Boy Accidentally Shoots His Little Sister In The Head

VACAVILLE, Calif. – While still being called an accidental shooting, an 8-year-old boy picked up a firearm, pointed it at his little sister and shot her in the head, killing her. Vacaville police continue to investigate the incident, trying to determine if anyone should be charged with a crime. “It ’s a tragic case of a sibling who picked up a firearm, thinking it was a toy, pointed it as his sister and discharged one round from the firearm, striking her in the head,” said Vacaville Police Sgt. Charlie Spruill. Officers removed four rifles and two handguns from the house but would not state if any of them were locked in the gun safe that was in the house, as required by California law. Both parents were home at the time of the shooting.
So if this was an accident, which the reports say it is, should the parents be charged with any crime(s) if it turns out the guns were within reach of the kids? Or should the result of that fact be enough? Personally, I feel for the parents – but if the guns were not locked up and in the vicinity of these two kids..well, I can see no other recourse but to charge them with neglect or endangerment charges. Some may see that as callous, and I can only imagine what the parents are going through right now, but still.

Besides the 17-year-old girl who actually utters the phrase “like, blood on her face” there is something else worth noting. Watch the video and at the beginning, as the news anchor is talking from the scene, you will see a little boy come from the left-hand side walking to the right just behind the woman. He walks out of camera view at a steady gait, but never emerges from behind the woman. He fucking vanishes! That neighborhood is haunted.

These are tough ones for me. As some may be aware, several years ago, my 16 year old cousin, Johnny, accidentally shot and killed his younger brother, 13 year old Alex, when he picked up a loaded handgun my aunt’s husband (I never liked the guy, so I never called him my uncle even though he was the father of the boys) had stored under his pillow. My aunts husband was cited for negligence which, in that state under these circumstances amounted to a traffic ticket.
Of course, absolutely no punishment could have trumped the damage done to this family. Johnny became incredibly socially inept and skiddish, like a beaten dog. His sister, my cousin Tristen, began acting out due to the trauma and being “forgotten” as a result of the accident, a straight A student becoming promiscuous and eventually dropping out of school. My aunt’s husband pretended like Alex never existed because his death was too painful to face. He eventually killed himself – with a handgun – in front of my aunt after writing “I’m coming, Alex,” on the wall of their living room.
So, really, having seen the damage first hand, any criminal charge resulting from something like this is so moot it’s almost insulting. Believe me – for those of you who know me, you know I’m all about law and order being maintained. But sometimes, like in this case, it’s pointless.

I am just not sure how the law would be able to determine what level of guilt a person who left a handgun available for a kid to kill another actually feels. It’s the main reason why I say that if a law was deemed broken, then the person should be charged appropriately, no matter how bad they may feel over the results of their actions. I’m sure drunk drivers who kill their kids feel pretty shitty too, but I don’t think this fact should get them of the legal hook.

Athena you have good points and since you’ve witnessed it first hand I see where you’re coming from (I’m also truly sorry, I can’t imagine what you and your family went through). However if he’s charged I can’t help but think that someone will see this story and maybe take gun safety more seriously. Almost set an example of him to save more lives in the future. Does that make sense? Like Morbid said callous, but still by being negligent a life was lost….someone should take responsiblity for the crime.

Well, sure, and I’m not necessarily saying these parents shouldn’t be charged with something. My aunt’s husband was charged and convicted and I wasn’t disapproving of it. I’m just saying that, at the end of the day, it doesn’t actually change anything. A person who won’t change their ways after destroying their family sure as fuck won’t be moved by a negligence conviction.

I’m not going to comment on the law or punishment, very sad situation, I know I would be devastated
At the same time if adults with children leave guns around especially LOADED they’re idiots.
I feel for the loss of a child, but the dam parents brought this on themselves.

Wow, this one hits kind of close to home. Partly because this happened in the town next to mine, where I lived for years (It’s not the first time Vacaville’s been on the FP, either).
Partly because last year my best friend accidentally shot and killed another of our friends. She was handing the gun back to him after checking out his new ‘toy’, and it discharged. It should never have been loaded, and it should never have been pointed at a human being. Period.
He was charged with involuntary manslaughter, but the DA eventually dropped the charges. He’s a good guy, and a good father, with full custody of his 7 year old daughter. I don’t see how sending him to prison would have made the world a safer place. As Morbid said, it’s hard to know just how guilty someone feels about something like that, but as his friend, I know it weighs heavily on him every day. If it wasn’t for his responsibility to his daughter, I worry he would have killed himself over it.
Growing up, my father kept a loaded rifle behind my parent’s bedroom door. I had fired guns before I was this boy’s age, and had been taught to respect them. I also knew that under no circumstances was I to ever touch that gun. I never broke that rule (although I certainly broke the rest of them).
If these parents planned to keep guns in the house, they had a responsibility to teach their children about gun safety. There’s absolutely no excuse for an eight year old to think for one second that playing with a gun is permissible. These parents failed their children, and their family, by not educating their son. And the gun should never have been accessible, as a two-year old is old enough to get into everything, but not old enough to be taught gun safety.
But there’s nothing the law can do to them that can approach what their negligence has already done. This boy will never get over this. Neither will they. I think our judicial system has too much to do to worry about cases like this.

He doesn’t vanish he’s hiding behind her back. If you look closely at her arm you’ll see his head going back and forth. Somebody must have motioned for him not to move.
