now I'm stuck with the image forever. *shudder*

    It wouldn't be so bad if these things didn't actually happen. This is a sick god damned world!

    This is a sad thing if he's not guilty, and it kinda seems probable that he's not. I wanted to mention two things about the article- The first is a small typo, easily overlooked but fairly important or I wouldn't mention it- On the screenshot, the website is limewire; you have it listed as limeware. The second thing is just to clarify- in the first line, where it says "...all you guys out there surfing porn..." is that intended to be a gender neutral comment? I suspect it is, but I wanted to make sure, because I have spent a fair amount of time surfing porn myself and would not want to feel excluded from the warning. :D (I am not nit picking in an attempt to be PC, please don't misunderstand!)

    It’s disgusting yes, but its even more digusting to get punished for childporn and have it on your record for life when you haven’t done anything to deserve it.

    Wrong, almost every program that you can "accidentally" download child porn is a P2P program. It means its peer to peer..direct IP connection to another persons computer. You pull the file straight from them. The programs themselves have no control over what people share except if it's reported.

    People don't waste virus's on putting child porn on someones pc..if you have child porn on your pc and it's related to anything virusy like, it means you've been rooted (which technically isn't a virus it just means you fail using the internet and securing yourself properly) and the people who put it there have total control over what's on your pc. And very seldom do people use rootkits for child porn, usually it's for heavy duty warez passing or throttling websites (read huge secured websites..like government sites) into the ground. Crimes that get you more time then child porn would ever get you sadly enough.

    That's why it's important that people report it if it happens. If it's done right away it's almost 100% that the IP is still logged and actively distributing it. I'd rather people think I'm some kind of kinked out circus freak because of the porn on my pc then have some pedo get away with crap like that.

    Maybe I'm naive, and hubby's not home so I'll show my ignorance on here, but wouldn't something like that show up rather easily as something unintentional? At least to qualified 'puter pros? I can see where someone could get blamed for downloads off of limewire and such, because even though tho CP was not the intent, it was still downloaded purposely because someone may have thought it was something else or whatever happens in those cases. But if a virus hits you, it seems like that would be fairly easy to see that the files had not been actually accessed. But then again, maybe that's me being naive. Either way, I think that it would create a hell of a bad time in proving yourself innocent. *thinking uneasily about the terrible, horrible virus I picked up TWICE in the last couple months*

    My nephew goes on the website TesseractHeart mentioned since I gave him my account from when I was sill a teen. I remember when the troll was posting the CP on there. He ran to my office and said that he was gonna go to jail and cried until I told him it wasn't his fault and that it was probably some sicko from some site called 4chan or something. Now he refuses to even log into the site anymore and he cries when the police are on the street.

    I did have a neighbor on my street who was with his wife downloading orchestra sheet music for christmas from one of his fellow clergymen only to find out it was a folder packed with child porn.

    Biggest problem here is using limewire. Sheesh, who doesn't know they track that like crazy and'll get you on anything from illegal music to CP, apparently? Use bittorrent or something.

    But yes, this sort of thing (accidentally running across CP) is pretty common. I remember just recently that a big forum, gaiaonline, had a troll posting CP pics and a bunch of kids were panicking about going to jail for accidentally viewing it.

    He should have reported it, but again, it's easier said than done, and most people would just delete and go on. I'm not really blaming him for not doing that. I think there really does need to be some sort of process to try and weed out people who ended up with it by accident. Only problem is what the process would be.

    Because, often times, child porn investigations start by the authorities stumbling upon (or being tipped off to) a porn site, then identifying the machines that site downloaded to. This can take a considerable amount of time. And they bother because this country is rabid about convicting child porn possessors. Not necessarily saying they shouldn't, but being rabid about ANYTHING is going to result in sweeping initiatives that haven't been well thought out and are bound to make victims of otherwise innocent people.

    I can see the kid not immediately reporting it, though he should have. I just don't understand the 1-year wait either. And considering that my husband is a 'puter genius (though unfortunately we are definitely like the shoemaker's barefoot children sometimes as I wait for him to fix whatever I did wrong), I know how easily it can be verified/documented with file paths and blah blah (*I* am not the pro, hubby is--I don't need to know the real terms as long as HE knows what I mean by thingamajig).

    Yes, I can see this happening accidentally and that would be HORRIBLE. I don't know what I'd do in that case. I've been reading wikisposure lately and refuse to click on any outside links (not to actual CP of course, but to their pedo support sites--gag) because I'm so paranoid that this may happen to me while I'm trying to research stories and criminal psychology.

    I think that public education about reporting links or activities like this would go a long way toward making sure that convictions are not of innocent people.

    My hubby had the same thing happen with a program called Kazaa. He put on a pile of stuff to download overnight, which isn't odd in our house considering his work is centered around porn albeit not the stuff most people watch >.>. He woke in the morning to find some of the files were child porn. Big difference here..my hubby reported it and got thanked instead of thrown in jail and having people think he's a pedo. Shame the kid didn't think to report it, could have saved him many years in jail and a lot of heartache.

  • Yep... it certainly does happen. We probably don't even know how often. I'm familiar with one particularly heartbreaking case where a man had taken his computer into a repair shop because it had been infected by a virus. While repairing the computer, the guy found kiddie porn. Turned him into the feds and, even though it was pretty obvious based on where the files were found that they were probably deposited on his machine without his knowledge, they prosecuted. The man lost his job, his family, his friends, his belongings, absolutely EVERYTHING. A few years later, the feds dropped the charges because, after expert review, they found the program responsible, proving he was unaware.

    Unfortunately, by that point, the damage had been done. That's a hard stigma to shake.

    As for this kid? It's entirely possible he's willing to plead guilty for a deal. A 22 year old doesn't likely have the funds to maintain an ongoing defense, and he may not have legal professionals offering help, yet. Also, in a case like this, it's really his word against the (old) files on his computer. They can't always tell how they were downloaded, and the fact that he didn't report them upon deleting them makes it look kind of bad. But, on the other hand, if this is the only instance of kiddie porn on his machine, and it's a year old, it's probably safe to say he's not a pedo.

    Ugh. What a mess.
